RESOLUTION NO. 786
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING A
CHANGE FROM ZONE R-1TO R- 3 ON PROPERTY
KNOWN AS 445-461 WEST DUARTE ROAD.
WHEREAS, a publiC hearing was held on June 13. 1972.
for the purpose of considering changing the zone from R-l to R-3
on the property known as 445-461 West Duarte Road. more particularly
described as follows:
Lots 51 and 52 of Tract 3430 in the City of
Arcadia. County of Los Angeles. as per map
recorded in Book 42. page 32. of Maps. in the
Office of the County Recorder of said County; and
WHEREAS, all interested persons were given full oppor-

tunity to be heard and to present evidence.
NOW, THEREFORE, BE IT RESOLVED:
SECTION 1. That the Planning Commission recommends to the
City Council that the zoning on the above described property be
changed from R-l to R-3.
SECTION 2. That the Planning Commission finds that the
proposed change complies with the General Plan which indicates this
area as high-density residential; adjacent property is developed
with multiple dwellings and the pUblic conven~ence. necessity and
general welfare justify the above zone change.
SECTION 3. The Secretary shall certify to the adoption
of this resolution.

REQUEST TO CHANGE ZONE FROM R-l TO R-3
APPLICATION
This application, filed on May 26, 1972; on behalf of
Shareholders Capital Programs (buyers in escrow), and Alton
E. and Muriel L. Scott, Lawrence A. Beckstrom, and Norina
Cannizzo (owners), is a proposal to change the existing R-l
zone to R-3 for the property at 445-461 West Duarte Road.
PRESENT LAND USE AND ZONING
.
The subject site is zoned R-l, located on two lots
(Lots 51 and 52, Tract 3430), and is developed with seven
(7) single.family dwellings. Property to the north is zoned
R-3 and is developed with single family dwellings. Property
to the east, so~th and west is developed 'with apartments and
is zoned R-l. (See attached Land Use.and Zoning Map.)
ANALYSIS
The applicant applied for a change ,of zone in order
to permit the development of a 46~unit condominium project.
The proposed project would be expected to meet applicable
R-3 regulations except those, which may. be permitted through
modification procedures.
The proposed change of zone would comply with the
Gen~ral Plan, which indicates this area as High Density
Residential.
City Council Resolution No. 3356 (adopted March 7,
1961), granted a variance which permitted certain properties
along Duarte Road to be developed for any R-3 use. In
general, the variance included property on the nort;h side of
Duarte Road between Holly and Lovell, and on the south side

of Duarte Road between the Church of. the Good Shephard and
Lovell Avenue. (See attached area map.) The Council believed
that placing the area in a .less restrictive zone at that time
would have served. little useful purpose as there were
numerous single, family dwelling property owners in opposition
to this move. The variance expired on March 7, 1971.
RECOMMENDATION
The Planning Department recommends approval of this
application for the following reasons:
1. The proposed use of the property would be com-
patible with the General Plan recommendation of
"High Density Residential."
2. The subject property is contiguous to high density
residential developments to the east, west and
to the south.

Subject property is surrounded by multiple zoned
property with little or no vacancy factor. The area
is in need of additional multiple zone property as
there are not substantial available apartments to be
offered to the public.

suitable for the purposes permitted in the proposed zone than
for the purposes permitted in the present classification?

allowed variances to construct apartment buildings, sUbject
property could not feasibly be developed for residential
use. Any residential development planned would have lots
backing up to 2-story apartment buildings which would not
allow privacy for the single family.

TO PROPERTY OWNERS WITHIN A 300-FOOT RADIUS
SHAREHOLDERS CAPITAL PROGRAMS, INC., buyers in escrow of real
property located within the City of Arcadia, California, and
hereinafter described, has filed with the Planning Commission of
the City of Arcadia, an application requesting a zone change from
Zone R-1 to R-3 on the following described property.
.
Lot 51 and Lot 52 of Tract 3430 in the City of Arcadia,
County of Los Angeles, as per map recorded in Book 42,
Page 32 of Maps, in the Office of the County Recorder of
said County.
The property is commonly .known as 445, 453 through 457 and
461 Duarte Road.
NOTICE IS HEREBY GIVEN that on Tuesday, June 13, 1972, at
7:30 p.m., in the Council Chamber of the Arcadia City Hall, 240

West Huntington Drive, Arcadia, California, said Planning Com-
mission will hold a public hearing on the proposed zone change
and an opportunity will be afforded to persons particularly
interested, and the public generally, to be heard on all matters
concerning said zone change.
