RESOLUTION NO. 775 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING CERTAIN AMENDMENTS TO THE PLANNED RESIDENTIAL DEVELOPMENT REGULATIONS. WHEREAS, a public hearing was held on March 28, 1972, for the purpose of considering changing the, provisions of planned unit development reglIlations, Section 9277, et seq., oT the Arcadia Municipal Code; and WHEREAS, all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: . SECTION 1. The Planning Commission recommends to the City COlIncil that the following amendments, deletions and additions be made to Section 9277, et seq., of the Arcadia Municipal Code;: a. Section 9277.1 (B) shall be amended to read as follows: "Each application for the establishment of a residential planned development shall be accompanied by the following prelimi- nary plans: plot plan, subdivision plan, building elevations, landscape and site improvement plan, and such related plans and data which may be prescribed from time to time by the Planning Commission." b. Section 9277.1 (D) shall be amended to read as follows: "The Planning Commission shall have the authority to approve an application if it finds that the proposed development . is well related to existing and planned use and circlIlation patterns in the neighborhood and provides a better environmental design than would be possible under standard subdivision procedures." -1- 775 v " . . . . c. Section 9277.1 (E) "shall be amended to read as follows: "A condition of each permit shall be that final precise plans for the project shall be slIbject to review and approval by the Commission. The Commission shall approve said plans if they slIb- stantially conform with the terms of the conditional lIse permit." d. Section 9277.7 shall be amended to read as follows: "DENSITY. The maximuIil number of lots within a residential planned development shall be det,ermined by dividing 85 per cent of the gross sqlIare footage of slIbject property by the minimum lot area required by the underlying zone." . . e. Section 9277.12 shall be deleted. f. A section shall be added to read as follows: "Common walls 'between, dwellings shall be constructed with a soundproofing system in accordance with the Building Code reglIlations relating to such walls." g. A section shall be added to read as follows: "At any time af,ter the final plans have been approved, the Modification Committee may approve changes in the plan which do not substantially alter the character of the development. Application for such modification shall be made in accordance with the procedlIres applicable to the Modification Committee, provided that notice shall be given to all owners of property within 300 feet of the perimeter of the development." SECTION 2. The Planning Commission finds that the public necessity, convenience, general welfare and good zoning practice justify the above recommendations. SECTION 3. The public hearing is being held to afford the pub+ic an opportunity to be heard before such ~tems as the'method of the calculation of the allowable density are discussed by the Planning Commission. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA SETTING A PUBLIC HEARING TO CONSIDER CERTAIN AMENDMENTS TO THE PLANNED RESIDENTIAL DEVELOPMENTS REGULATIONS. THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. That a public hearing shall be held on the day of , 1972, for the purpose of determining whether the following amendments, deletions and additions should be made to the planned unit development reglIlations, Section 9277, et seq.,of the Arcadia Municipal Code: 1. SUBJECT: SUGGESTED CHANGES TO PLA~NED UNIT DEVELOPMENT REGULATIONS The Planned Unit, Development study, committee recommends the following sections of the Plan~ed Unit Development regu- lations to be modified to read as follows: 9277.1 B~ Each application for the establishment of a, ~esidential planned development, shall be accompanied by the following preliminary plans; plot plan, subdiyi~io~,plan, building elevations, landsc~pe a~d site'improvement plan, and such related plans and data which may be prescribed from time to time by a resolution of the Planning Commission. . 9277.1 D. The Planning Commission shall have the authority to approve an application if it finds ,that, the proposed development is well related to existing and ,planned use and circulation p,atterns in the neighborhood and provides a better environmental design than would be possible under etandard subdivision procedures. 9277.1 E. A condition of each permit shall be, that final precise plans for the project shall be subject to review by the Commission. The Commission shall ,have the authority to approve said plans if they, substantially conform with the terms of the conditional use permit. 9277.7. DENSITY. The maximum number of lots' within a residential planned development shall be determined by dividing the gross square footage of the subject property by the minimUJli lot, area required by the underlying zone. . 9277.10. 'COMMON AREAS AND'COMMON IMPROVEMENTS. All l~nd within the development which is not', subdivided into separate lots or dedicated for streets or'other public pur- poses, shall be shown as "common area" on the final subdivision map and shall be for the common use' of the owners of lots within the development, an<;l each owner of a lot' 'shall own an inseparable, undivided interest in the ,common area and common ~mprovements. Said interest may be, through shares of stock or voting membership in an owners association. . . . PUD REGULATIONS 2 9277.12, SITE COVERAGE. (Delete') This section, does not seem necessary inasmuch as the' site coverage, is a factor which could be regulated by the 'Commission'as a part of'a conditional use permit approval. The Committee also suggests that new sections of the Planned Unit Development be provided as follows: "Where dwelling units 'share a common wall, the con- struction of said wall shall be governed by the sections of the Arcadia Mupicipal Code relating to walls separating adjoining dwellings." "Any request for modification to an approved conditional use permit for a Planned Uhit Developmen~ shall be made by application to the Modification Commi t,tee. " . Also, in, conjunction with the, latter section, the Umi ts of Modification Commi tt,ee authority should be spelled out in the Arcadia Municipal Code in the section regulating the authority of the Modification Committee. . . . . . . Number 4. DENSITY.
