RESOLUTION NO. 751
A RESOLUTION OF THE PLANNING, COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 1440 SOUTH BALDWIN AVENUE.
WHEREAS, on August 9, 1971, Bob's Big Boy filed an
application for a conditional use permit for a restaurant, Planning
Department Case No. C.U.P. 71-15, on the property commonly known
as 1440 South Baldwin Avenue, more particularly described as
follows:

Lot 3 of Tract No. 5907, in the City of Arcadia,
County of Los Angeles, State of California, as
per map recorded in Book 63, Page 67 of Maps, in
the office of the County Recorder of said County; and
WHEREAS, a public hearing was held on said matter on
August 24, 1971, at which time all interested persons were given
full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. The applicant proposes to construct a restaurant
containing approximately 5,500 square feet on a site totaling
approximately 31,328 square feet. The subject property is vacant
and is zoned C-2; property to the north is zoned C-2 and is
developed with general commercial activities; property to the east,
across a 20-foot alley, is zoned R-2; and properties to the south
and west are zoned C-2 and are developed with commercial businesses.

SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity.

2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,
landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
~. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SEqTION 3. That, for th~ foregoing reasons, subject to
approval of the City CounCil, this Commission grants a conditional
use permit for the use of said property for a restaurant subject
to compliance with all applicable regulations of the Arcadia
Municipal Code and upon the following conditions:
1. The property shall be developed and used in accordance
with plans filed with the Planning Department by the applicant,
,Planning Department Case No. C.U.P. 71-15, provided that a'trash
enclosure shall be constructed in accordance with the Arcadia
Municipal Code.
2. Landscaping, an irrigation system, and lighting
shall be installed in accordance with plans submitted to and
approved by the Planning Department.
3. All signs must comply with the Arcadia Municipal
Code.
4. Full parkway width sidewalks with tree wells shall
be installed on Baldwin Avenue and Camino Real, and 15-gallon
parkway trees shall be planted in conformance with the Master Tree

5. All utilities shall be installed underground.
6. All drainage shall be intercepted and piped under
the sidewalk to the street gutter.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

at a regular meeting of the Planning Commission of the City of

This application, filed on August 9, 1971, by BOB'S BIG BOY, requests
a Conditional Use Permi,t 10 construct an eating esloblishment.
LAND USE AND ZONING
.
The subject site is vacant and is zoned C-2. Property 10 the north is
general cammercial and is zoned (;-2.
An alley'separotes the subject site from the residentially developed R-2
property 10 the east,;. commercially'developed C-2 property is 10 the south and west.
(See attached-land Use and Zoning Map).
The proposed land use intensity is consistent with the intensity shown on
the proposed General Plan.
PROPOSAL AND ANALYSIS
.
The proposed eating establishment has a Iotal floor of approximately
fifty-five hundred (5,500) square feet, on a site of approximately thirty-one thousand
three hundred twenty-eight (31,328) square feet.
Code requires fifty-five (55) parking spaces; the applicant's proposal is
for sixty-eight (68), with fourteen (14) of these spaces using direct access from the
existing alley.
Adequate interior and perimeter landscaped areas have been indicated.
However, complete landscape, irrigation and I ighting plans need 10 be submitted for
approvo I.
A trash area needs 10 be provided, as required by the Code.
There is a special setback requirement, along Camino Real, of sixty (60)
feet from the center line'of the street; the applicant's proposal indicates only forty-five
(45) feet ((thirty-eight (38) feet 10 the maximum overhang)). The Planning Department
does not consider this deficiency 10 be of serious detriment 10 the area or 10 traffic.
The realignment of Camino Real is tentatively'scheduled for 1975 - 1976 in the Capital
improvements Program, and if realized, will provide a substantially greater setback
than prov ided in the proposal.

RECOMMENDA TION
The Planning Department recommends that this application be approved
subject ta the following conditions:
I. That the conditions as outl ined in the repart from the Department of
Public Works shall be complied with ta the satisfaction of the Director
of Public Works.
2. That complete landscape, irrigation and lighting plans shall be sub-
mitted to the Planning Department for approval, prior to occupancy.
3. That a Code approved trash area shall be provided.
4. That all signs shall comply'with the Code.

Plans for the proposed development have been reviewed, snd it
is recommended that the following be made conditions' of spproval.
1. Install full parkway width sidewalk with tree wells
on Baldwin and Camino Real and plant 15 gallon size
parkway trees conforming to the Master Tree Plan.
2. Ins,tall all utilities underground.
3. Intercept all drainage and pipe it under the side-
walk to the street gutter as drainage over the side-
walks is not permitted.
