'" RESOLUTION NO. 8.34 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A ,RESTAURANT AT 218-.230 NORTH FIRST AVENUE. WHEREAS, on September 24, 1973, an application was filed by Acapulco Mexican Restaurants, Inc., for a conditional use permit to construct an addition for storage and an enclosed trash area to the existing restaurant building, Planning Department Case No. C.U.P. 73-13, on the property commonly known as 218-230 North First Avenue, more particularly described as follows: Lots 34, 35 and 36 of Block 79 of Arcadia Santa Anita Tract in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 15, pages 89 and 90 of Miscellaneous Records, in the office of the County Recorder of said County'. EXCEPT the easterly 40 feet of said Lots 34, 3S and 36. WHEREAS, a public hearing was held on said matter on I October 9/ 1973, at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the application was thereafter amended to provide for another addition and additional parking; and WHEREAS, a public hearing was held on the amended applica- tion on November 27, 1973, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The subject site is zoned M-l and developed -1- 834 . . . . . with a restaurant, surrounding property is zoned M-l. and developed with general industrial uses and single-family dwellings. The sub- ject site has a width of approximately 160 feet with a depth of approximately 106 feet. The building is now situated 4 feet from the front (First Avenue) property line and 4 feet 10 inches from the side (St. Joseph Street) property line. The M-l section of the Code requires a front yard of 10 feet and a side yard of 5 feet. The existing restaurant building contains approximately 5,041 square feet and seating for approximately 140 people. The applicant proposes to add 936 square feet to the existing building along with an enclosed trash area of' 8 feet by 14 feet. Two hundred thirty-six square feet of the additional area would be used for storage and as space for a cooler and 700 square feet would be used for 14 additional seats and a waiting area. The existing restaurant site has 25 parking spaces and needs 50 spaces to meet Code (deficiency of 25 spaces). With the additional 936 square feet of eating .and storage areas, 60 parking spaces would be required to meet Code. The applicant proposes 22 spaces on-site and 21 spaces across the street, a total of 43 parking spaces which would leave a deficiency of l7 spaces. The new addition to the south will continue the same architectural style as the existing building. Landscaping on the south will be upgraded and constitute approximately nine percent of the parking lot which would provide a visual bu~fer from traffic on First Avenue by placing a four-foot wide planter between the parking lot and the street along with a four-foot wide planter -2- 834 . . \ . adjacent to the south side of the new addition which should add a softening effect. The parking lot .across the street will have an irrigated planter five feet wide and a 12-inch berm landscaped with two to three foot high planting in lieu of the three-foot high block wall usually found in commercial developments. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided'will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking., loading, landscaping and other features required to adjust said. use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the General Plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a .conditional use permit for the use of said property for a restaurant upon the following conditions: . . -3- 834 . . . . . 1. The property shall be improved and maintained in accordance with the plans which are on file in the subject Case No. C.U.P. 73-13. 2. Until such time as parking for the subject use meets Code requirements, if a parking district is proposed which would encompass the subject property, the owners and tenants of the property shall not protest formation of the district and shall cast any vote accorded the property or the owners or tenants thereof in favor of the formation of such district. 3. Landscaping and irrigation plans and plans for the trash enclosure shall be submitted for approval of the Planning Department prior to the issuance of any building permits. 4. All roof mounted mechanical equipment on the site shall be screened from view. 5. Prior to construction of the structural additions, the applicant will submit for the City Attorney's approval an agreement which will provide that the parking lot will be maintained as long as the use authorized by this permit is maintained. 6. Energy saving low level lighting shall be provided in both parking 'lots and shall be subject to the approval of the Planning Department. 7. Landscaping ,shall be provided between parking stalls No. 21 and No. 13 on, the off-site parking .lot. a. Except as herein modified, all regulations of the Arcadia Municipal Code shall be complied with. -4- 834 . . . " .. . SECTION 4. The Secretary shall certify to t~e adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. November 27, 1973 TO: PLANNING COMMISSION FROM: PLANNING DEPARTMENT SUBJECT: CHANGES IN THE ACAPULCO RESTAURANT C.U.P. 73-13 218-230 NORTH FIRST AVENUE HISTORY A conditional use permit for a structural addition to the east portion of the Acapulco' Restaurant building,for"a cooler, storage space and trash area was approved by' the' Planning Commission on October 9, 1973. The'applicant later 'requested that action on the resolution not be taken, on these plans until a,second set of drawings could be submitted'which shows'some structural additions not included in the earlier plans. PROPOSAL AND ANALYSIS In addition to the 236 square feet extepsion on the east side of the structure (approved October 9, 197.3), the .applicant now proposes to construct' a 20 by 35 foot addition to' ,the south side of the restaurant and rearrange a portion"'of the existing seating to create a waiting area. The new plan would increase the building 700 square feet in addition to the 236 square foot addition on the east, and the seating capacity by 14 seats, plus create' a waiting area of 7 feet by 20 feet. The building addition 'would also remove three existing Parking spaces and would' leave a total of '22,'parking spaces on-site. To offset some of the existing parking aeficiency the applicant plans to secure the use of 9,459.5 square feet of lot area at the southwest corner of First Avenue' and St'.' The M-l section of the code requires a front yard of 10 feet and a side yard of S feet. The existing restaurant building contains approxi- mately S,04l square feet and seating for approximately 14.0 people. This proposed expansion would not alter the existing seating capacity of the restaurant. The applicant proposes to add an addition of 236 square feet to the existing building along with an enclosed trash area of 8 feet by 14 feet. The additional area would be used for storage and as space fo.r a cooler. The exterior of the addition would resemble the existing structure with a sloping roof and stucco walls. ' RECOMMENDATION The Planning Department recommends approval of C.U.P. 73-13 subject to the following conditions: l. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. . .2. All requirements of the Arcadia Municipal Code shall be complied with excepting: a. Existing front yard setback of 4 feet be p~rmitted along with the existing side yard setback of 4 feet 10 inches. 3. Required parking spaces shall be located on the same site or wi thin SOO feet of the site with all appropriate covenants to be approved by the Arcadia City Attorney. 4. Landscaping and irrigation plans shall be sub- mitted for approval of the Planning Department prior to the issuance of any building permits. S.
