A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING A
DENIAL OF A ZONE CHANGE FROM R-l TO c-o
AT 503 AND 509 WEST DUARTE ROAD AND
1111 AND 1117 LA CADENA AVENUE.
WHEREAS, on March 16, 1972, John H. and Beatrice L. Stone,
on behalf of Margaret E. Finnegan, Winifred B, Foreman and Ruth
Daley, filed an application requesting that property hereafter
described be rezoned from R-l to C-O, Planning Department Case

No. Z-72-3; and
WHEREAS, a pUblic hearing was held before the Planning
Commission on April 11, 1972, at which time all interested persons
were given full opportunity to be heard and to present evidence;
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The subject property is zoned R-l and con-
tains five single-family dwell:lmgs on four lots. Two lots front on
DlIarte Road and two lots front on La Cadena Avenue. Contiguous
property on all sides is zoned for residential uses. The General
Plan indicate,S high density residential for the subject property.

Said property is described as follows:
Those portions of Lots 47 and 48 of Tract
No. 3430 as shown on map recorded in Book 42,
page 32 of ,Maps, in the office of the recorder
of Los Angeles County described as follows:
Beginning at the intersection of the west line
of La Cadena Avenue 55 feet wide with the north-
erly ,line of Duarte Road 60 feet wide; thence
north along said west line 254.70 feet; thence
westerly parallel with the northerly line of said
Lots 47 and 48 167.05 feet; thence south parallel
with said west line to the northerly line of
said DlIarte Road; thence easterly along last
mentioned line 168.77 feet, more or less to the

point of beginning. Excepting therefrom any
portion .of said lots deeded for street plIrposes.
SECTION 2. This Commission finds that the prop.osed zone
change is not jlIstified by either public necessity, convenience,
general welfare or good z.oning pra'c tice and, therefore, rec.ommends
to the City Council that said property not be rezoned.
SECTION 3. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City C.ouncil of the City of Arcadia.

WHEREAS" JOHN H. & BEATRICE L. STONE, ET AL, owners of real pro-
perty located within the City of Arcadia, California, and
hereinafter described, has filed with the Planning Commission of
the City of Arcadia, an application requesting a zone change
from Zone ll.-l to Zone c-o on the following described property.

11,1972, at the hour of 7:30 o'clock p,m., i~ the Council
Chamber of the City Hall, 240 West Huntington Drive, Arcadia,
California, said Planning Commission will hold a public hearing
on the proposed zone ,change, and a'n opportunity will be afforded

APPLICATION
This application, fil~d on,March 16, 1972, by John H.
and Beatrice L. ~tone, and on behalf of Margaret E. Finnegan,
Winifred B, Foreman and Ruth E. Da1ey-, is a request to change
the existing R-1 Zone to C-O Zone, on four lots located at,
the northwest corner of Duarte Road and La Ca,dena AvelJue.
PRESENT LAND USE AND ZONING
The subject property, is zoned R-1 and contains five
sing'le family dwellings on four lots. Two lots front on
Duarte Road and two lots front, on La Cadena Avenue. Property
to the north consists of a vacant lot which has already re~
ceived Modification Committee approval for ~ planned apartment
building; property across Arcadia Avenue is developed with
single,family dwellings, condomini~ms and apartments, all in
zone R-3; prop.rty to the south across Duarte Road is developed
with a church, apartments~ single family dwellings, professional
office building and zoned R-l, R-2a,nd C-O &, D; property t,o
the east across La Cadena Avenue is deve10pe~ with single
famjly dwellings andap.rtments and zoned R-1 and R-3; pro-
perty to the west is d.ve1oped with apartments, mortuary and
professional offic~ building and zoned R-l,.R-3 and C-O D&H.

PROPOSAL AND ANALYSIS
The applicants are seeking a zone change to encourage
the construction ofbUsi ness and/or professional office
sfruct~re~. The c-o zone requires that every lot shall con-
tain a minimum of 10,000 square f.et. The subject site con-
tains 53,211 square feet of which only the two lots fronting
on Duarte Road meet or exceed the lot area requirements.

The two lots fronti ng on La Cadena AV,enue wo,ul d be non-
conforming as t~ey would not meet the C-O z~ne lot area re-
quirements; ,
The subject site was previously covered by Resolution
3356 which pe~mitted R-3 uses on property along both sides
of Du.rte Road between Holly Avenue a~d Lovel] Avenue,
Resolution 3356 wa$ grahted for a ten-year period of time
and expired in March. 1971.
Approval of zone chang.s Z-69-3 and Z-71-8 granted a
change of zone from R-) to R-3 for property located at.603
West Duarte Road, 515 West Duarte Road and 1103 La Cadena
Avenue. '

The 'most desirable development of this property would
be if these four lots were assembled into one parc~l and
developed as a high density residential development. This
area il indicated in the General Plan as being high denlity
residential.
The,C-O zone will permit structures to be three (J)
stories or 35 feet in height, whereas ,the R-3 zone permits
structures not to exceed two (2) stores or 35 feet in height.
There is a special setback of 80 feet from center line
of Duarte Road and 60 feet from center line'of La Cadena
Avenue that is applicable to the subject site.
RECOMMENDATION
.
The Planning Department recommends denial of this appli-
cation for the following ~easons:
1. The proposed use of the properties would ~ot be
compatfble with the recently adopted ,General Plan
which designates this,area to be developed as high
de~sity ~esidential.
2. There is adequate existing C-O zoned property in the
City which has not yet been fully developed.
3. The subject property is not contiguous to any com-
mercial zoning only to R-3 zoning.
4.' Commercial zoning of these four lot~ would not
insure or guarantee the development of all the
incl,uded parcels.

Howevet, should the Planning Commission wish to
approve this applic,tion, the Planning Department reco~mends
that the following ctinditions be made condttions of
approva'l:
I. That~any proposed use on the properties .shall
comply with the'requirements tif Section 9261,
whi ch among, oth!!r res~ri ctions i nelude ,"ev~ry
building hereafter erected ,constructec! or, esta-
blished shall be located on,a sit~ containing an
area of not-less than ten thousand (10,000) square
feet.,"

are burdensome. With a C-O zoning whioh,would permit

Definitely not , The area is now surrounded by large
apartment complexes also a ohuroh and some business
as a matter o~aot)smaller structures as limited

property owner I, solioi ted for an endorsement, gave me
a IOO~ hearty approvai of the 0-0 request. They liked
the idea of smaller struotures instead of Apartments.

Duarte Road, Arcadia, may I respectfuliy state to
your commission that I have read a copy of Mr.
Stones letter to you, dated July 2, 1971, and feel
that he does have a sou~d and reasonable proposal
in pursuing c-o professional use of his land.
Taking all growth factors into account for our
immediate neighborhoorl, Mr. Stone has truley pro-
. posed a plan for this land that wi 11 enhance
better living throug, less future residential dens-
ity, less auto density on the streets with gr~ater
traffic SAfety, and a better balance of day and
night time use of the total land in the area.
I t is my feeling that Mr. Stone's proposal em-
braces the kind of planning that has created the
excellent living conditions of Arcadia in the past
which must be continued if we are to mature grace.
