RESOLUTION NO. 767
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A PRE-SCHOOL
AND KINDERGARTEN AT 917 vlEST DUARTE ROAD.
.
WHEREAS, on January lO, 1972, Max M. Newman filed an
application for a conditional use permit, Planning Department
Case No. C.U.P. 72-2, for construction of a pre-school and
kindergarten on property known as 917 West Duarte Road, more
particularly described as follows:
Lot 134, Tract No. 2731, in the City of
Arcadia, County of Los Angeles, State of
California, as shown on Map recorded in
Book 33, page 29 of Maps, in the Office of
the County Recorder of said County; and
WHEREAS, a public hearing was held on said matter on
January 25, 1972, at which time all interested persons were given
full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION l. The subject site contains one single-family
residence and is zoned R-3; property to the west, north and east is
zoned R-3 and is developed with single-family residences and
duplexes. Property to the south, across Duarte Road, is zoned

C-2 and is developed with general commercial stores. The proposed
pre-school and kindergarten has a total floor area of approximately
6,Ol7 square feet on a site approximately 28,620 square feet. The
applicant proposes to accommodate 134 children with 14 employees
initially, expanding to l60 children with l6 employees at a later
date. The proposed hours of operation are from 6:30 a.m. to
6:00 p.m., Monday through Friday. The applicant indicated there

would be half of the enrollment (67 children) inside the building
and half outdoors at all times of operation.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properlY one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,
. landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts 'streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That, for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for a day nursery limited
to pre-school and kindergarten children SUbject to compliance with
all applicable regulations of the Arcadia Muricipal Code and upon
the following conditions:
. 1. The existing improvements shall be removed and the
nursery shall be constructed in accordance with plans which
have been submitted to and approved by the Planning Department
as being in compliance with all applicable regulations and laws.

2. Written proof from the State Department of Social
Welfare verifying its approval of the site, the use and structures
on the site, and the maximum number of children for which a license
will be issued,be submitted prior to the issuance of any building
permits. Such proof shall also be submitted for all subsequent
annual license renewals.
3. Except for driveway areas, the front yard shall be
completely landscaped; no parking or passenger loading areas shall
be located in the front yard.
4. A passenger loading zone shall be provided on the
property for exclusive use of vehicles loading and unloading passengers.

5. A six-foot masonry wall shall be constructed around the
entire perimeter of the property except the perimeter of the front yard.
6. All utilities shall be installed underground.
7. That sidewalks shall be installed in front of the
subject property.
8. All drainage shall be intercepted and piped under the
sidewalk to the street gutter.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

ARCADIA CITY PLANNING COMMISSION
Co U. P. 72-2
The Planning Cammission of the City of Arcadia, California, will hold
a public hearing on Tuesday, January 25, 1972, at 7:30 p.m., in the Cauncil
Chambers of the City Hall, located at 240 West Huntington Drive, Arcadia, California.
The purpose of the public hearing will be to afford the public an oppor-
tunity to be heard concerning the proposed use of property commonly known as
917 West Duarte Road. The lot description of the subject site is as follows:

"Lot 134, Tract No. 2731, as shown on Map recorded in
Book 33, poge 29 of Maps, in the Office of the County
Recorder of said County (of Los Angeles)."
The applicant requests a Conditional Use Permit in order to construct a
Pre-School and Kindergarten building.
The proposed plan may be seen in the office of the Planning Department,
240 West Huntington Drive, Arcadia, Cal ifornia, Monday through Friday, between
the hours of 8:00 a.m. and 5:00 p.m.

M. Newman, requests a conditional use permit to construct
a pre-school and kindergarten.

PROPOSAL AND ANALYSIS
The proposed pre-school and kindergarten has a total
floor area of approximately 6,017 square feet on a site
approximately 28,620 square feet. The applicant proposes
to accommodate 134 children with 14 employees initially,
expanding to 160 children with 16 employees at a later
date.
The proposed hours of operation are from 6:30 a.m. to
6:00 p.m., Monday through Friday. The applicant indicated
there would be half of the enrollment (67 children) inside
the buildin and half outdoors at all times of operation.

site would not be in keeping with the residential character
of the surrounding area. The large number. of children would
constitute a disruptive factor on an interior lot such as
this.
The majority of nursery schools in Arcadia accommodate
from 25 to 50 children which create a far less intense
activity than the proposed project.

A reduction in the number of children permi tt,ed would
be recommended.
Twenty-two substandard off-street parking spaces have
been indicated with 8 feet by 20 feet parking stalls and a
20 foot driveway. The Zoning Ordinance requires 9 feet by
20 feet parking stalls and a 25 foot driveway. A maximum
of 17 Code approved parking stalls and driveway could be
built .
The plot plan does not indicate a wall to screen
parking spaces from Duarte Road.
The traffic circulation for this type of use is sub-
standard. There is no specified area designated for loading
and unloading of children from automobiles. A children's
loading area is essential for safety in a development of
this magnitude. -~- , -,
The parking requirements would be in conformance with
the zoning ordinance, (one off street parking space per
employee), however, in view of the number of children that
would be in attendance, additional parking spaces should be
provided.
A chain-link fence is proposed to surround the pre-
school/kindergarten. The Code require~ a solid masonry wall.
RECOMMENDATION
The Planning Department recommends approval of C.U.P.
72- 2, subject to the following conditions;
1. Conditions as outlined in the attached report
from the Department of Pub~ic Works shall be
complied with to the satisfaction of the Director
of Public Works.
