HomeMy WebLinkAbout0769 D . I ~ RESOLUTION NO. 769 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 211 EAST LIVE OAK AVENUE. WHEREAS, on Janllary 24, 1972, Ladean B. Martin filed an application for a conditional use permit for a restaurant, Planning Department Case No. C.U.P. 72-3, on the property commonly known as 211 East Live Oak Avenlle, more particularly described as follows: . Part of Lot 55, Tract No. 13217, beginning at the sOlltheasterly corner of said lot~ thence westerly along the sOlltherly line of said lot 76.34 fee t;, thence northerly parallel with the easterly line of said lot 128.22 feet; thence easterly 76.67 feet to the easterly line of said lot; thence southerly thereon 121,08 feet to the point of beginning, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 264, pages 26 and 27, of Maps, in the office of the COllnty Recorder of said COllnty; and WHEREAS" a public hearing was held on said matter on February 8, 1972, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: . SECTION 1. The subject property is developed with a vacant restallrant and related parking facilities and is zoned C-l. Property to the north is developed with a five (5) unit apartment complex and is zoned R-3. Property to the east is developed with a chllrch and related facilities and is zoned R-3. The property to the sOllth contains vacant land and a manufactllring operation and is zoned C-M & D. The property to the west of the sllbject site is developed with a service station and is zoned C-l. -1- 769 v .. . D . The proposed restalIrant would lItilize the existing building which was vacated by an earlier restaurant operation. The subject site has been unoccupied for over a year and has never been subject to a conditional lIse permit. The existing building contains a total floor area of approximately 840 square feet. The su.bject site con- tains approximately 9,536 square fe,et. A portion of the total lot fronts on Second Avenue; however, only the rectangular-shaped area fronting on Live Oak Avenue would be used for the restalIrant. The remainder of the parcel north of the service station is used for parking by the station and is separated from the restaurant site by automobile parking bumpers. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements inslIch zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is alIthorized. 3, The site for the proposed use is adeqlIate in size and shape to accommodate said lIse, and all yards, parking, loading, landscaping, and other featlIres required to adjlIst said lIse with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed lIse. . 5. The granting of slIch conditional lIse permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City COlIncil, this Commission grants a conditional -2- 769 " ' . .. lIse permit for the lIse of said pr.operty for restaurant plIrposes, slIbject to compliance with' all applicable regl''-,/:tions of the Arcadia Municipal Code and upon the following conditi6h:s: 1, The existing improvements together with those required by the conditions hereof shall be used for the condlIct of the restaurant business and shall be maintained in good condition and repair at all times. 2. Landscaping locations and materials plans shall be submitted to and approved by the Planning Department, 3, All signs shall comply with the Code. 4. All plans shall conform to all applicable codes in '. the Zoning Ordinance. 5. Each vehicular dri~eway shall have painted directional signs provided in each aisle. 6. One loading space, as required by Code, 'shall be located on the premises: 7. A two-foot landscaped buffer strip shall be planted and maintained adjacent to the east wall of the subject property, and wheel stops shall be located three feet from said planter, A five-foot landscaped blIffer strip shall be planted and maintained adjacent to the north wall of the subject property. 8. Lighting shall be hooded and arranged to reflect away from adjoining properties and streets. 9. All mechanical eqlIipment" includ'ing but not limited . to heating and air conditioning devices, shall be located within the building or if mounted elsewhere shall be screened from plIblic view. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia.
