RESOLUTION NO. 782
A RESOLuwrON OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESIDENTIAL
USE AT 504-508 WEST HUNTING,TON DRIVE.
WHEREAS, on April 11, 1972, Fleming and Fryer, Ltd.
filed an application for a conditional use permit for a residential
use, Planning Department Case No. C.U.P. 72-8, on the property
commonly known as 504-508 West Huntington Drive, more particularly
described as follows:

Beginning at a point on the easterly line of
Lot 20, Tract 2828, as per map recorded in
Book 33, page 63, of Maps, in the office of
the recorder of Los Angeles County, said point
being 225 feet northerly of the southea'st
corner of said Lot 20; thence westerly perpen-
dicular to said easterly line to the easterly
line of Lot 19 of said Tract 2828; thence
westerly perpendicular to said easj;erly line
to the westerly line of said Lot 19; thence
northerly along said westerly line to its
intersectio~ with a line parallel with the
northerly line of said Lots 19 and 20 and lying
southerly distance 15 feet, at rigpt angles;
thence easterly along said parallel line to the
easterly line of aforementioned Lot 20; thence
southerly along last said easterly line to the'
point of' beginning; and
WHEREAS, a public hearing was held on said matter on
April 25, 1972, at which time all interested persons were given
full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:

SECTION 1. The SUbject property is vacant and is zoned
C-O & D. A residential use is per~itted in a C-O zone upon the
granting of a conditional use permit. Property to the north
across Hunt~ngton Drive is developed with the race track and is

zoned R-l and C-2 & H; property to the east is zoned C-O & D'and is
developed wi.th apartments and a professional office; property to
the south is zoned R-3 and is developed with apartments; property
to the west is developed with apartments and is zoned C-O & D.
The "D" overlay classific'a tion of this property pertains to C-O
uses; therefore, the proposed plan under a conditional use permit
is not subject to those regulations.
The subject property consists of portions of Lots 19
and 20 of Tract 2828. The lots together have a total frontage of
187.1~ feet on Huntington Drive and a total lot area of approximately
47,600 square feet. The average depth of Lot 19 is approximately
343 feet, while Lot 20 has an average depth of approximately 212
feet.

The applicant proposes to develop a two-story complex
with all parking provided in a subterranean garage. The proposed
intensity of the development is consistent with the General Plan
(high-density residential) and is in substantial conformance with
the R-3 code requirements.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the pUblic health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,
landscaping, and other features required to adjust said use with

the land and uses in the neighbo~hood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for residential purposes,
subject to compliance with all applicable regulations of the
Arcadia Municipal Code and upon the following conditions:
L The property shall be developed in substantial
compliance with the plans on file in the Planning Department in
said Case No. C.U.P; 72-8.
2. The R-3 zone regulations .shall be applicable to this
development and all the regulations of said zone shall be complied
with, except as expressly modified ,by these regulations.
3. The minimum distance between swimming pools and other
structures which have openings shall be fifteen (15) feet.
4. All utili ties shall be ins.talled underground.
5. A five-foot wide concrete sidewalk shall be constructed
adjacent to the curb on La Cadena Avenue and a concrete gutter
shall be constructed on Huntington Drive.
6. A complete grading and drainage plan showlng existing
and finish surface elevations shall be prepared and submitted to
the Public Works Department for approval. Pump drainage shall be
designed by a registered civil engineer per Public Works Department
requirements.

7. A final approval fee of $25 and a street tree deposit
,
of $85 for planting street trees shall be paid. These fees and
deposits shall apply only if the subdivision pro~edure is used.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
Ci ty Council of the City of Arcadia..

at a regular meeting of the Planning Commission of the City of

The Planning Conunission of the City of Arcadia,
California, will hold a public hearing on Tuesday, April

1. There was no subdivision tract map applica,tion received.
The State Subdivision Map Act defines and establishes
procedure by which a condominium is developed and the
applicant is required by law to submit, ,a tract map.
2. The special setback (8.5 feet from center line) on
Huntington Drive is not observed; a 60 foot setback
is indicated.

3. The special setback on La Cadena (55 feet from center
line) is not observed; a 50 foot setback is indicated.
4. The rear building contains four dwelling units and is
separated from the main structure by a swimming pool.
However, the two buildings are connected by an over-
head walkway; thus the two buildings are technically
considered as one buildin~, and the structure would
exceed the max~mum allowable building length permitted
by code. However, the Planning Departmen~ does not
feel the walkway would be detrimental to the plart:
5. The swimming pool is located too close to adjacent
structures. Code requires a fifteen foot minimum dis-
tance from structures with openings.

Conditions, covenants and restrictions, in form and in
content, shall meet with the approval of the City
Attorney.
Title Sheet shall include a statement'which shall restrict
all future construction of addit~onal floor area,
structures"etc., except by agreement with the City after
all necessary procedures have been followed.
The minimum distance between swimming pools and other
structures which have openings shall be fifteen (15)
feet. \
The 85 foot setback from the center line of Huntington
Drive shall be complied with.
The 55 foot setback from the center line of La Cadena
shall be complied with.

SUBJECT: CUP 72-8 - Condominium at La Cadena' and Huntington Dr.
Plans for construction of 23 condominium units on this property have been
reviewed and the following items are reconnnended as conditions of approval
of the subdivision.
Prepare and record .a tract map in accordance with the State ,Subdivis1on
Map Act if condominium units are to be sold. A 15 foot radius corner
cut-off should be dedicated on the tract map.

Install all utilities underground.
Construct concrete sidewalk 5 feet wide adjacent to the curb on La
Cadena Ave. and construct concrete gutter on Huntington Drive.
