RESOLUTION NO. 757 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN AUTOMOBILE SERVICE STATION AT 7 WEST FOOTHILL BOULEVARD. WHEREAS, on September 24, 1971, Atlantic-Richfield Company filed an application for a conditional Qse permit, Planning Depart- ment Case No. C.U.P. 71-20, for an automobile service station at the northwest corner of Foothill BoQlevard and Santa Anita AvenQe . on a portion of the real property described as follows: Parcell of parcel map No. 1237, in the City of Arcadia, COQnty of Los Angeles, State of Cali- fornia, filed in Book 20, Page 90 of Maps, in the office of the County Recorder of said COQnty, more commonly known as 7 West Foothill Boulevard; and WHEREAS, public hearings were held on October 26 and November 9, 1971, at which times all interested persons were given full opportQnity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The applicant proposes to remove its existing service station and constrQct a new station in accordance with . plans on file in the subject case. The existing station occupies an area of 150 feet by 150 feet. It is proposed ,that the new station occupy a site which has 170 feet on Foothill Boulevard and 175 feet on Santa Anita Avenue. If the property is developed as proposed, a vacant L-shaped piece of property within said Parcell will surround the service station with 75,11 feet of frontage on Foothill BoQlevard and 65 feet of frontage on Santa Anita Avenue, -1- 757 ( ~ . . . , . . . Property to the north and west of said Parcel 1 is in one of the finest residential districts. of the City and is developed with single-family homes; the property immediately adjacent to the west is developed with a church under a variance. P~operty at the southwest corner of the intersection is developed with a service station; adjacent property is developed residentially. Property at the southeas.t corner is developed with a small, neighborhood shopping center. The property at the northeast corner is vacant. The Planning Commission finds that future developments on the L-shaped piece of property should be subject to control of the Planning Commission under a conditional use permit in order to insure proper development of the property so as to protect the adjacent residential properties from any detriment which could occur because of the unusual shape, size and frontage of said L-shaped piece of property. Therefore, the Planning Commission finds that all of said Parcell should be included in this condi- tional use permit. SECTION 2, This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which ,a conditional use permit is authorized. 3, The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood, -2- 757 , , . . . 4, The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5, The granting of such conditional use permit will not adversely affect the general plan. 6, The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district, 7, The proposed use will not lessen the suitabiiity of any nearbY commercially zoned property for c,ommercial use by interfer~ng with pedestrian traffic, 8. The proposed use is not located near a place of . assembly. . SECTION 3. That for the foregoing rea,6ons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for the reconstruction of an automobile service station, subject to compliance with all applicable regulations of the Arcadia Municipal Code, particularly the prov~sions of the zoning regulations relating to drive-in businesses, and upon the following conditions: 1, The property shall be developed and maintained in accordance with the plans on file in Planning Department Case No, C.U.P. 71-20, which will leave a vacant L-shaped piece of property surrounding the station with 65 ~eet of frontage on Santa Anita Avenue and 75 feet of frontage on Foothill BOulevard, This piece of property shall not be developed except pursuant to an amendment to this permit, and the Planning Commission hereby retains jurisdiction to amend this permit to allow a suitable development of the L-fOhaped piece of property, In the meantime, -3- 757 : , I: . . . the L-shaped piece of property sh~ll remain vacant and shall be maintained in a clear and neat condition, free from weeds, debris, and refuse, 2, All signs shall comply with the zoning ordinance. 3, The entrances to the restrooms shall be screened from view by a solid, decorative screening. 4, All utilities s,hall be, installed underground, 5. All surface drainage shall be collected and piped under the sidewalk to the street gutters. SECTION 4, The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the . September 24, 1971, by Atlantic-Richfield Company for the purpose of constructing a service station at the northwest corner of Foothill Boulevard and Santa Anita Avenue. This application was filed in con- junction with L-71-11, a proposal to create two lots from,the existing lot at the northwest corner of Foothill and Santa Anita. LAND USE AND ZONING The subject site is located at the northwest corner of the Foothill Boulevard and Santa Anita Avenue intersection and contains 58,800 square feet (240 feet by 245 feet) and is zoned C-2. The southeast corner of said lot (150 feet by 150 feet) is developed with a service station, and a strip ad- jacent to the north property line is used for additional church parking. The remainder of the property is vacant and unimproved. The property north of the subject site is developed with single family homes, to the east across Santa Anita is vacant, to the south across Foothill is partially developed with a service station,and to the west with a church. (See the attached Land Use and Zoning Map,) PROPOSAL AND ANALYSIS The applicant proposes to remove the existing service station in order to construct a new and larger facility, The existing station contains 22,500 square feet, whereas the proposed facility would occupy 31,500 square feet, The proposed station appears to comply with most of the zoning ordinance, with the exception of the height of the free standing sign and scr.eening of restrooms. A^~ . . . . . . ,C.U,P.71--20 2 The proposed development would be an improvement over the existing facility, and not adverse to the preliminary General Plan. However, the additional area adjacent to the service station site would hinder any future development of the surrounding land on the parcel. RECOMMENDATION The Planning Departmen;t'recommends approval of Conditional Use Permit No. C.U.P. 71720 subject to the following conditions, L That Lot Split Application No. L-71-11 be approved, 2, That all conditions as outlined in the attached report from the Public Works Department shall be complied with to the satisfaction of the Director of Public Works. 3. That all signs shall comply with code. 4. That restrooms shall bescreeneci.'from view bya solid decorative screening. The Planning Department has reviewed past actions on the subject property, The following is a brief out- 'line of the applications and development of the property. On March 15, 1960, the City Council adopted Reso- lution No. 3230 granting a variance for the con~truction, maintenance and operation of a c~urch and for c~urch parking at the northwest corher of Santa Anita Avenue and Foothill Boulevard. The plot plan submitted with the application indicated that the church would eventually utilize the entire corner properties, This variance lapsed without any construction having taken place. On February 20, 1962, the Ci ty Counci 1 adopted Resolution No. 3470 granting a variance for the applica- tion of a church and for automobile parking at the northwest corner of Foothill Boulevard and Santa Anita Avenue. The plot plan for the proposed church i,nd'icates that the present development of the property as' brought out in the staff report of this variance, that it was the church's intention to build a church building on the westerly portion of the property (which is the existing church). with the service station to remain until the expiration of their lease which is about eleven years, At that time the station would be removed and the main church built and erected, On October 18, 1967, the City Council adopted Resolution No, 3964 denying a change of zone from R-O to C-2 and C-2 and D to permit the co~struction of a shopping center in this area. . , , rY \' '~1i''\ V ~ ~VJ . . . . On May 13, 1969, the Planning Gommission approved Lot Split No. L-69-10. which created the current service station parcel and the "L" shaped lot around the service station, and readjusted the lot line upon which the easterly portion of the church had been built upon. This lot split was approved and one of the conditions of approval was that all conditions of Resolution 3470 which granted the variance for the church, were to remain in full force and affect, including provision for an ease- ment to maintain ing~e~s and egress from Santa Anita Avenue to the church property. Subsequent to this appeal, both the church and Atlantic Richfield sought to have the requirement of an ingre5s and egress deleted as a condi- tion of the lot spli~ approval and this request was granted by the Planning Commission on June 10, 1969. In the Planning Department's review of all the acti ons on thi's prope'rty, there was no evi dence to sug- gest that commercial uses should not be e~panded in the area already zoned for commercial purposes.
