RESOLUTION NO. 748
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A ,
CONDITIONAL USE PERMIT FOR AN EATING
ESTABLISHMENT AT 1427 ' SOUTH BALDWIN
AVENUE. '
.
WHEREAS, on July 22, 1971, Baskin-Robbins Thirty-one
Flavors Ice Cream filed an application for a conditional use permit
for an eating 'establishment, Planning Department Case No. C.U.P.
71-12, on the property commonly known as 1427 South Baldwin Avenue,
more particularly described as follows:
That portion of Parcel 3 in the City of Arcadia,
County of Los Angeles, State of California, as
shown on Map No. 1411, filed in Book 23, page
84 of Maps, in the office of the County Recorder
of' said County presently occupied by the
building used by the applicant for the conduct
of its business; and
WHEREAS, a public hearing was held on said matter on
August 10, 1971, at whi,ch time all interested persons were given
full opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES .AND RESOLVES AS FOLLOWS:

SECTION 1. The subject site is presently in Zone C-I and
is developed as a shopping center with a food marke,t and various
commercial activities. T~e property to the north is zoned C-2 and
C-2 & H and is developed with miscellaneous commercial activities;
the property to the east is zoned C-2 and C-2 & H and is developed
with commercial businesses and a church; ahd the property to the south
is in Zone C-2. The applicant proposes to install and use chairs
having wide arms in an existing ice cream store. The applicant's
ice cream store would become an eating establishment with the
addition of wide-armed chairs. This is a use which properly

requires that a conditional use permit application be filed. The
surrounding neighborhood shopping center is adequate in size and
shape to accommodate s~id use in regard to parking, landscaping,
lighting, walls, and other features.
SECTION 2. This,Commission finds that:
1. The ~ranting of a conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious, to the property or ,improvements in such zone.or vicinity.
2. The use applied for at the locatiop indicated is
properly one for which a conditional use 'permit, is authorized.
3. The site for the proposed use is adequate in size
. and shape to accommodate said use, and all yards, parking, loading,
landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
,
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
.
use permit for the use of said property for an eating establishment,
subject to compliance with 'all applicable regulations of the
Arcadia Municipal Code and upon the following condition:
1. That the eating establishment shall be maintained in
accordance with plans submitted by the applicant and on file with
the Planning Department in said Case No. C.U.P. 71-12.

SECTION'4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia"
I HEREBY CERTIFY that the foregoing resolution was adopted
at a regular meeting of the Planning Commission of the City of
Arcadia held on the 24th day of
August , 1971, by the following

APPLICATION
This application was filed on July 22, 1971 by Baskin
Robins Thirty-one Flavors Ice Cream for the property commonly
known as 1427 South Baldwin Avenue and proposes to install
wide armed chairs in an existing ice cream store.
PRESENT LAND USE AND ZONING '

RECOMMENDATION
The Planning Department recommends that this application
be approved subject to the following conditions:
1. All conditions as outlined in the attached report
from the Department of Public Works shall be complied
with to the satisfaction of the Director of Public
Works.

CUP 7l-l2 - Baskin-Robins Ice Cream Parlor
The CUP is to permit some interior changes within the restaurant.
All required parkway improvements were installed concurrent with the
development of the main shopping center and no further improvements are
required at this time.
