RESOLUTION NO. 817
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING
AMENDMENTS TO THE RESIDENTIAL PLANNED
DEVELOPMENT REGULATIONS OF THE Zd'NING
ORDINANCE.
WHEREAS; the Planning Commission on its own'motion held
a public hearing on June 12, 1973, to consider amending the provi-
sions of the residential planned development regulations of the
zoning ordinance; and
WHEREAS, all interested persons were given full oppor-
tunity to be heard and to present evidence;
NOW ,THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
. ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. That Section 9217.6 of the Arcadia Municipal

Code be amended to read as follows:
"9277.6.
USES.
ZONES.

Residential planned developments
shall be permitted in R-O, R-l and R-2 zones. No more than
one (1) dwelling unit shall be permitted on anyone (1) lot."
SECTION 2. That Section 9277.7 of the Arcadia Municipal,
Code be amended to read as follows:
"9277.7. DENSITY.
A. The maximum number of lots within a residential

planned development in Zones R-O and R-l shall be determined by
dividing eighty-five per cent (85%) of the gross square footage
of the subject property by the minimum lot area required by the
underlying zone.
B. The maximum number of dwelling units within a
residential planned development in Zone R-2 shall be the same as
permitted if the land area of the development were developed
under the R-2 zone regulations."

SECTION 3. The Planning Commission finds that the
public necessity, convenience, general welfare and good zoning
practice justify the above recommendations.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the
City of Arcadia held on the 26 day of

DEVELOPMENT REGULATIONS, OF THE ZONING
ORDINANCE
This text amendment has been initiated by the
Planning Department in order to clarify existing regu-
lations.
The recent application for a Residential Planned,
Development on. the Eaton prqperty has brought to light
a couple of problems in the language of the existing
RPD regulations' re1ativ~ to Section 9277.6 USES. ZONES.,
and Section 9277.7 DENSITY,., as applicable to R-2 zoned
properties.
Section ~277.l8 allows for variances from the re-
quirements of the RPD regulations except for the require-
ments of the above mentioned sections relative to "Uses"
and to "Density." Therefore, clarity in the ordinance
is imperative in these particular sections.
Section 9277.6 provides ,that "'Residential planned
developments shall be permitted only for-one-family
dwellings (emphasis added) in R-O, R"l and R-2 zones.
No more than one dwelling shall be 'permitted on anyone
lot." Section 9220.21 defines a one-family dwelling
as, "a detached building (emphasis added) designed ex-
clusively for occupancy by one family." Ther~fore, by
the strict interpretation of Section 9277.6 a,R~i>len-
tia1 Planned.Deve10pment may not consist of a~tached
.. dwellings.
However, ,attached dwellings were anticipated by
Section 9277.12 'which spell out the'soundproofing re-
quirements for "common' walls between buildings,"
(emphasis added).

Because Section 9Z77.6 uses the words "one-family
dwelling" which have a prescribed meaning precluding
clusters of attached dwellings, the Planning Department
recommends that this section be revised eliminating the
existing ambiguity.
This revision is recommended to read as follows-:

"9277.6. USES. ZONES. Residential planned de-
velopments shall be permitted only in R-O, R-l
and R-2 zones. No more than one (1) dwelling
shall be permitted on anyone (1) lot."
Section 9277.7 provides that "The maximum number of
lots within a residential planned development shall be
determined by dividing eighty-five percent (85%) of the
gross square footage of subject property by the minimum
,lot area required by the underlying zone."
This section calculates density not in terms of
dwellings, but rather calculates it in terms of lots.
The square fQotage for an R-2 lot and an R-1 lot is, in
most cases, the same - the square footage required on an
R-2 or R-1 lot is 7,500 square feet. While the square
footage for R-1 and R-2 lots is the same, density in R-2
lots is double that in R-1 lots because the Ordinance pro-
vides that two dwellings can be built on a 7,SOO square
footR-2 lot (see Section 92S3.2.7.1 of the Arcadia
Municipal Code). However, Section 9277.6 of the Residen-
tial Planned Development Ordinance specifically prescribes
that only on~ dwelling shall be permitted on anyone lot.
The net effect is that the number of lots under the for-
mula of Section 9277.7 would be the same regardless of
whether the underlying zone was R-1 or R-2, and the pro-
visions of Section 9Z77.6 would not allow two dwellings
per lot as provided in the regular R-2 ordinance of the
City.

Because of the ambiguity in this section, the
Planning Department recommends that Section 9277.7 be
revised to read as follows:
"9277.7. DENSITY.

dential, planned development in zones R-O and R-1
shall be determined by dividing eighty-five, per cent
(85%) of the gross square foot~ge of the subject
property by the minimum lot area required by the
underlying zone,.
