RESOLUTION NO. 792 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT TO RECONSTRUCT A ,SERVICE ST~TION AT 9977 EAST LAS TUNAS DRIVE. ' . WHEREAS, on August 29, 1972, Union o.n,Company of California filed an applic~t10n for a conditional use permit for an automobile service station, Planning Department Case No. C;U.P. 72-13, on the'property commonly known as 9977 East Las Tunas Drive, more particularly described as follows: Lots 11 and 12 of Tract No. 6561, in the City of Arcadia, County of Los Angeles, State of .California, as per map. recorded in Book 72, pages 34 and 35 of Maps, in the Office of the County Recorder of said County. EXCEPT THEREFROM that portion of Lot 11, described as follows: Beginning at the north- east corner of said lot; thence southerly along the easterly line of said lot to the northerly line of the southerly 66.69 feet of the. easterly 20.00 feet of said lot; thence .westerly along last mentioned northerly line to the westerly line of the easterly 20.0.0 feet of said lot; thence northerly in a direct line to the inter- section of the northerly line of said lot with th~ westerly line of the easterly l2.00,feet of said lot; thence easterly along last mentioned northerly.line of said lot to the ,point of beginning; and WHEREAS, a public hearing was held on said matter on October 10, 1972, at which time all interested persons were given full opportunity to be heard and to present'evidence; . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The subject property is zoned C-2 and PR-3 and developed with a service station. The nor;th portion of the subject site is vacant. Properties to the north are developed with single- family dwellings, apartments, and z -1- 792 I . '. i . family dwellings, apartments, and, a .church; properties to the east are zoned R-l, C-O and .C-.2 & D, and developed with single-family . dwellings, office buildings .and .a s.ervice station; properties to the south are zoned C-2.and developed with a large market and service station; properties to the west ar.e zoned C-2 and developed with a church. The remainder of the, block is within the, City. of Temple City and R-2 and developed with a church, YMCA buildings and single- family dwellings. The subject site is irregular in shape and contains approximately 18,315 square feet. The present service station occupies only that portion~of the land zoned C-2 an~ t~e remaining vacant portion is zoned PR- 3" The applicant proposes to r.eplace 'the existing service station with a new three-bay service station utilizing the entire parcel of land. , SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use-is adequate in size and shape to accommodate said use., and all yards, parking, loading, landscaping, and other features required to adjust ~aid use with . the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind, of traffic generated by the proposed use. -2- 792 ., . . . 5. The granting of such conditional use permit will not adversely affect the ganeral plan. 6. The proposed use will not sUbstantially increase vehicular traffic on any street in a residentially zoned district. 7. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interfering with pedestrian traffic. . 8. The purpose of the public hearing will be to afford the public an opportunity to be heard concerning the proposed use of property commonly known as 991 East Las Tunas Drive. . The legal description of the subject site is as follows: Lots 11 and 12 of Tract No. 6561, in the City of Arcadia, in the County of Los Angeles, State of California, as per map recorded in Book 12, Pages 34 and 35 of Maps, in the Office of the County Recorder of said County. PRESENT LAND USE AND ZONING The subject property is zoned C-2 and PR~3 and de- veloped with a service station. The north portion of the subject site is vacant. Properties to the north are developed with single family dwellings, apartments, and a church; properties to the east are zoned R-l, C-O and C-2 & D and developed with single family dwellings, office buildings and a service station; properties to the south are zoned C-2 and developed with a large market and ser- vice station; properties to the west are zoned C-2 and developed with a church. PROPOSAL AND ANALYSIS The subject site is irregular in shape and contains approximately 18,315 square feet. C.U.P. 72-13 2 The new service station would appear to reduce a traffic problem by having only one driveway instead of the present two driveways located at the Las Tunas Drive and Baldwin Avenue right-hand turn traffic island. The exterior materials of the proposed service station will be slumpstone veneer, tempered glass, metal board and batten, aluminum shingles and concrete block. One canopy, 21 feet 6 ~nches by 47 feet in size, will cover two pump is~ands. Thirteen parking stalls are proposed on the site. The proposed landscape areas exceed Code requirements. The proposed wall sign (located on the south side of the building) meets Code requi~ements. The proposed free standing sign is shown to be 20 feet in height. The other dimensions of the free standing sign are not indicated on the plot plan. . The proposed six foot high slumps tone wall along the northerly property line, decreases to three (3) feet in height at a point 25 feet from the Baldwin Avenue property line. Code requires that the block wall be 30 inches high in this area. Code requires that the trash enclosure be five feet high. The lot frontage along Las Tunas Drive is 95 feet wide. Code requires a minimum of 100 foot frontage. Plan- ning Department feels that the difference of five feet would not be detrimental to the construction of the new service station nor to the surrounding neighborhood or area. The Planning Department feels that the construction of a more attractive service station and deletion of one driveway would be an asset in improving the appearance of this intersection. RECOMMENDATION The Planning Department recommends that application C.U.P. 72-13 be approved subject to the following conditions: 1. That all signs conform with Code. . ~~. Trash area enclosure walls shall comply with Code. . . . C.U.P. 72-13 3 3. That the six (6) foot high slumpstone wall shall decrease to 30 inches in height at a point measured 25 feet from Baldwin Avenue property line. 4. All conditions as outlined in the attached report from the Department of Public Works shall be com- plied with to the satisfaction of the Director of Public Works.
