RESOLUTION NO .759
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A SERVICE
STATION AT l7l EAST LIVE OAK AVENUE.
WHEREAS, on September 22, 1971, Shell Oil Company filed an
application for a conditional use permit" Planning Department Case
No. C.U.P. 7l-l8, for an automobile service station on property
known as l71 East Live Oak Avenue, more particularly described as
follows:

Those portions of Lots 4 and 5 of Tract
No. 12570, in the City of Arcadia, County of
Los Angeles, State of California, as per map
recorded in Book 245, Pages 47 and 48 of Maps,
in the Office of the County Recorder of said
County, described as follows:

Beginning at a point in the south line of said
Lot 5, distant westerly thereon l2.l5 feet from
the westerly terminus of the curve in the
boundary of said Lot 5 having a radius of l5
feet and a length of 21.22 feet as shown on
said map; thence westerly along said south
line l37.l7 feet; thence northerly parallel with
the east line of said Lot 4 and southerly
prolongation of said east line to the south
line of the land secondly described in the qeed
to the City of Arcadia ,recorded on October 18, 1957,
as Instrument No. 3859 in Book 55889, Page 395,
of Official Records, in the Office of the County
Recorded of said County; thence easterly and
southerly along the boundary of the land secondly
described in said deed to the southerly terminus
of the curve therein concave southwesterly having
a radius of l5 feet and a length of 23.56 feet;
thence southerly along a line" parallel with and
distant westerly 12 feet, measured at right
angles from the east line of said Lots 4 and 5
to the beginning of a tangent curve concave
northwesterly having a radius of l5 feet, said
curve at its southerly terminus being tangent to
the south line of said Lot 5 at the point of
beginning; thence southwesterly along said curve

WHEREAS, public hearings were held on October l2 and
November 23, 1971, at which times all interested persons were given
full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The subject property is developed with a
service station (three bays) and zoned C-2 & D and PR-3. Property
to the north is zoned R-2 and R-l and developed with single-family
dwellings and duplexes; to the south, property is zoned C-2 and
developed with commercial buildings, market and s,ervice stations;
to the east, property is zoned C-l, R-3 and R-2 and developed with
a service station, vacant eating establishment and apartments; to
the west, property is zoned C-2 & D, C-l & D and R-3 and developed
with a donut shop, nursery, miniature golf and professional offices.
The sub'ject property is irregular in size (140 by 148 feet) and
contains approximately 20,720 square feet. The building contains
approximately l,485 square feet. There are stations at all four
corners of the intersection at Second and Live Oak Avenues. The
service station exterior will be remodeled to a Ranch Mansard style
of design. The pump islands will be modified and additional land-
scaping will be installed.
SECTION 2. This Commission finds that:
l. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
. welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location ind~cated is
properly one for which a conditional use permit is authorized.

3. The site for the proposed use is adequate in size
and shape to accommodate s,aid use, and all yards, parking, loading,
landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by
the proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
6. The proposed use will not substantially increase
vehicular traffic on any street in a residentially zoned district.

7. The proposed use will not lessen the suitability of
any nearby commercially zoned property for commercial use by
interfering with pedestrian traffic,
8. The proposed use is not located near a place of
assembly.
SECTION 3. That, for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for an automobile service
station, subject to compliance with all applicable regulations of
the Arcadia Municipal C.ode, particularly the provisions of the zoning
regulations relating to drive-in. businesses, and upon the following
conditions:
1. That, all signs shall comply with code.

2. Improvements shall be made in accordance with revised
plans which are on file in Planning Department Case No. C.U.P. 71-18,
provided that additional landscaping shall be installed consisting
of a minimum of 30 square feet of raised planter area adjacent to
the building facade fronting on the adjacent streets, and the rest

room entrances shall be s,creened with a solid, decorative wall.
2. All utilities shall be installed underground.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the City
of Arcadia held on the 11th day of January , 1971, by the following

The Planning Commission of the City of Arcadia,
California, wi+l hold a public hearing on Tuesday,
October 12, 1971, at 7:,30 p.m. in the Council Chambers
of the Arcadia City Hall, located at 240 West Huntington
Drive, Arcadia, California
The purpose 6f.the public hearing will be to afford
the public an opportunity to be heard concerning the
proposed use of property commonly known as 171 East Live
Oak Avenue.
The legal description ,of the subject site is as
follows:

NORTHWEST CORNER OF LIVE OAK AND SECOND
APPLICATION
This application was filed on September 22, 1971, by
Shell Oil Company for property at l7l East Live Oak and
proposes to remodel the exterior of an existing service
station.
PRESENT LAND USE AND ZONING
Subject property is developed with a service station
(three bays) and zoned C-2 & D and PR-3. Property to the
north is zoned R-2 and R-l and developed with single family
dwellings and duplexes; to the south, property is zoned
C-2 and developed with commercial buildings, market and
service stations; to the east, property is zoned C-l, R-3
and R-2 and developed with a service station, vacant eating
establishment and apartments; to the west property is zoned
C-2 & D, C-l & D and R-3 and developed with a donut shop,
nursery, minature golf and professional offices. (See

City Council on December 21, 1965 and April 19, 1966,
permitted a third bay to be built, waived some of the land-
scaping requirements and permitted the roof signs to remain,
placed a five-year period of abatement on the rotating free
standing sign and permitted certain display racks at the
pump islands.
Code requires (1) a five foot wide raised planter along
the street side except for driveway openings, (2) a three foot
wide raised planter along the walls of the interior property
line to a distance equal to the front building line, (3) 150
square feet of raised planting at the intersection of Second
and Live Oak Avenues, and (4) 30 square feet of raised planting
area along building facades fronting on the street.

The existing service station is totally lacking or
deficient in all four items. Due to the pump islands being
located ten (10) feet from the property line, requiring .
landscaping would present a hardship in that the gas island
would have to be relocated or that lane closed off completely.
There is existing landscaping along the interior property
line which complies with the Code. However, the landscaping
at the intersection of Second and Live Oak Avenues is below
the 150 square foot required by the Code. In addition, the
accessway from the service station directly to the alley
could present a potential traffic hazard both to the operation
of the station and the welfare of the general public.
Staff feels that additional landscaping in conjunction
with a total remodeling of the station would be most
desirable.
RECOMMENDATIONS
The Planning Department recommends that application
C.U.P. 71.,.18 be approved subject to the following conditions:
1. All conditions as outlined in the attached report
from the Department of Public Works shall be com-
plied with to the satisfac,tion 'of the Director of
Public Works.

2. The Planning Department recommends that additional
landscaping shall be provided in the following

The revised plot plan submitted by Shell Oil Company
indicates the pump islands will be relocated in order to
provide a five (5) foot wide planter between driveways in
compliance with Code, on Live Oak Avenue and Second Avenue.
Due to the relocation of the pump iSlands, new driveway
approaches will be constructed and for this reason staff
would recommend that condition number 2A of ,the original
conditions be waived.
In. addition, the new plot plan does not indicate
the 30 square feet of planter area adjacent to the building
facade fronting on both streets, as per code, nor the re-
quired three (3) foot wide planter along the northerly
property line for a distance equal to the service station
building line, conditions number 2B and C.
Shell Oil Company has also submitted a landscape
plan.
