RESOLUTION NO. 835 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN AUTOMOBILE SERVICE STATION AT 186 EAST DUARTE ROAD. WHEREAS, on October 29, 1973, Standard Oil, of California filed an application for a conditional use permit to add a third service bay to the exis.ting service station, Planning Department Case No. C.O.P. 73-15, on the property commonly known as 186 East Duarte Road, more particularly described as follows: That portion of, Lot 15, Tract No. 808, in the City of Arcadia, County of Los Angeles, State of California as per map recorded in Book 10, page 18 of Maps 1n the office of the County Recorder of said county, described as follows': Beginning at the northeast corner of said Lot 15 thence South 0021' East along the westerly line of Second Avenue (60 feet wide) a distance of l34.07 feet to a point; thence at right angle South 890 39' West a distance of 12.00 feet to a point on a line parallel with and distant westerly 12.00 feet (measured at right angles) to the said westerly line of Second Avenue, sa~d point also being the true point of beginning; thence South 80039' We,st a distanc,e of 80.00 feet to a point; thence North 72039'13" West a distance of 41.47 feet to a point on a, line parallel with the westerly line of Second Avenue; thence North 0021' West along said parallel line a distance of 100.00 feet to a point on a line parallel with and distant southerly 12.00 feet (measured at right angles) to the southerly line of Duarte Road (formerly Main Street, 60 feet wide); thence North 80035' East along said last mentioned parallel line a distance of 102.42 feet to the beginning of a tangent curve concave to the southwest having a radius of 15.00 feet; thence along said curve through a central angle of 9904' a distance of 25.94 feet; thence South 0021' East along a -1- 835 . . . line parallel with and distant westerly 12.00 feet (measured at right angles) to the westerly line of Second Avenue a distance of 102.42 feet to the true point of beginning. WHEREAS, a public hearing was held on said matter on November 13,1973, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. Subject property is developed with a service station and zoned C-2 & D.Property to the north is zoned C-2 and developed with Carl's Jr. eating establishment; pr9perty to the south and west is zoned C-l & D and developed with commercial uses; . property to the east is zoned C-l and contains a vacant service station. Subject property is irregular in shape containing 15,363 square feet with an existing building of 1,269 square feet. The existing service station was constructed with two service bays in 1965. The applicant proposes to construct a third service bay on the east side of the building adjacent to the two existing bays. The addition to the building would be 15 feet by 27 feet. The exterior of the addition would be the same height and constructed of the same colors and materials as the existing structure. This new addition should match the service station in appearance. On-site landscaping will remain the same in the corner planter and in the planters between driveways on Second Avenue and Duarte Road. Two additi9nal planters . are to be constructed adjacent to the front of the structure and an -2- 835 . . . 8 foot by 34 foot planter is to be added to the east of the third bay addition which will offset the existing landscaping deficiency. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, ahd other features required to adjust said use with the . land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the 'kind of traffic generated by the proposed use. 5. The granting of ~uch conditional use permit will not adverselY affect the general plan. 6. The proposed use will not substantially increase vehicular traffic on any stree.t in a residentially zoned district. 7.. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. 8. The proposed use is not located near a place of . assembly. -3- 835 . . . .. . SECTION 3.. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for an automobile service station upon the fOllowing conditions: 1. The property shall be improved and maintained in accord- ance with the plans which are on .file in the subject Case No. C.U.I? 73-15. 2. The service station shall be maintained and operated in accordance with all applicable laws and regulations of the Arcadia Municipal Code including, without limitation, the following regula- tions of Sections 9275.4.5 and 927S.4.7: a. No off-site parking or standing of vehicles of customers or employees. b. No vehicles may be parked on the premises and offered for sale. c. No activities other than the following shall be con- ducted: dispensing gasoline, oil, grease, tires, batteries and automobile accessories directly to users of motor vehicles; tuning motors; wheel and brake adjustment and other minor repairs and se'rvicing of motor vehicles only to the extent of installation of tires, b~tteries and automobile accessories directly to users of motor vehicles. All other activities are prohibited, including (but not limited' to) upholstery work, auto glass work, painting, welding, tire recapping and auto dismantling. -4- 83S . . . 3. The portland concrete cement driveway aprons shall be repaired and maintained in a good condition to the satisfaction of the Director of Public Works. 4. Landscaping shall be installed and maintained in good condition in accordance with plans filed with and approved by the Planning Department. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
