RESOLUTION NO. 752
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA DENYING A
CONDITIONAL USE PERMIT FOR AN AUTOMOBILE
SERVICE STATION AT THE SOUTHWEST CORNER
OF SANTA ANITA AVENUE AND CAMPUS DRIVE.
WHEREAS, Standard Oil Company of California on
August 13, 1971, filed an application for a conditional use permit,
Planning Department Case No. 71-16, for an automobile service
station on property known as 909 South Santa Anita Avenue, more
particularly described as follows:

That portion of Lot 3, Tract No. 950, in the
City of Arcadia, County of Los Angeles, State of
California, as per map recorded in Book 17,
Page 25 of Maps in the office of the County
Recorder of said County, described as follows:
Beginning at a point in the easterly line of
said lot, distant northerly thereon 239.97
feet from the southeasterly corner of said
lot; thence westerly at right angles to said
easterly line 150.00 feet; thence northerly
parallel with said easterly line of said lot
184.57 feet, more or less, to a line parallel
with and distant 15.00 feet southerly, measured
at right angles, from, the northerly line of said
lot; thence easterly along said last men~ioned
parallel line 130.00 feet to the beginning of a
tangent curve concave southwesterly having a
radius of 20.00 feet,' said curve being also
tangent at its southerly terminus to the
easterly line of said Lot 3, thence e'asterly
and southerly along said curve 31.42 feet to
its point of tangency with the easterly line;
thence southerly,along said easterly line
164.97 feet to the point of beginning; and
WHEREAS, a public hearing was held on said matter before
the Planning Commission on October 12, 1971, at which time all
interested persons were given full opportunity to be heard and
to present evidence.

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:

SECTION 1. The subject site is zoned C-2 and is located
at the southwesterly corner of Santa Anita Avenue and Campus Drive
and is presently developed with anll,460 square foot, one-story
building and related off-street parking facilities. The Santa Anita
Golf Course is northerly of the site in a S-2 zone. Mixed commercial

buildings are east and south of the s,ite in a C-2 & H zone and a
C-2 zone. Apartments occupy a parcel to the west and immediately
adjacent to the subject site. Arcadia High School occupies property
to the west of said apartments. ,The applicant proposes to remove
existing improvements'and construct a service station.
SECTION 2,. This Commission finds that the circulation
. of, vehicular traffic in the immediate vicinity of the subject site
is from time-to-time extremely congested and that this, in connec-
tion with the large amount of pedestrian traffic generated by the
Arcadia High School, creates a condition in the vicinity of said
site that makes it unsuitable as a location for an automobile '
service ,station; that said use would substantially increase the
traffic hazard to pedestrians using adjacent sidewalks and streets;'
further, an automobile service station at this location would not

be in conformance with the proposed general plan, Further, there is
no substantial evidence to support a finding that the proposed use
is essential or desirable to the public convenience or welfare and
therefore this Commission finds that the proposed use is not
essential or desirable to the public convenience or welfare.
SECTION 3. That for the foregoing reasons this Commis-
sion denies a conditional use permit as requested by the applicant.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the

The Planning Commission of the City of Arcadia, California,
will hold a public hearing on Tuesd.y, September 14, 1971~ at
7:30 p.m. in the Council Chambers of the City Hall, located at
240 West Huntington Drive, Arcadia, Californi'a.
The purpose of the public hearing will be to afford the
public an opportunity to be heard concerning the proposed use

APPLICATION
This application was filed .on August 13, 1.971, by Standard
Oil Company of California for the property commonly known as
909 South Santa Ahita Avehue.' The proposal is to'build a three
bay service station.
.
PRESENT LAND USE AND ZONING
The property under consideration is located in the C-2,
general commercial zone at the southwesterly corner of Campus
Drive (150 feet of street frontage) and Santa Anita Avenue
(185 feet of street frontage). Said property is presently
developed with an 11,460 square foot, one story, concrete
block building and related off-street parking .facilities. The
subject premises was used by PATH Incorporated for a community
teen center and related activities.
Attached is a map illustrating the existing land use and
zoning. The property to the north, the Arcadia County Park; is
zoned $-2. The property to the east-is zoned C~2 & H and is
developed with general commercial uses.
There is a swim school to the south lnd a seven unit
apartment complex to the west of this' subject property, all in
zone C~2.
PROPOSAL AND ANALYSIS
.
The-applicant proposes to develop a thtee bay service
station. The plot plan indicates reasonable conformity to'
devel6pment standards required by the zoning ordinance. Land-
scaping, irrigation, driveways and buildings are all withi~
code requirements. However, there are plan changes needed.
These changes are listed below:
1. Plan indicates parki~g stalls 8 x 18 feet in size
(zoning ordinance requires 9 x 20 foot stallsl.

2. Free standing sign at the intersection of Campus and
South Santa Anita indicates 28 feet hi9h (zoning
ordinance permits 25 foot height limit).
RECOMMENDATION
The proposed service station us~ does not conform to the
land use intensity indicated on the propos'ed General Plan which
has been reviewed by the Planning Commission and is presently
being cqnsidered by the City Council. This area is indicated
on the General Plan as being an extension of Public Uses, i.e.,
either Arcadia High School, Cultural Center, or other public
use fa~iltty. Based on the land use recommendations in the
General Plan, the Planning Department recommends denial of the
a p pI i ca t ion.
Approval of this application would permit new and addi-
tional land uses which do not conform with the proposed General
Plan, thus acting as a serious detriment to the implementation
of the Plan.

If approved, C.U.P. 71-16 shall comply with the following
conditions:
1. All conditions as outlined in the attached report from
the Department of Public Works shall be complied with
to the satisfaction of. the Director of Public Works.
2. Parking stall size shall comply with zoning ordinance
requirements.
3. All signs shall comply with the zoning ordinance re-
quirements.
4. All plans shall comply with zoning ordinance codes.

The following should be made conditions of approval of the subject Conditional
Use permit:
1. Intercept all drainage and convey by pipe to the st.reet. Drainage over
sidewalk and driveway aprons is not permitted.
2. Construct full parkway width sidewalks on Santa Anita Avenue and on Campus
Drive. Provide tree wells at specified locations.
3. Install all utilities underground.
4. Improvements are to extend to the south property line, i.e. to include the
southerly 30 feet.
5. Existing dwellings on adjacent property to the west of the proposed site
are owned by the applicant and vehicle access to said dwellings is by
means of a driveway opening at the west cnd of the proposed site. The
applicant should provide separate access facilities or execute a covenant
that access to the parking area of said dwellings shall be maintained
over the proposed site as long as such dwellings and parking area exist.
6. Submit detailed site plans showing existing and finish surface elevations.
7. Dedicate an additional 5 feet for Campus Drive and 20 foot radius corner
cut-off.

EXPLAIN IN DETAIL WHEREIN YOUR CASE CONFORMS
TO THESE FIVE CONDITIONS:
A, That the granting of such Conditional Use permit will not be detrimental to the public
health or welfare or iniurious to the property or improvements in such zone or vicinity.
The granting of thIS Conditional Use Permit will afford the City of
Arcadia and the owner an opportunity to pave the way for the re-
development of a present non-productive parcel of land, and allow
for a rcvcnue producing asset to the community. The property under
consideration wbuld ~e utilized to its highest advantage in the best
interests of the general public welfare. By Permitting this proposed
use, precedented development standards can be set for other develop-
ment and revitalization of the area in which it is to be located.

B. That the use appl ied for at the location indicated is properly one for which a Conditional
Use permit is authorized, The property under consideration is presently
loca ted in the C - 2, Ge'heral Comme,rcial Zone, an deve loped with an
existing building used for office and counseling type facilities.
The location of the subject property is properly one for which a
Conditional Use Permit is authorized pursuant to Section 9275,1.40
of the Arcadia Municipal Code.

C, That the site for the proposed use is adequate in size and shape to accommodate said use,
and all yards, spaces, walls, fences, parking, loading, landscaping, and other features
required, to adiust said use with the land and uses in the neighborhood, The site for
the proposed development is adequate in size and shape, being 150
feet in width, 185 feet in depth, and having 27,750 square feet of
net land area. The subject property will sufficiently accomodate
the proposed development to a greater advantage than now existing,
The proposed development will reorganize the use of land, provide
greater yard areas, and more useable amenity oriented open space,
more convenient flow of vehicular traffic circulation, a greater
abundance of landscaping, and other related development features
such, as a wall to be eretted along the interior property lines for
self containment, all of which will sufficiently adjust the pro-
posed use to the existing land configuration, and be more compatible
with other uses within the vicinity it which it would be located.

ANALYSIS
DESCRIPTION OF REQUEST - In its Application, Standard Oil Com-
pany is requesting approval of, a Conditional Use Permit to
develope an Automobile Service Station facility on property
generally located at the southwest~rly corner of Santa Anita
Avenue and Campus Drive. In addition to the Application, Stand-
ard Oil Company submits the following evidence supporting its
request:
1. In the best interests of the community, approval of the
requested Conditional Use Permi t \~ill provide the highest and
best use of a present non-productive parcel of land. The sub-
ject property is neither serving the existing use of land nor
the present zone classification to its best advantage. There-
fore, in order to eliminate a land use liability to the City
of Arcadia and to better serve the general area, this Condi~
tional Use Permit will allol~ full utilization of the existing
zoning pattern and balance the land use distribution. The sub-
ject property would best serve'the community of this area by
catering to the local service needs and the motoring public.
2. The property in question is more suitable for the pro-
posed use than for the existing use because tt will be in the
interests of furtherence of the general public welfare to im-
prove the zoning pattern by providing well balanced uses of
land. The subject property would provide for a new and attrac-
tive commercial consumer complex that would eliminate economic
stagnaSion and stimulate a healthier economy by creating a
revenue producing asset to the community. '

3. The proposed development will not be detrimcnt~l in
any way to other neighboring properties because such develop-
ment will be designed so as to blend with the surrounding ev-
vironmental elements, be self-contained, set precedented phys-
ical design features that will benefit and maintain the character
of the area, broaden the tax base, and promote, stabilize and
increase the value of property in the vacinity in which it is
loca,ted.
DESCRIPTION OF PROPERTY - The property under consideration is
located in the C-2, general Commercial Zone at the southwesterly
corner of Campus Drive (150 feet of street frontage) and Santa
Anita Drive (185 feet of street frontage.) Said property is

REVIEW OF LAND USE AND TRAFFIC SAFETY ENGI~mERING:
1. h~ND USE - When considering the requested use of land,
it must be taken into consideration whether or not the existing
use has been effective in implementing and influencing develop-
ment in the general vacinity, and also whether the property is
realistically serving the community in terms of overall contrib-
uted benefits. It is pointed out that the present land use has
created a tendency to freeze development and not produce expected
results. When applying the principals and practice of land use
planning, approval of this Conditional Use Permit can be relied
on as the major device for correcting the present land use defic-
iency.
2. T&~FFIC SAFETY ENGI~mERING - Attached hereto and made
a part of this analysis, is a Traffic Volume Flow Map which shows
vehicular traffic movements, the counts of ~lhich l'lere taken at
peak hours over a 12 hour period. Campus Drive and Santa Anita
Avenue are designed, respectively, with pavement road surface
markings and physical island channelized dividers, both streets
of which are further controlled wi th si~,mali7.ed traffic control
facilities, that regulate vehicular traffic trip destination
movements. It is further pointed out, that although this type
of trarfic control greatly reduces traffic safety hazards, there
are no absolutely safe traffic control facilities.

CONCLUSION - The question lll",-y arise relative to the disposition
of PATH Incorporated teen center. During the entire lease
period to date, Standard Oil Company has not cashed rent pay-
ments, and will return all uncashed checks in order that PATH
Incorporated may have sufficient funds for relocation. Futher-
more, upon Conditional Use Permit approval, Standard Oil Comp-
any will discontinue its Automobile Service Station operation
presently located at the corner of Baldwin Avenue and Camino
Real Avenue.
Approval of this requested permit will encourage activity that
will produce a desirable pattern of growth and development.
It will also encourage the most appropriate use of land, and
conserve, stabilize and promote the value of property in the
best interests of the Community.
