RESOLUTION NO. 760 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN EATING ESTABLISHMENT AT 165 EAST DUARTE ROAD. WHEREAS, on November 2, l~7l, an application was filed by Carl Karcher Enterprises, Inc. on behalf of Ralph M. and Louise Burston and Robert G. and Nona Riddle for a conditional use permit for an eating establishment, Planning Department Case No. C.U.P. 71-23, on property commonly known as l65 East Duarte Road, more particularly . described as follows: Parcell: The easterly 27 feet of Lot 18 of Block 62, of a part of Arcadia Santa Anita Tract in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book l6, Page 58 of Miscellaneous Records, in the office of the County Recorder of said County, together with the southerly one-half of the alley vacated by Ordinance No. 661 adjacent to said Lot l8 of Block 62, Santa Anlta Tract. EXCEPT the interest in the southerly lO feet of said alley, the northerly 10 feet of said Lot 18, and the southerly l2 feet measured at right angles to the southerly lot line of Lot l8 conveyed to the City of Arcadia for street. alley and highway purposes, by deed recorded in Book 4a339, Page l32, Official Records. Parcel 2: Lots 19, 20 and 21 in Block 62 of' part of Arcadia Santa Anita Tract, in the City of Arcadia, County of ,Los Angeles, State of California, as per map recorded in Book l6, Page 58, of Miscellaneous Records in the office of the County Recorder of said County, together with the southerly one-half of the alley vacated by Ordinance No. 661 adjacent to Lot 2l, Block 62, Santa Anita Tract. . WHEREAS, a public hearing was held on said matter on November 23, 1971, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The subject property is developed with a vacant service station building. The property was recently rezoned from C-l to C-2. There are service stations at each of the other three corners. Property to the north is developed with single- family dwellings, duplexes and apartments; property to the south is developed with a shopping center; property to the east is developed with commercial businesses and single-family dwellings and property to the west is developed with a single-family dwelling and vacant land. The applicant proposes to remove the existing service station and develop the site with a Carlts, Jr. eating establishment. SECTION 2. This Commission finds that: l. The granting of a conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for l~hich a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhoOd. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. . -2- 760 . . . . 5. The granting of such conditional use permit will not adversely affect the general plan... SECTION 3. That, for the foregoing reasons, subject to approval of the City Council, this Commis,sion grants a conditional use permit for the use of said property for an eating establishment subject to compliance with all applicable r,egulations of the Arcadia Municipal Code and upon the following conditions: l. The property shall be developed and used in accordance with plans filed with the Planning Department by the applicant, Planning Department Case No. C.U.P. 71-23, provided that the trash enclosure shall be relocated and constructed in the location desig- nated as parking space "42." 2,. The Planning Department shall approve all plant materials. 3. A six-foot high masonry wall shall be installed along the alley right-of-way (north side) and reduced to three feet in height fora distance of 25 feet measured from the Second Avenue property line. ~. All signs shall comply with the Arcadia Municipal Code. 5. A 15-foot radius corner cut-off at Duarte Road and Second Avenue shall be dedicated. 6. All drainage shall be intercepted and piped under the sidewalk to the gutter through the curb face. . 7. The 20-foot wide unimproved alley shall be paved in accordance with plans to be provided by the Public Works Department. 8. All utilities shall be installed underground. -3- 760 . . . . 9. City standard tree wells shall be cons truc.ted on Duarte Road and Second Avenue and $92.50 paid to the City to cover the cost of planting parkway trees. SECTION 4. The Secre,tary shall. certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. (See Land Use and Zoning Map) The proposed use complies with the' proposed Gener.al Plan. PROPOSAL AND ANALYSIS . The pr.oposed eating establishment has a total floor area of approximately 2,180 squar.e feet, on'a site approxi- mately 23,640 squar.e feet. Code requires 44 parking spaces, the applicant's pr.o- posal is for 42 spaces, however, the spaces indicated are 10 by 20 feet in size rather than 9 by 20 feet as per Code.. Staff feels the additional increase in the size of the parking spaces wo.uld be more desirable and a reduction of two (2) spaces would not be detrimental. ~o . . . C.U.P. 71..,23 -2- The parking lot area would ,have access from the alley which would have to be improved by the applicant. The residential property owners to the north have no block wall along their southerly property line which would separate them from the alley, thus affording them privacy from vehicular usage of'the alley. Adequate interior and perimeter landscaped areas have been indicated. Adequate landscape plans have been submitted, however, the kinds of plant material must comply with Planning Department approval. A trash area is indicated on the plan. . Signs proposed ~nclude the following: 1. On~ free standing sign, 25 feet in height, con- taining 126 square feet of sign area per side, or a combined total of 252 square feet. Code permits a maximum of 200 square feet for the free stand- ing sign. 2. Wall sign to be located on the east, south and west sides of the structure. Each side will con- tain 46 square feet of sign area or a combined total of 138 square feet. The wall signs comply with Code. Two double 300 watt incandescent light standards are indicated on the plan. RECOMMENDATION The Planning Department recommends that this applica- tion be approved subject to the following conditions. 1. That the conditions as outlined in th~ report from the Department ofPu);llic Works shall be complied with to the satisfaction of the Director of Public Works. . 2.
