RESOLUTION NO. 776 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING AMENDMENTS TO THE ARCADIA MUNICIPAL CODE RELATING TO STREET SETBACK LINES. WHEREAS, a public hearing was held on March 28, 1972, for the plIrpose of considering changing the provisions of Chapter 3, Article 9 of the Arcadia MlInicipal Code relating to street setback lines; and WHEREAS, all interested persons were given flIll opportunity to be beard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The Planning Commission recommends to the City Council that the following sections of the Arcadia Municipal Code be added, amended or repealed as follows: -1- 776 ~ ~e of . Distance . The Planning Commission finds that the public necessity, convenience, general welfare and good'zoning practice justify the above recommendations. SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. On, one of these streets there are eleven special setbacks on one side and twelve on the other. These setbacks were established in May, 1931 by Ordinance 257 long before the current use and zoning of the affected properties. Present development trends have requi~ed numerous modifications to be made to these special setbacks, particularly in the high density residential areas. Because of the constant requests for modifications, and the apparent unreasonableness of many of the setback requirements, the Planning Department has begun study of these s~tback regulations. Because of the number and complexity of these regulations, the Planning Department can only examine a few areas at a, time. This first report examines the streets in the downtown and West Arcadia high density residential areas. The streets examined in the West Arcadia high density resi- dential area are Arcadia, Fairview, Golden West and Sunset. Their predominant setbacks are 70 feet from the center line of the street (40 feet from the front property line). This area is zoned R-3 which requires only a 25 foot setback from the property line. Modifications granted in this area have permitted 30 foot setbacks. Considerable high density residential development has taken place at either the special setback require- ment ,or at a 30 foot from property line modification. The Planning Department recommen,ds that a 30 fO,ot from property line be established as the predominant setback and recommends the following sections of the Arcadia Municipal Code, to be changed to read as follows. ~^" . . . . . Their predominant setbacks are 60 feet from center line of the street (30 feet fr.om the front property line). This area is zoned R-3 which requires only a 25 foot setback from p~operty line. Mod~fications granted in, this area have per- mitted 25 foot setbacks. The Planning Department recommends a 25 foot setback from property line as required by the zoning of the property be established as the general setback and recommends the following sections of the Arcadia Municipal Code to be deleted.
