RESOLUTION NO. 781
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING
CHANGES IN THE ZONING REGULATIONS RELATING
TO THE KEEPING OF HORSES, COWS AND SMALL
ANIMALS .
WHEREAS, public hearings were held on February 8, Feb-
ruary 22, and April 25, 1972, to consider changing the regulations
relating to the keeping of horses, cows and small animals in the
R-l zone, at which public hearings all 'interested persons were
.
given full opportunity to be heard and to present evidence;
NOW, THEREFORE, BE IT RESOLVED THAT THE PLANNING COMMISSION
HEREBY FINDS AND DETERMINES AS FOLLOWS:
SECTION 1. That Section 9252.1.4 of the Arcadia Munici-
pal Code be amended to read as follows:
"9252.1.4. ANIMA'LS AND FOWL. Small animals and fowl
shall include rabbits, poultry, domestic fowl, goats and sheep.

The raising or keeping for domestic, non-commercial use, of,not
to exceed a total of ten (10) fowl or birds; the raising or
keeping of homihgpigeons under such regulations as may be imposed
elsewhere in the Code; and total of not to exceed five (5) small
animals (and the offspring of each thereof until such offspring
is capable of being raised or maintained separately from and
independently of full grown members of the same speCies); provided
that the keeping of all small animals provided for herein shall

of not more than two (2) equine animals for the use of the family
occupying the lot, on sites having an area of not less than
sixteen thousand (16,000) square feet entirely within the boundary

lines of a single lot as such lot is shown on the subdivision map
recorded in the office of tQe County Recorder. One (1) additional
equine animal may' be kept for each additional five thousand (5,000)
square feet over the minimum sixteen thousand (16,000) square feet,
provided that no more than a total of five (5) equine animals
shall be thus kept. The keeping of such equine animals provided
for herein shall conform to other provisions of law governing same."
SECTION 2. The Planning Commission finds that the public
convenience, general welfare, and good zoning practice justify the
above amendments.
SECTION 3. The Secretary shall certify to the adoption

of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

This proposed Text Amendment, T.A. 72~3, was continued
to the April 25, 1972, Planning Commission meeting. The
purpose of this text amendment was to facilitate the admini-
stration of the Zoning Ordinance and the public's general
knowledge of the uses permitted in the R-l zone. Presently
the R-l zone does permit the keeping of livestock. The
keeping of horses is not clear in the current R-l zone regu-
lations but only as an indirect reference to the R-Q zone
regulations.
The Planning Department had recommended that the
keeping of livestock be eliminated from the. R-l zone.
However, the Planning Commission felt that perhaps the keeping
of livestock should be a permitted use in the R-l zone.
The City Attorney's opinion was that if livestock
(9attle) are to be per~itted in the R-l zone, they should
also be permitted within the R-Q zone. In addition, the
Planning Department received a petition signed by twenty-
seven (27) property owners requesting that livestock (cattle)
not be permitted in the R-l zones.
The Planning Department recommends that Section 9252.1.1+
"Animals and Fowl" be revised to read as follows:

That regulations permitting the keeping of horses be
more clearly, established by the inclusion of the following
Section:

more than two (2) equine for the use of the family
occupying the lot, on sites having an area of not
less than sixteen thousand (i~,OOO) square feet
entirely within the boundary lines of a single lot
as such lot is shown on, the subdivision map recorded
in the office of theC.9unty Recorder. One (1)
additional equine may be kept for each additional
five thousand (5,000) square feet over the minimum
sixteen thousand (16,000) square feet, provided that
no more than a total of five (5) equine shall be

I,f the Planning Commission feels that JIlorethan one
(1) cow, bull, steer or calf should be permitted on a lot
or parcel of land having an area of not less than 16,000
square feet., it will require a textamendme~t to the
Municipal Code as the Code presently defines the keeping
of two or more cows, calves" steers, bulls; or. heifers, or
combination thereof, constitutes a dairy. ~~

Attached is a copy of animal definitions to modify and/or
replace existing definitions in Municipal Code Section 4131,
submitted for your review and corrunents. Also, shouldn't
the R-O and R-l zones have the same animal regulations?

I have not been able to find in the Municipal Code
a satisfactory explanation as to how many Racing Homing
Pigeons a penson may keep or maintain on his property.
Section 4136 omits the number of homing pigeons that may
be kept on a lot. However, Section 6510 states that if
a person maintains more than 200 birds he is required to
secure a permit from the City Council and prior to January
1, 1963, a permit was not required. Does this mean that
a property owner may keep as many as 199 homing pigeons
on his property and still comply with the Municipal Code?
Would appreciate your corrunents on this matter. Thank

The following definitions, shall modify and be included
in Section ~lal of the Municipal Code.
ANIMALS
Equine: Any equine, female or male of any age.
Bovine: Any bovine, female or male of any age.
SMALL ANIMALS
Household Petsl Household pets shall include cats,
dogs, canuies, parrots and other fndrecij birds and
animals usually or ordinarily kept as household pets,
provided, that this Part is not intended to and does
nOt supersede Part 2 of this Chapter imposing a
Lioense Tax upon dogs'. but is intended to and does
supplement any other provisions of the Code covering
the subject maher.
Rabbits. POUltry and Domestio Fowl: Rabbits, poultry
and domestic fowls shall include rabbits, pigeons,
ChiCkens. ohicks, oapons, dUCKS. geese, turkeys, doves,
squabs and all similar or other domestic or domesticated
fowls or birds other than household pets.
Goats 'and Sheep: Any goat or sheep. male or female.
