RESOLUTION NO. 819 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN AUTOMOBILE SERVICE STATION AT 679 WEST DUARTE ROAD. . WHEREAS, on June 11, 1973, Mobil Oil Corporation filed an application for a conditional use permit to alter the exterior of an existing service station, Planning Department Case No. C.U.P. 73-9, on the property commonly known as 679 West Duarte Road, mOire particularly described as follows: That portion of Lot 40 of Tract 3430, in the City of Arcadia, County of Los Angeles, State of California, shown on map recorded in Book 42, page 32 of Maps in the Office of the County Recorder of said County, described as follows: Beginning at the southwest corneT of said Lot 40' thence north 810 east, along Duarte Road lS5.90 feet; thence northerly parallel with the easterly line of said Lot 40, along the westerly line of the lands conveyed to Robert E... Ferrante and wife by deed recorded in Book 12038, page 12 of 150.12 feet, more or less, to the southerly line of lands conveyed to A. Carleton Ambler and wife by deed recorded in Book 14182, page 208, Official Records; thence along said southerly line, south 87007'43" west to a point in the westerly line of said Lot 40 (being also the easterly line of Baldwin Avenue) distant north 3043' east, 170.92 feet from the place of beginning4" thence along said westerly line of Lot 0 south 304)' west 170.92 feet to the place of beginning. Note: Lessor dedicated portion of subject premises, approximately 12 feet along Duarte Road and approximately 15 feet along Baldwin Avenue, to the City of Arcadia for road widening purposes. . WHEREAS, a public hearing was held on said matter on June 26, 1973, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. Subject property is developed with an existing service station and is zoned C-2 & H; property to the north, south and west. is zoned C-2 & H and developed with -1- 819 /' . . . , . . " commercial uses; property to the east is vacant and zoned C-2 & H. The subject property is irregular in shape containing approximately 23,079.6 square feet. The General Plan indicates this as a commercial area. The applicant proposes to update and remodel the existing structure constructed in 1957. The remodeling of this site consists of: 1. General repair and repainting of surface material. 2. Rebuild and lengthen existing pump islands to accommodate three pumps per island. 3. Change the lighting. 4. Place a brick veneer on some of the front, west and all of the east side of the building. The basic configuration of the lot and building will remain the same. The existing front entrance to the service bays should be closed off and rear entrance bays should be used; this would permit construction of a planting area in front of the building. Due to the close proximity of the pump islands to the ,street, the usual landscaping requirements adjacent to the pumps should be waived in lieu of a five-foot wide planting area in front of the building which would enhance both the appearance of the station and the surrounding area. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loadIng" landscaping, and other features required to adjust said use with the land and uses in the neighborhood. -2- 819 , . . .' ... 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. 6. The proposed use will not substantially increase vehicular traff.ic on any street in a residentially zoned district. 7. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. 8. The proposed use is not located near a place of ... . assembly. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for an automobile service station subject to compliance with all applicable regulations of the Arcadia Municipal Code and upon the following conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file with the Planning Department as modified by the conditions of this permit. 2. A five foot wide raised planter shall be placed across the front of the building._ 3. The front of the structure shall be enclosed with decorative block in the same manner as the sides of the structure. ~. The trash area shall be located in the 'northeast corner of the lot and shall be enclosed with block similar to that of ,the existing walls. 5. All signs shall comply with Code. 6. The landscaping and irrigation plan shall be submitted for approval of the Planning Director, 7. All building changes shall comply with plans, colors and materials submitted to the Planning Department. 8. Restrooms shall, be screened to meet Code requirements'. -3- 819 . . . 9. All utilities shall be installed underground. 10. All surface drainage shall be intercepted and con- veyed under the sidewalk to street gutter. 11'. Three tree wells shall be constructed at locations designated by the Department of Public Works and 15 gallon trees shall be planted as follows: one Holly Oak on Baldwin Avenue and two Wilson Holly on Duarte Road SECTION 4. The Secretary shall certi~y to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City .of Arcadia.
