HomeMy WebLinkAbout0805 . . '. '. . RESOLUTION NO. 805 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDI- TIONAL USE PERMIT FOR A RESTAURANT AT 59 WEST LAS TUNAS DRIVE. WHEREAS, on January 26, 1973, jojo's Restaurants, Inc. filed an application for a conditional use permit for a restaurant, Planning Department Case No. C.U.P.73-1, on the property commonly , known as 59 West Las Tunas Drive, more particularly described as follows: , The westerly 202.00 feet measured at right angles of those portions of Lots 66 and 69 of the Santa Anita Colonye~cepting the northerly 117.18 feet thereof, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 42, page 87 of Mis- cellaneous Records, in the office o.f the County Recorder. and WHEREAS, a public hearing was held on said matter on February 13, 1973, at which time all interested persons were given I full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The subject property is vacant land and is zoned C-O and C-2. Contiguous property to the north is single family residentiaL Property to the south is zoned C-M and is developed with general commercial uses. Property to the east is -- restaurant providing seating for 118 people. Parking is to be -1- 805 /'" . . . provided for 57 vehicles, with a ~andscaped perimeter as required by Code, The restaurant and 41 parking spaces are to be located in the C-2 zone portion of the subject site and the remaining 16 parking spaces and driveway are to be located in the c-o zone. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity, / . J 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping and other features required to adjust said use with the land and uses in the neighborhood. 4, The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by I the proposed use. 5. The granting of such conditional use permit will not adversely affect the general. plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a I conditional I I use permit ~or the use of said property for restaurant purposes, subject to compliance with all applicable regUlations of the Arcadia . Municipal Code and upon the folloWing conditions: 1. The property shall be improved and maintained in accordance with the plans which are on file with the Planning Department, provided that all signs shall confrom with the Zoning Ordinance. -2- 805 .. . . . 2. That the hours of operation including the delivery of supplies and maintenance of, the property shall be between the , hours of 6:30 a.m. and 11:00 p.m., with the exception that thehou~s on Friday and Saturday evening be extended to 1:00 a.m. This port~on of the resolution shall be reviewed by the Planning Commission one year from its effective date for possible changes. 3. Ornamental street lights shall be installed with underground conduit along the frontage of subject property. 4. Portland cement concrete full-width parkway sidewalk; with tree wells and driveways shall be constructed along the frontage of subject property. ~ 5. All utilities shall be underground. J j 6. A grading and d~ainage plan shall be prepared by a registered ~ivil engineer and submitted to the Department of Public Works for approval. . 7. All work to be performed in accordance with City of Arcadia I,S Standard Plans and Specifications and to the satisfaction , I of the City Engineer. 8. The developer shall be responsible for paying all costs involved with complying with the above conditions and furtherr pay the following fee for street trees: Five 15-gallon street trees -- $92.50. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
