RESOLUTION NO. 823 A RESOLUTION OF THE PLANNING COMMISSION REPORTING ON THE REDEVELOp~mNT PLAN FOR THE CENTPAL REDEVELOPMENT PROJECT AND RECOr-l.l,lENDING THAT THE CITY COUNCIL APPROVE AND ADOPT SAID PLAN " WITH CERTAIN CHANGES AND RECOMMENDING AGAINST SAID ADOPTION IF THE RECOMMENDED BOUNDARY CHANGE IS NOT MADE. WHEREAS, pursuant to Section 33346 of the California Community , Redevelopment Law, the Redevelopment Agency submitted the pro- posed Redevelopment Plan for the Central Redevelopment ?roject to the Planning Commission for its report and recommendation con- cerning the Redevelopmen~ Plan and its conformity to the General Plan of the City: and WHEREAS, the Planning Commission has reviewed said proposed Redevelopment Plan; NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION AS ~OLLOWS: . I 1. The Planning Commission reports that the proposed Redevelopment Plan is in conformity to the General Plan of the City. ' 2. The Planning Commission recommends that the City 'Council approve and adopt said proposed Redevelop- ment Plan as the Planning' Commission has recom- mended it be changed. (Said changes are indicated on the document attached hereto, labeled Exhibit "A", and incorporat~d herein by this reference.) EXHIBIT "A" PROPOSED CHANqES TO THE PROPOSED REDEVELOPMENT PLAN FOR THE CENTRAL REDEVELOPMENT PROJECT (Additions are underlined; deletions are lined out) PROPOSED CHANGE NO. 1 That ,a clerical error in line 1 of the first paragraph of S 301 (page 3) be corrected by substituting therein the word "proposes" for the word "proposed." PROPOSED CaANGE NO. 2 That the third sentence of the second paragraph of S 310 (page 6) be amended to read as follows: "The Agency shall impose on all public bodies the planning - and design controls co~tained in the Plan to insure that presen~ ~ses-And any future development by public bodies will conform to the requirements of this Plan." PROPOSED CHANGE NO. 3 That a new sentence be added after the first sentence of the second paragraph ~ 311 (page 6) to read as follows: "The Agency may also pay to any school district with territory , located within the Proj'ect area any amounts of money which in the Agency's determination is appropriate to alleviate any financial I burden or detriment caused to any such school district by the Project." -1- Ii. ,I I; . PROPOSED CHANGE NO.4 That the first sentence of S 321 (page 7) be amended to read as follows: "As necessary in carrying out this Plan and only in accor- dance with applicable provisions of the City's Municipal Code, the Agency is authorized to move or to cause to be moved any standard structure or building to a location within or .outside the Project area. PROPOSED CHANGE NO.5, That the first sentence of the third paragraph of S 325 (pages 8 and 9) be amended to read as follows: "All property in the Project Area is hereby subject to the restriction that there shall be no discrimination or segregation , based upon ~, race, color, religion, national ori~in, or ancestry, in the sale, lease, sublease, transfer, use, occupancy, tenure, or enjoyment of property in the Project area." PROPOSED CHANGE NO. 6 ,That a new paragraph be added after the first paragraph of item 2 of S 403 (page 10) to read as follows: liThe area generally located at the northeast corner of Baldwin ~venue and Huntington Drive, and shown on the Map as designated for Commercial General use, shall be developed as a regional commercial shopping center; and the uses permitted thereon and the controls and restrictions applied thereto shall be those specified in . Arcadia Municipal Ordinance 'No. 1425: and Resolution No. 4185." -2- , , . . .,;... . , ,- '. PROPOSED CHANGE NO. 7 That the second sentence of S 404 (page 10) be amended to read as follows: "These industrial uses shatl include all those industrial uses permitted by the applicable zone in the Arcadia Municipal Code of-~he-ei~y~including but not limited to uses related to research and development fac'ilities. n PROPOSED CHANGE NO. 8 That the first sentence of the second paragraph, of S 408 (page ~l) be amended to read as follows: "In any area in addition to these areas designated on the Map , . as Open Space and Public Facilities Uses, the Ag~ncy is authorized I to permit the establishment and enlargement of public, semi-public, open space, institutional, or nonprofit' uses: includ'ing civic cen- ter buildings and facilities; police and fire stations; park raee ~raen and recreational fa~i1ities, hiking and riding trails and facilities; libraries,' schools; hospitals; educational, fraternal, employee, philanthropic, and charital:?le institutions; and facili~ies of other similar associat'ions or organizations." PROPOSED CHANGE NO.9 That the first sentence of S 409 (page 12) be amended to read as follows: "All real property in the Project area is hereby subject to' the controls and requirements of this P~an ,which controls and ~ requirements shall conform to and not be less than those provided in the City's Municipal Code." -3- . . . That, a new sente~ce be added to replace the last sentence of the third paragraph of S 410 (page 12) to read as follows: "Adjacent properties and adjoining stree.ts shall be shielded from light sources for or in parking 'spaces." PROPOSED CHANGE NO. 12 'I That the second sentence of the fourth paragraph of S 410 (page 12) be amended as follows: "All off-street loading facilities shall be reasonably located . at such a depth within a comp1etely:enc10sed building as to reason- ably contain and restrict the emission of noise' and light typically attr.ibuted to such function." -4- . . . . ",.. . -- PROPOSED CHANGE NO. 13 That a new paragraph be added to replace the second paragraph of S 416 (page 13) to read as follows: "With respect to the amount of open space to be provided in the PI'oject area and with regard to the maintenance of sufficient space bet\1een buildings to provide for adequate light, air, and privacy, the requirements and controls of this Plan shall conform, to and not be less than those provided in the City's Municipal Code." PROPOSED CHANGE NO. 13A That a new sentence be added after the first sentence of the last paragraph of S 422 (page 15) to read as follows: "In no event, however, shall the Agency permit a variance which violates any limit, restriction, or control provided in the City's Municipal Code." PROPOSED CHANGE NO. 14 That the first sentence of the first paragraph of S 423 (page 15) be amended to read as follows: "~-athin the limits, restrictions, and controls established in the Plan, the Agency i5-a~eher~Eed-~e shall, within 120 days of the adoption of this Plan, establish heights of buildings, land covera~e, setback requirements, design criteria, traffic circula- tion, traf,fic access, and other development and design controls necessary for proper development of both private and public areas within the Project area." -5- '. . . . , . . PROPOSED CHANGE NO. 15 That the word "may" be substituted for the word "will" in the third line of the first paragraph of S 503 (page 18). PROPOSED CHANGE NO. 16 That item .E. under S 600 (page 18) be deleted. PROPOSED CHANGE NO. 17 That S 800 (page 19) be deleted, from the Redevelopment Plan" and that the headings "IX. [S 900] PROCEDURE FOR AMENDMENT" and "X. [S 1000] NEIGHBORHOOD IMPACT ELEMENT" be amended to'read a's follows: "VIII. [S 800J PROCEDURE FOR AMENDMENT" "IX. [S 900] NEIGHBORHOOD IMPACT ELEMENT" PROPOSED CHANGE NO. 18 That a new sentence be added after the last sentence under the provision entitled "Traffic Circulation" of retitled 5 900 to read as follows: "The provision of railroad over- and under-passes will increase vehicular and pedestrian safety while providing for better traffic c,ircu1ation. " PROPOSED CHANGE NO. 19 That a new 5 426 be added to the Redevelopment Plan to read as follows: "J. [5 426J Conformity with the Municipal Code . Notwithstanding anything provided to the contrary in the -6- " . . . . . . . Plan, all uses, limits, restrictions, oontrols, reqUirements, and criteria established in the Plan or by the Aqenoy pursuant to the Plan, shall at least meet 'the'minimum stnndards provided in the City's Municipal Code; and no bui1dinq permit or plan for the development, construction, or rehabilitation of improvements shall be approved by the Aqency which is not in conformity with the C,ity"s Municipal Code.
