HomeMy WebLinkAbout0794 . . . RESOLUTION NO. 794 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 150 EAST DUARTE ROAD. WHEREAS, on October 30, 1972, John T. Mione filed an application for a conditional use permit for a restaurant, Planning Department Case No. C.U.P. 72-15, on the property commonly known as 150 East Duarte Road; and WHEREAS, a public hearing was held on said matter on November 14, 1972, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW ,THEREFORE, THE PLANNING COMMISSION OF THE CITY OF . ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The subject site is zoned C-l & D and developed with a planned commercial center. Property to the north and west is zoned C-2 and is developed with general commercial uses and contains considerable vac~nt property. Property to the east is zoned C-l and developed with .general commercial uses and service stations. Property to the south is zoned R-l and developed with single-family dwellings. The applicant currently operates a delicatessen which is . adjacent to the subject site. This proposal is to expand the delicatessen to include a restaurant operation. The existing delicatessen occupies .an area of 523 square feet. The proposed restaurant would occupy an area of 640.5 square feet. SECTION 2. This Commission finds that: I. The granting of a conditional use permit as herein- after provided will not be detrimental to the publiC health or -1- 794 v' / t ~ . . . . . . welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditiona'l use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to the approval of the City Council, this Commission grants a condi- tional use permit for the use of said property for restaurant purposes, subject to compliance with all applicable laws, ordinances and regulations. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. NOTICE OF PUBLIC HEARING BEFORE THE ARCADIA CITY PLANNING COMMISSION C.U.P. 72-15 TO PROPERTY OWNERS WITHIN A 300-FooT RADIUS The Planning Commission of the City of Arcadia, california, will hold a public hearing on Tuesday, November 14, 1972, at 7:30 p.m. in the Council Chambers of the Arcadia City Hall, located. at 240 West Huntington Drive, Arcadia, California. Mione and requests a permit to operate an Italian style pizza restaurant. . PRE,SE ND USE AND ZONING The subject site is zoned C-l & D and developed with a planned commercial center. Property to the north and west is zoned C-2 and is developed with general commercial uses and contains con- siderable vacant property. Property to the east is zoned C-l and dev~loped with general commercial uses and ser- vice stations. Property to the south is zoned R-l and developed with single family dwellings. PROPOSAL AND ANALYSIS The applicant currently operates a delicatessen which is adjacent to the subject site. This proposal is to expand the delicatessen to include a restaurant opera- tion. The existing delicatessen occupies an area of 13'8" by 37'9" or 523 square feet. The proposed restaurant would occupy an area of 16'9" by 37'9" or 640.5 square feet. C.U.P. 72-15 2 Customer access to the restaurant would be from a single door in the front of the building or through a passageway from the delicatessen. The subject site has a rear door from which delivery of supplies can be made by way of an alley that runs behind all stores in the development. The parking requirement for the proposed restaurant is seven (7) parking spaces. There are currently one- hundred ten (110) marked parking spaces in the commercial development, which appears to be more than adequate for the commercial center uses including the addition of this restaurant. Landscaping, walls and fences have already been provided to City standards, and, therefore, additional improvements are not required. RECOMMENDATION . The Planning Department recommends approval of Con- ditional Use Permit C.U.P. 72-15 subject to the following condition: 1. Conditions as outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works.
