RESOLUTION NO. 789
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT TO OPERATE AN
AUTOMOBILE ACCESSORIES SALES AND INSTALLA-
TION FACILITY AT 850-860 SOUTH BALDWIN
AVENUE AND 653 FAIRVIEW AVENUE.
WHEREAS, on July 10, 1972, Paul Friedman and Murrey
Seidner filed an application on behalf of United California
Bank to operate an auto~obile accessories sales and installation

facility, Planning Department Case No. C.U.P. 72-11, on the
property commonly known as 850-860 South Baldwin Avenue and
653 Fairview Avenue, more particularly described as follows:
Parcell: The easterly 69 feet of Lot 1 of
Tract No. 3430 in the City of Arcadia, in the
County of Los Angeles, State of California,
as per map recorded in Book 42, page 32, of
Maps, in the office of the County Recorder of
said County.
Parcel 2: Lots 11 and 12 o~ Tract No. 6985,
in the City of Arcadia, in the County of Los
Angeles, State of California, as per map re-
corded in Book 106, page 53, of Maps, in the
of~ice o~ the County Recorder of said County.
EXCEPT therefrom the westerly 15 feet thereof,
measured at right angles, from the westerly
lines of said Lots 11 and 12.

Parcel 3: That portion of the Rancho Santa
Anita in the City of Arcadia, in the County
of Los Angeles, State of California, as pel'
map recorded in Book 1, page 97, of Patents,
in the office of the County Recorder of said
County, included within that por,tion of the
northerly 20 feet of the 40 foot strip of land
marked "Southern Pacific Railroad Right of
Way" on the map of Tract No. 3430, recorded
in Book. 42, page 32., of Maps, in the office.

between the northerly prolongation of the

ing described property: That portiqn of the
Rancho Santa Anita, in the City of Arcadia in
the County of Los Angeles, State of California,
included within. that portion of the southerly
20 feet of the 40 foot strip of land marked
"Southern Pacific Railroad Right of Way" on
map of Tract No. 3430, recorded in Book 42,
page 32, of Maps, in the o.ffice of the County
Recorder of said County, lying between the
northerly prolongation of the easterly line
of Lot 1 of said Tract No. 3430, and the
center line of Baldwin Avenue 60 feet wide,
as said Avenue is shown on said Map of Tract
No. 3430; and
WHEREAS, a public hearing was held on said matter on
July 25, 1972, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY
OF ARCADIA RESOLVES AS FOLLOWS:
SECTION 1. The subject property is zoned C-2, C-2 & D,
PR-2 and PR-3, and is developed with an existing automotive dis-
play sales and office building, automotive service building,
and a parking lot area. Property to the north is developed with
mixed commercial uses and single family dwellings and apartments;
property to the east is zoned R-.3, C-O & D and developed with
apartments; property to the south is zoned C-2 and PR-3 and
developed with mixed commercial uses and a parking lot. Across
Fairview Avenue the property is zoned C-2 & H, R-3 and PR-3 and
. developed with mixed commercial uses and apartments; property
to the west is zoned C-2 and developed with mixed commercial
uses and single-family dwellings.

The vacant two-story building has approximately 4,340
square feet of o.ffice space, 1,322 square feet of merchandise
display area and 11,035 square feet of service building areas, located
in two structures. The sUbject property is L-shaped with frontage
on Baldwin Avenue and Fairview Avenue and contains approximately
52,868 square feet..
The applicants are proposing to engage in the retail sales'
and installation of automotive air conditioners, tire and wheels,
shock absorbers, and other small accessories.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be de.trimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,
landscaping, and other fe.atures required to adjust said use with
the land and useE in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated
by the proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for the foregoing reasons, subject to
the approval of the City Council, this Commission grants a condi-
tional use permit for an automobile accessories sales and installat'ion

facility, subject to compiiance with all applicable regulations
of the Arcadia Municipal Code and upon the following conditions:
1. The facility shall be operated and maintained in
accordance with a plot plan showing all structures, landscaping,
permanent irrigation, parking space layout, and all improvements
which are required by this permit. Said plan shall be submitted
to and approved by the Planning Department.
2. The facility shall comply with all requirements of
the C-2 zone regulations except for the number of parking spaces.
3. The operation of the facility shall not cause any
loud, unnecessary or unusual noise which causes discomfort or
annoyance to any reasonable person of normal sensitiveness residing
in the area.
4. A solid masonry wall shall be constructed along the
north property line of the parking lot fronting on Fairview
Avenue.

5. All installation work shall be conducted entirely
within the covered s.ervice areas. No installation work shall
be done except between the hours of 8 a.m. and 5 p'.m. on weekdays
and Saturdays.; no work shall be done on Sundays or holidays.
6. There shall be no outdoor storage of any kind on
the premises.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause .a copy to be forwarded to the
City Council of the' City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was

TO PROPERTY OWNERS WITHIN A 300-FOOT RADIUS
The Planning Commission of the City of Arcadia,
California, will hold a public hearing on Tuesday, JUly
25, 1972, at 7: 30 p.m., in the CounciL Chambers of the
Arcadia. City Hall,' located at 240 West Huntington Drive,
Arcadia, California.
The purpose of the public hearing will be to afford
the public an opportunity to be, heard concerning the
proposed use of property commonly known as 850, 856, 860
Baldwin Avenue and 653 Fairview.
The. legal description of the subject site is as.
follows:
Parcell: The easterly 69 feet of Lot 1 of
Tract No. 3430 in the City of Arcadia, in the
County of Los Angeles, State of California, as

the Office of the County Recorder of said County.

APPLICATION
This application, filed on. July 10., 1972, by Paul
Friedman and Murrey Seidner (applicants) on behalf. of
United Califor~ia Bank ,(owners), reque~ts a conditional
use permit to operate an automotive center with an
existing building.

~ The subject property is zoned C-2, C-2 & D, PR-2
and PR-3 and developed with an existing automotive dis~
play sales and office building, automotive service
buildings, and a parking lot area.
Property to the north is developed with mixed com-
mercial uses and single family dwellings and apartments;
property to the east is zoned R-3, c-o & D and developed
with-apartments; property to the south is zoned C-~ and
PR-3 and developed with mixed commercial uses and a
parking lot. Across FairviewAvenue the property is
zoned C-2 & H, R-3 and PR-3 and developed with mixed

The C-2 zone requires that retail stores or businesses
not involve any kind of manufacture, processing or treat-
ment of products other than that which is clearly incidental
to the retail' business conducted on the premises. It '
appears that the applicants will not be stressing retail
sales of automotive parts and supplies but instead will be
operating more of an automot~ve service anq repair type
of business which, accordirig~eo Code, is limited to C-M
and M zones with a conditional use permit.
Code, requires a total of 85 parking spaces based
upon the total floor area. of all buildings on the property.
Existing are a total 'of' 58 marked spaces 8' 6" by 20' in
size. Code requires that.all. parking spaces be 9' by 20'.
The plot plan was'deficient in that it did not give
dimensions of the two planter areas iocated adjacent to
the building, existing planters located in the parking
lot or for the proposed planter on the north side of the
Fairv~ew.Avenue parking lot area. Code requires that
three percent (3%) of a parking lot be landsc~ped. In.
addition, the plot plan did not show the parking stalls
and only indicated one driveway along the Baldwin Avenue
frontage.
Code requires that additional landscaping be located
along ~e parking lot area fronting on Baldwin Avenue.
Further, the plot plan did not indicate an enclosed
trash area or outdoor lighting arrangement; also, no
s~gn plans were submitted.
The plot plan was also deficient by not showing
existing chain link fencing that separates the Baldwin
Avenue parking area fro~ the automotive service areas or

RECOMMENDATION
The Planning Department fe s that the proposed use
is more of a garage type. busin s rather than being an
incidental use to retail saies and should be restricted
to a C-M or M zone. Therefore, the Planning Department
recommends that this application be denied.
However, if the Planning Commission desires to
approve this application, the following conditions. should
be made conditions of said approval:
1.
Applicants shall submit to the Planning Depart-
ment a revised plot plan delineating all of the
deficiencies outlined in this report.
