RESOLUTION NO. 756 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR AN AUTOMOTIVE GARAGE AT 86 WEST LIVE OAK AVENUE. WHEREAS, there was filed with this Commission on October 11, 1971, the application of Truman P. Byrne for a . conditional use permit to operate an automotive garage, Planning Department Case No, C.U.P. 71-22, on the premises known as 86 West Live Oak Avenue, more particularly described as follows: The westerly 55 feet of Lot 2 of Tract No. 12049, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 224, Page 21, of Maps, in the office of the County Recorder of said County; and WHEREAS, a public hearing was held on said matter on October 26, 1971, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY RESOLVES AS FOLLOWS: SECTION 1. The subject site is improved with a building and facilities sui table for an automotive garage. SUr,rounding property within the City of Arcadia is zoned C-M and developed with various commercial uses,. The southerly line of the alley at the rear of the property is the boundary between Arcadia and Temple City. Adjacent property in Temple City is developed with single ~ family dwellings. There is an existing building on the site with a floor area of approximately 4,.800 square feet. The site is approximately 8,250 square feet. The applicant proposes to operate an automobile garage that would inclUde body, frame and axle work, and limited radiator and motor work. -1- 756 I . . . . SECTION 2. This Commission finds that: 1, The granting of a conditional use permit as hereinafter p~ovided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2,. The use applied for at the location indicated is p~operly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood,. 4, The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5, The granting of such conditional use permit will not adversely affect the general plan, SECTION 3, That, for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for an automotive garage subject to compliance with all applicable regulations of the Arcadia Municipal Code and upon the following conditions: 1, No automobile body painting shall be permitted, 2, Off-street parking will be provided for all employees, including any owner-operator, on an off-site parking facility located within five hundred feet of the subject property. 3. No vehicle which is not undergoing active repair shall be stored on the premises. 4. No vehicle which is in the custody of the garage operator for repairs on the property shall be parked on the public streets. . -2- 756 . , . . p.- ,.' . 5. All automotive work shall be done within the enclosed building on the property. 6, All operations on the property shall comply with the maximum noise regulations of the Arcadia Municipal Code, Section 9266,3,2, 7, A trash area shall be provided in accordance with the Arcadia Municipal Code, 8, All signs shall comply with the Arcadia Municipal Code. . 9. The sum of $18.50 shall be deposited with the City for the planting of one parkway tree, SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. LAND USE AND ZONING dP,7! tU,u-.;J;:.. f3'~ The subject site contains a vacant building.~ is zoned C-M and developed with an animal hospital,.;:~~ipment rental, auto shop, service station, car wash and eating establishmen}T; property to the east is zoned C-M and deve- loped with a restauran]9, la~fiWmower equipment and building materials; property to the south and west is in the City of Temple City and developed with single family dwellings and a sanitarium, (See attached Land Use and Zoning Map,) PROPOSAL AND ANALYSIS The existing building has a floor area of approximately 4,800 square feet, on a site of approximately 8,250 square feet, Code requires twenty-five (25) parking spaces; the applicant's proposal is for five (5) spaces using the existing alley for egress. The driveway aisle width of eight (8) feet is below the acceptable code requirement of sixteen (16) feet. Three (3,) parallel parking spaces (10 by 24 feet) would be the maximum that could be located on the site. r A trash area needs to be provided as required by code. C.D,P. 71-22 2 RECOMMENDATION The Planning Department reconunends that this application be approved subject to the following conditions: 1, That the conditions as outlined in the report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. 2, That a Code approved trash area shall be provided, 3, That all proposed signs shall comply with the Code. 4, That the additional twenty~two (22) parking spaces shall be provided within five hundred (500) feet of the building and a convenant in a form approved by the City Attorney shall be recorded in the office of the County Recqrder, according to Code (Section 9265,3,2), 5. That all automotive work shall be done within the enclosed building, 6. That the noise level due to any work activity shall not exceed a maximum level of seventy (70) decibles, and shall comply with M-l Code requirements, (Section 9266,3.2.) NOTICE OF PUBLIC HEARING BEFORE THE ARCADIA CITY PLANNING COMMISSICN C.U,P, No. 71-22 The Planning Commission of the City of Arcadia, California, will hold a public hearing on Tuesday, October 26, 1971, at 7:30 p,m., in the Council Chambers of the City HoII, lo'coted at 240 West Huntington Drive, Arcadia, California. The purpose of the public hearing will be to afford the public on oppor- tunity to be heord concerning the, propased use of property commonly known as B6 West Live Ook Avenue. The lot description of the subject site is as follows: "The westerly fifty-five (55) feet of Lot 2, Tract 12049 i as shown an Map recorded in Book 224, Page 21, of Maps, in the Office of the County Recorder of said County," The applicant requests a Conditionol Use Permit to use the existing building and property to operate an automobile gorage, The proposed plan may be seen in the office of the Planning Department, 240 West Huntington Drive, Arcadia, California, Monday through Friday, between the hours of 8:00 a.m. and 5:00 p,m.
