HomeMy WebLinkAbout0826 '. . . / .. . RESOLUTION NO. 826 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING AMENDMENTS. TO THE SETBACK REGULATIONS OF THER-O, R-l. AND R-2 ZONES,. WHEREAS, the Planning Commission on its own matian held a public hearing an August 14, 1973, to'consider amending the provisions of the Arcadia Municipal Code relating to the setback regulations of the R-O, R-l and R-2 zanes;. and WHEREAS, all interested persans were given full appar- tunity to. be heard and to present evidence; . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RECOMMENDS TO THE CITY COUNCIL THE FOLLOWING CHANGES IN THE ARCADIA MUNICIPAL CODE: . SECTION 1. R-ORegulations. A. That Section 9251.2.2 be amended to read as follows: "9251. 2.2. FRONT YARD. There shall be a front yard af nat less than thirty (30) feet; pravided that where lots comprising sixty per cent (60%) or more of the frontage in a block are, developed with larger front yards., the front yard fora lat propos,ed for development shall be the average of the two (2) nearest developed lots at the time a building permit 1s issued." B. That Section 9251.2.6. be amended to read as follows: "9251. 2.6. REAR YARD. There shall be a rear yard of not less than twenty-five (25) feet.1I C. That Section 9251.2.3 which reads as follows be deleted: tr. - 9251.2.3. SPECIAL FRONT YARD. Where exceptionally deep lots or exceptionally shallow lots prevail, an appropriate special front yard depth established .in the manner provided for in Divisians 1 or 2 of Part 9 of this Chapter shall govern; -1- 82~ v \ . . . , . . provided, however, that if a front yard depth, greater than that herein prescribed., is now or may hereafter be established by Part 2 of Chapter 3 of this Article, the required front yard depths shall be as prescribed therein,." SECT10N 2. R-l Regulations. A. That Section 9252.2.2 be amended to read as follows: "9252.2.2. FRONT YARD. There shall be a front yard of not less than twenty-five (25) feet; provided that where lots comprising Sixty per cent (60%) or more of the frontage in a block are developed with larger froPt yards, the front yard for a lot proposed for development shall be the average of the two (2) nearest developed lots at the time a building permit is issued .'" B. That Section 9252.2.8 be amended to read as follows: "9252.2.8. REAR YARD. There shall be a rear yard of not less than twenty-five (25) feet." C. That Section 9252.2.3 which reads as follows be deleted: "9252.2.3. SPECIAL FRONT YARD. If sixty per cent (60%)' I or more of the lots on one side of a street, between intersecting streets have a front yard greater than that prescribed by this Title, the r'equired front yard shall be the average of the front yards of the other lots on the same side of the street between intersecting streets. In any case where the front yard specified by 'this Section exceeds by more than five (5) feet the front yard of an adjacent lot, an appropriate front yard shall be established as specified in Division 2 of Part 9 of this Chapter or as provideq by Part 2 of Chapter 3 of this Article." SECTION 3. R-2 Regulations. A. That Section 9253.2.2 be amended to read as follows: "92.53.2.2. FRONT YARD. There shall be a front yard of. not less than twenty-five (25) feet; provided that where lots -2- 826' ". . . B. Tha t Sec tion 9253.2.5 be amended to read as fo llows :' "9253.2.5. REAR YARD. On lots having only one (1) dwelling there shall be a rear yard of not less than twenty-five (,25) feet." SECTION 4; The Planning Commission finds that the public necessity, convenience, general welfare and good zoning practice justify the above recommendations. SECTION 5. The Secretary shall certify to the adoption " . of this resolution and shall cause a copy to be forwarded to the City Council of toe City of Arcadia. The exist-ing method of calc111ating the setbacks in R-O, R-1 and R-2 zones is in need of some clarification. For example, to determine where the' front' setback falls on a standard R-1 lot (rectangular 7S feet by 100 feet) it is only necessary to measure back 25 feet or 25% of the lot depth. In the case of cul-de-sac lots, however, the problem becomes one of identifying the front lot line and deciding at what point the length of the lot is to be measured. With the current sections of the code, staff finds that houses on cul-de-sac 10,ts have greatly reduced setbacks when compaired to the same house on the straight part of the street. This, even though both houses have the minimum 7,500 square feet of lot area. Staff feels a solution to the problem of measuring setback lines would be to amend the code, to establish certain minimum setback distances (these minimum setback distances would be measured from a,point that is parallel with either the front or rear lot line). The proposed minimums could be: R-O (1) Minimum front yard 30 feet (2) Minimum rear yard -25 feet (3) Delete special front yard setback R-1 (1) Minimum front yard ZS feet (2) Minimum rear, yard 25 ,feet (3) Delete special front yard setback R-2 (1) ,Minimum 'front yard setback 25 feet (2) Minimum rear yard setback 25 feet if there is only one residence on the lot The Planning Department recommends the following sections of the code be amended: . , ~~. . . . . .
