RESOLUTION NO. 754
A RESOLUTION OF THE~FLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE FERMIT FOR A" DRIVE;" IN
EATING ESTABLISHMENT AT THE SOUTHEAST
CORNER OF HUNTINGTON DRIVE AND FOURTH
AVENUE.
WHEREAS, on September 22, 1971, Henry Comstock filed
an application for a conditional use permit, Flanning Department
Case No. C.U.F. 71-19, for a drive-in eating establishment on
property known as 400 East Huntington Drive, more particularly
described as follows:

Lots 4, 5, 6 and 7 of Tract 8504,in:;tjle:City
of,Arcadia, County of Los Angeles, State of
California, as per map recorded in Book 107,
Fage 56 of Maps, in the office of the County
Recorder of said County; and
WHEREAS, a public hearing was held on said matter on
October 12, 1971, at which time all interested persons were given
full opportunity to be heard and to present evidence,
NOW. THEREFORE, THE FLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1, Subject property is developed with a vacant
used car lot and building. and is zoned C-2 & D, Froperty to
the north is developed with a new and used car sales business and
is zoned C-2 & D. Froperty to the east is developed with a motel
and single-family dwellings and is zoned C-2 and D, Froperty
. to the south and wes,t is developed with an automobile garage,
motel and single-family dwellings and is zoned C-2 & D. The
City's Service Yard is located to the south at the terminus of
Fourth Avenue. The proposed eating establishment has a total floor
area of approximately 1,200 square feet.

SECTION 2, This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such
zone or vicinity,
2. The use applied for at the location indic~ted is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,

landscaping and other features required to adjust said use with
the land and uses in the neighborhood,
4, The site ab,uts streets and highways adequate in
width and pavement type to carry the kind of traffic generated by

the proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan,
6. The proposed use will not substantially , increase
vehicular traffic on any street in a residentially zoned district,
7. The proposed use will not lessen the suitability of
any nearby commercially zoned property for commercial use by
interfering with pedestrian traffic,
SECTION 3, That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for drive-in eating
establishment purposes subject tO,compliance with all applicable
regulations of the Arcadia Municipal Code, particularly the ptoyi-
sionsof the zoning regulations relating to drive-in businesses,
and upon the following conditions:

l. The property shall ,be developed and maintained in
accordance with the plans on file in ~lanning Department Case
No, C.U.P. 71-19,
2. Landscape, irrigation and lighting plans shall be
submitted to and approved by the Planning Department before any
building permit hereunder is issued,
3. All signs shall comply with the zoning ordinance,
4, A trash enclosure shall be constructed in accordance
with the Arcadia Municipal Code.
5. All utilities shall be installed underground.
6, The owner and lessee of the subject property shall
dedicate a 15-foot radius corner cut-off at the corner of
Huntington Drive and Fourth Avenue,
7. Driveway aprons shall be constructed in accordance
with City standards at the locations shown on the plans. Unused
aprons shali be clbse~and curbs and sidewalks shall be reconstructed
in connection with such closing.
8. All surface drainage shall be intercepted and piped
under the sidewalk to the gutter.
9. Full parkway width concrete sidewalk shall be con-
structed on Fourth Avenue and two tree wells shall be cutin
existing sidewalk on Huntington Drive. Thirty-seven dollars
shall be deposited with the City for the planting of two trees.
SECTION 4, The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia,
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission of the

C.U.P, 71-19

The Planning Commission of the City of Arcadia,
California, will hold a public hearing on Tuesday,
October 12, 1971, at 7:30 p,m, in the Council Chambers
of the Arcadia City Hall, located at 240 West Huntington
Drive, Arcadia, California,
The purpose of the public hearing will be to afford
the public an opportunity to be heard concerning the
proposed use of property commonly known as 400 East
Huntington Drive.
The legal description of the subject site is as
follows:

Lots 4,5,6 a~d 7 of Tract 8504, as per map
recorded in Book 107, Page 56 of Maps, in
the ,office of the County Recorder of said
County.
The applicant requests a Conditional Use Permit

indicated. Complete landscape, irrigation and lighting
plans need to be submitted for approval

A trash area is proposed on the plot plan, Applicant
proposes to provide quick service to occupants of automobiles
with no direct car-service,
RECOMMENDATION
The Planning Department recommends that this applica-
tion be approved subject to the fOllowing conditions:
1, That the conditions as outlined in the report
from the Department of Public Works shall be
complied with to the satisfaction of the Director
of Public Works,
.2, That complete landscaping, irrigation and lighting
plans shall be submitted to the Planning Department
for approval, prior to occupancy.

'3, That the trash area shall comply with code,
