RESOLUTION NO. 774 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 30 EAST LIVE OAK AVENUE. WHEREAS, on February 28, 1972, Gerald F. Henry (lessee) and Meeker Land Company (owner) filed .an application for a condi- tional use permit for a restaurant, Planning Depa~tment Case No. C.U.P. 72-7, on the property commonly known at 30 East Live Oak . Avenue, more particularly described as follows: The westerly 25 feet of Lot 124 Tract 15628, as per Map recorded in Book 35 , pages 24 and 25 of Map~ in the Office of the County Recorder of the County of Los Angeles, State of California; and WHEREAS, a public hearing was held on said matter on March 14, 1972, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The subject property is developed with a vacant store, cleaners, storage room and parking lot and is zoned C-2. Property to the north is developed with a service station, restaurant, savings and loan, and single-family dwellings and is zoned C-l, C~O and D and R-l; property to the east and to the west is developed with a market and mixed commercial uses and is zoned C-2; 'property to the south is developed with single-family dwellings and is located . within the COlInty of Los Angeles, unincorporated territory. The proposed restaurant has a total floor area of 2,000 square feet on a site of approximately 7,900 square feet. The floor plan indicates seating for approximately sixty people. -1- 774 ,J '. - . . Code reqlIires twenty parking spaces for the restaurant and eight spaces for the'cleanersj the applicants. proposal indicates an existing total of eleven spaces for this site. The parking lot area and the alley located behind the businesses front- , ing on Live Oak Avenue are shared by all of the commercial uses. There is a deficiency of parking in this area and there is no available landfor additional parking. This entire area was developed prior to its annexation to the City of Arcadia. It is not anticipated that the proposed restaurant would generate greater traffic problems in this area. SECTION ,2. This Commission finds that: 1. The granting of a conditional use permit as hereinafter . provided will not be detrimental to the pUblic health or welfare or injurious to the property or improvements in such zone Or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, - landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for restaurant purposes, subject to compliance with all applicable reglIlations ,of the Arcadia -2- 774 . . . Municipal Code and upon the following conditions: 1. The restaurant shall be operated entirely within the existing premises. 2. The restaurant use shall continue only so long as customers of the restaurant have unres,tricted access and use of thirty (30) public parking spaces within five hundred (500) feet of the establishment. 3. All on-site areas, except the building site, which are not used for parking or circulation shall be landscaped in accordance with plans submitted to and approved by the Director of Planning. 4. All signs shall comply with Code requirements. . SECTION 4. The secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Henry (lessee) and Meeker Land Company (owner), is a request for a Conditional Use Permit to operate a restaurant in an existing building. LAND USE AND ZONING The subject property is developed with a vacant store, cleaners, storage room and parking lot and is zoned C-2. Property to the north is developed with a service station, restaurant, savings and loan and single-family dwellings and zoned C-l, c-o and D and R-l; property to the east and to the west is developed with a market and mixed commercial uses and zoned C-2; property to the south is developed with single-family dwellings and is iocated within the County of Los Angeles, Unin- corporated Territory (See Land Use and Zoning Map).
