RESOLUTION NO. 794
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 150 EAST DUARTE ROAD.
WHEREAS, on October 30, 1972, John T. Mione filed an
application for a conditional use permit for a restaurant, Planning
Department Case No. C.U.P. 72-15, on the property commonly known
as 150 East Duarte Road; and
WHEREAS, a public hearing was held on said matter on
November 14, 1972, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW ,THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
. ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. The subject site is zoned C-l & D and developed
with a planned commercial center. Property to the north and west
is zoned C-2 and is developed with general commercial uses and
contains considerable vac~nt property. Property to the east is
zoned C-l and developed with .general commercial uses and service
stations. Property to the south is zoned R-l and developed with
single-family dwellings.
The applicant currently operates a delicatessen which is

adjacent to the subject site. This proposal is to expand the
delicatessen to include a restaurant operation. The existing
delicatessen occupies .an area of 523 square feet. The proposed
restaurant would occupy an area of 640.5 square feet.
SECTION 2. This Commission finds that:
I. The granting of a conditional use permit as herein-
after provided will not be detrimental to the publiC health or

welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditiona'l use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,
landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for the foregoing reasons, subject to
the approval of the City Council, this Commission grants a condi-
tional use permit for the use of said property for restaurant
purposes, subject to compliance with all applicable laws, ordinances
and regulations.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the Planning Commission of the City of
Arcadia held on the 28th' day of November , 1972, by. the following

ARCADIA CITY PLANNING COMMISSION
C.U.P. 72-15
TO PROPERTY OWNERS WITHIN A 300-FooT RADIUS
The Planning Commission of the City of Arcadia, california,
will hold a public hearing on Tuesday, November 14, 1972, at 7:30 p.m.
in the Council Chambers of the Arcadia City Hall, located. at 240
West Huntington Drive, Arcadia, California.
The purpose of the public hearing will be to afford the
public an opportunity to be heard concerning the proposed use of
the property commonly known as 150 East Duarte Road.
The legal description of the subject site is as follows:
Those portions of lots 13, 14 and 15 of Tract No. 808, in
the City of Arcadia, County of Los Angeles, State of calif-
ornia, as per map recorded in Book 16 page 82 of Maps, in
the Office of the County Recorder of said County, described
as a whole as follows:
Beginning at a point in the northerly line of said lot 13,
distant easterly thereon, 117.50 feet from the northwest
corner of said lot 13; thence South 00 18' 54" East along
the northerly prolongation of the westerly line of the land
described as Parcel 4, in the deed to Lands and Buildings,
Inc., recorded on December 3, 1964, as instrument No. 4526,
in book 02720, Page 835, Official RecordS, in said office of
the county recorder, a distance of 12.15 feet to the northwest
corner of Said Parcel 4, said last mentioned northwest corner
being the true point of beginning for this description;
thence continuing South 00 18' 54" East, along the westerly
line of said Parcel 4, a distance of 157.82 feet to the
northerly line or its prolongation of the land described in
the irrevocable offer to dedicate property for public street
and alley purposes to the City of Arcadia, recorded on
October 25, 1965, as instrument No, 3146, in Book 0 3092,
Page 467, Official Records; thence along said northerly line
and/or its prolongation to and along the other .various
courses in the northerly line of said irrevocable offer to
dedicate, as follows: North 890 36' 22" East, 220.30 feet;
South 760 45' 36" East, 110.29 feet' and North 890 36' 22"
East, 206.06 feet to the westerly line of the easterly
12.00 feet of said Lot 15; thence 'North 00 22' 38" West
along said westerly line to the southeast corner of the land
described as Parcel 1 of the lease to Standard Oil Company

APPLICATION
This application was filed on October 30, 1972 by
John T. Mione and requests a permit to operate an
Italian style pizza restaurant.

The subject site is zoned C-l & D and developed
with a planned commercial center.
Property to the north and west is zoned C-2 and is
developed with general commercial uses and contains con-
siderable vacant property. Property to the east is zoned
C-l and dev~loped with general commercial uses and ser-
vice stations. Property to the south is zoned R-l and
developed with single family dwellings.
PROPOSAL AND ANALYSIS
The applicant currently operates a delicatessen
which is adjacent to the subject site. This proposal is
to expand the delicatessen to include a restaurant opera-
tion. The existing delicatessen occupies an area of
13'8" by 37'9" or 523 square feet. The proposed restaurant
would occupy an area of 16'9" by 37'9" or 640.5 square
feet.
Improvements of fixtures and accessories would in-
clude eight serving tables, an o~en and various prepara-
tion equipment.

Customer access to the restaurant would be from a
single door in the front of the building or through a
passageway from the delicatessen. The subject site has
a rear door from which delivery of supplies can be made
by way of an alley that runs behind all stores in the
development.
The parking requirement for the proposed restaurant
is seven (7) parking spaces. There are currently one-
hundred ten (110) marked parking spaces in the commercial
development, which appears to be more than adequate for
the commercial center uses including the addition of this
restaurant.
Landscaping, walls and fences have already been
provided to City standards, and, therefore, additional
improvements are not required.
RECOMMENDATION
.
The Planning Department recommends approval of Con-
ditional Use Permit C.U.P. 72-15 subject to the following
condition:
1. Conditions as outlined in the attached report
from the Department of Public Works shall be
complied with to the satisfaction of the Director
of Public Works.
