RESOLUTION NO. 785
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING THAT
THE ZONING ORDINANCE BE AMENDED TO PERMIT
CLUBS, FRATERNITIES AND SIMILAR GROUPS IN
ANY ZONE ON A CONDITIONAL USE PERMIT BASIS .
WHEREAS, a public hearing was held on May 23, 1972, to
consider amending the zoning ordinance to permit private clubs,
fraternities, sororities, lodges and community service organizations
in any zone on a conditional use permit basis, at which public
hearing all interested pexsons were given full opportunity to be
heard and to present evidence;
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION
. HEREBY FINDS AND DETERMINES AS FOLLOWS:
SECTION 1. That Section 9275.1.29,.1 of the Arcadia Municipal
Code be added to read as follows:
"9275.1.29.1. SAME. Private clubs, fraternities, sorori-
ties, lodges and community service organizations, provided that
the chief activity of any such use is not one which is customarily
carried on as a business."
SECTION 2. The Planning Commission finds that the public
convenience, general welfare, and good zoning practice justify the
a'bove amendment.

SECTION 3. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the Planning Commission of the City of

REVISION OF CONDITIONAL USE PERMIT REGULATIONS
FOR PR~VATE CLUBS, FRATERNITIES, SORORITIES,
LODGES, AND COMMUNITY SERVICE ORGANIZATIONS
The Planning Department has undertaken this study as
a direct result of Zone Change No. Z-72-2 which reclassi-
fied R-3 property on North First Avenue between the
Foothill Freeway and Foothill Boulevard to zone R-2.
Both the Planning Commission and the City Council
were concerned with the consequences of this zone change
to the American Legion property. The City Council requested
staff to research the conditions under which the American,
Legion was permitted to locate in their present zoning
and location.
The Planning Department, City Clerk's Office, and
the City Attorney's Office researched their files and no
specific variances or other use peI'llli ts were found.. The
main building was constructed in 1932 when the use was
apparently permitted without the need of a variance.
Under present regulations the use is permitted

By permitting such use in any zone with a conditional
use permit, the American. Legion use would have the same
status as presently exists as far as the existing use and
changes to the existing buildings are concerned.

Other uses not heretofore covered by conditional use
permits are community service organizations such as the
Red Cross, Girl Scouts, Boy Scouts, Assistance League,
Woman's Club, etc. In the past these uses have been per-
mitted by variances. However, the State has since set
forth strict guidelines for variances which would all but
preclude variances being granted for such uses today.
Should community service organizations wish to come
into Arcadia or relocate within Arcadia or otherwise alter
their buildings or use beyond the limits of the original
variances, there is no procedure for such changes within
the present zoning ordinance.
The conditional use permit process affords sufficient
checks and balances to insure that uses covered by the
proposed text changes would be compatible with adjacent
uses.
The Planning Department recommends Section 9275.1.53.2
which reads as follows, to be deleted: ",PRIVATE CLUBS,
FRATERNITIES,SORORITIES AND LODGES, excepting those the
chief activity of which is a service customarily carried on
asa business. ~-3 and C-O or any less restrictive com-
mercial or industrial zone." And a new section added to
the zoning ordinance to be listed under the uses which may
be permitted in any zone upon the granting of a conditional
use permit, which would read as follows: "Private clubs,
fraternities, so~orities lod es and community service
organizat~o s, cep ~ng t ose 1 0 wh~ch
~s erv~ce customar~ y carried on as a business.

Notice is hereby given that on Tuesday,
May 23,1972, at the hour of 7:30 p.m., in the
Council Chamber of the City Hall, 240 West
Huntington Drive, Arcadia, California, said
Planning Commission will hold a public hearing
for the consideration of certain changes in the
zoning ordinance.

APPLICATION
This applica~ion, filed on May 5, 1972, by Vernon
Crowder (tenant) on behalf of Carl & Elizabeth Reinhardt
(owners), requests a conditional use permit to operate a
brake repair shop within an existing industrial building.

LAND USE AND ZONING
.
The subject property is zoned M-l and contains an
industrial buiiding, a portion of which is used for a cabi-
net shop. The property to the north, east and west is zoned
M-l and developed with industrial businesses, automotive
garage, single family homes, duplexes and apartment buildings.
The property to the south across Flower Street is zoned
C-C D & H and'developed with a lumber company, building
materials company and upholstery shop. (See attached Land
Use and Zoning Map.)
PROPOSAL AND ANALYSIS
The industrial building has a total floor area of 2,9'00
square feet, the vacant portion contains 1,450 square feet.
The site is approximately 4,428 square feet.
The applic~nt is proposing to operate a brake repair
shop with a~l work to be conducted entirely within the
building. The applicant has another location, 401 North
First Avenue, where the majority of his work is done. The
proposed new location would serve as an overflow or accessory
use to the present First Avenue location.
The applicant has indicated that there would be no out-
door storage of cars.

Code requires a total of six (6) parking spaces,based
upon the combined uses of the building. Proposed are a
total of four (4).parking spaces. Two of the proposed
parking spaces would be located directly in front of two
overhead garage-type doors and the fourth space would be
located directly in front of the cabinet office door. It,
was noted during two field checks that the cabinet shop
did not have any cars parked upon the lot. In order to
provide a better circulation and parking plan as well as
additional landscaping and a Code approved tra~h enclosure,
a reduction of, three parking spaces from the required six
spaces would facilitate a better overail plan. In addition,
the revised parking plan could be designed so as to provide
direct access to the vacant portion without having a
parking space directly in front of the overhead garage door.
The Planning Department wouid not object to having
parking spaces located in front of the overhead garage
doors nor a reduction of three parking spaces.

Other deficiencies noted in the applicant's plot plan
include:
1. No trash area enclosure indicated.
2. No landscaping indicated. A minimum, of 3% should
be provided in the front yard area.
RECOMMENDATION
The Planning Department recommends that this applica-
tion be .approved subj ect to the following conditions:
