RESOLUTIO~ NO. 771
A RESOLUTION OF THE PLANNING COMMISSION,
OF THE CITY OF ARCADIA DENYING A
CONDITIONAL USE PERMIT FOR A CHILD CARE
CENTER AT 55 EAST LIVE OAK AVENUE.
WHEREAS, on February 8, 1972, Newfield Investments, Inc.
filed an application for a conditional lIse permit for a child care
center, Planning Department Case No. C.U.P. 72-4, on the property
commonly known as 55 East Live Oak Avenue, more pa,rticularly des-
cribed as follows:

That portion of Lot 65 of the Arcadia Acreage
Tract, in the City of Arcadia, County of Los
Angeles, State of California, as per map recorded
in Book 10, page 18 of Maps, in the office of
the County Recorder of said County, described as
fo llows :
Beginning at the sOlItheast corner of Lot..20 of
Tract No. 11438, as per map recorded in Bo'ok 234,
page 22 of Maps, in said office of the County
Recorder.; thence along the easterly line of s,aid
Tract No. 11438b north 0055'25" west 117.93 feet;
thence north 86 33'18" east 95.09 feet; thence
south 0055'25" east 150.09 feet to the beginning
of a tangent curve concave northwesterly and
having a radius of 20 feet; thence southwesterly
along said curve throlIgh a central angle of
81004'40", an arc distance of 28.03 feet to the
northerly line of Live Oak Avenue 100 feet wide
as shown on said Tract No. 11438; thence alon~
said northerly line south 80009'15" west 79.00
feet to the point of beginning; and
WHEREAS, a public hearing was held on said matter on
March 14, 1972, at which time all interested persons were given .
full opportunity to be heard and to present evidence.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. The slIbject site is zoned C-O & D and is
developed with a single-family residence. Property to the north is
developed with a single-family dwelling and is zoned R-l. Property

to the east is vacant and is zone.d C-O & D. Property to the south
is developed with general commercial business and is zoned C-2.
Property to the west is developed with a bank and is zoned C-O ~ D.
The applicant's plans show, a blIilding with 3,878 square feet on a
site of 16,551 square feet. The applicant proposes to accommodate
78 children with six employees. The plan as submitted by the
applicant does not comply' in many respects with requirements of the
zoning ordinance.
SECTION 2. This Commission finds that the proposed plan
does not comply with the zoning ordinance as specified in the staff
report on file in the subject case, that the proposed plan would
not harmoniously adjust to the surrounding uses in the community,
and that denial of the plan is jus tified by good zoning prac tice .
SECTION 3. That for the foregoing reasons, this Commis-
sion denies a conditional use permit as requested by the applicant.
SECTION 4. The Secretary shall certify to the adoption of
this resolution and shall cause a copy to be forwarded to the City

Council of the City of Arcadia.

TO PROPERTY OWNERS WITHIN A 300-FOOT RADIUS
The Planning Commission of the City of Arcadia, California,
will hold a public hearing on Tuesday, March 14, 1972, at 7:30
P,!ll. in the Council Chambers of the Arcadia City Hall, located
at 240 West Huntington Drive, Arcadia, California.
The purpose of the public hearing will be to afford the
public an opportunity to be heard concerning the proposed use of
property commonly known as 55 East Live Oak Avenue, aS,a child
cape center.

The legal description of the subject site is as follows:
That portion of Lot 65 of the Arcadia Acreage Tract,
in the City of Arcad~a, County of Los Angeles, State

This application, filedon February,-8, 1972. by

ch11d care center,
PRESENT LAND USE AND ZONING
.~eT(CIA-' The subject side is zoned C-O& D and is developed
with a sing'le family residence, Property to the north is
developed with a single family dwelling and is zowed R-1.
Property to the east is vacant and is zoned C-O & D.
Property to the south is developed with general commercial

PROPOSAL AND ANALYSIS
The proposed child c~re center has a total floor area
of approximately 3,87& square feet on a siteap~roximately
1~,551 square feet. The applit~~t proposes to accommodat~
78 children, with si~ employees. The following deficiencies
are indicated on thf plot plan:
1. The applicant's drawing indicates sidewalk~ on private
property -- the drawing is in error as dimensiohs are
to prop~rty line and should not include the right-of-
way as shown,
t. The special setback of 100 feet from the centerline of
Live Oak Avenue is not observed. The drawing indicates
84 feet from center line.

3. The width of ,the access drives from Live Oak Avenue
are shown as 19 feet. Twenty-five (25) feet is the
required width.

4. The,loading ar,ea wall is two feet high, A wall three
feet high is req~ired,
5. The loading area is not.re1ated to the parking area.
6. The parting,faci1ities on El Capitan are not permitted;
the curb cuts are too large, there is nQ landscaping
or screening, and the stalls are ~ubstandard in width.
The parking layout necessitates backing across a
public right-of-way.
7. The parking numbers are deemed inadequate.
8., There are no sign plans.
9, There ar, no,l~ndscape .nd irrigation plans.
10. It is impos~ib1e to determine the orien~ation of the
bui Ming on the site. It must be determined if the
building ori,ntation conforms to the regulations that
no public entrances to any permitted business shall
be 10cated,on the side street of a corner lot nearer
than 160 feet to property in any "R" zone.
11. Outside lighting arrange~ent is not indicated.
12. There is no tr,ash area provided.
13. Mechanical equipment is not shown.
14. The play area is not confined to the rear'~ard.

any of the foregoing conditions if s~ch modific~tion will
not adversely affect property or improvements in the
vi.cinity and if such modification will eqLially accomplish
substantially the same results as well as adherence-to
the foregoing conditions. ' ,
RECOMMENDATION
.
The Planning Department recommends denial of condi-
tional use permit No. C.U,P. 72-4. The proposed plan is
substantially deficient in meeting numerous,code,require-
ments.

plans for the proposed development have been reviewed and the following should
be made conditions of approval:
1. Install all utilities underground,
2. Construct 8 foot wide concrete sidewalk with tree wells on Live Oak and
plant 15 gallon size Bottle Brush trees to conform to existing parkway
improvements in front of the adjacent property. Construct five foot con-
crete sidewalk on El Capitan Avenue.
3.
Maximum allowable driveway width is 35 feet.
