HomeMy WebLinkAbout0747 ! . . . RESOLUTION NO. 747 A RESOLUTION OF THE PLANNING ,COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RESTAURANT AT 820 SOUTH BALDWIN AVENUE. C-vP 7/-/1 . WHEREAS, there was filed with this Commission on 6 July 1971, the application of Project Coordinators, on behalf of Marie Callendar Pie Shop, for a conditional use permit for a restaurant on real property known as 820 South Baldwin Avenue, moreparticu- larly described as follows: Lots 7 and 8 of Tract No. 6985, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 106, Page 53, of Maps in the Office of the Recorder of said County; and WHEREAS, a pUblic hearing was held on said matter on 27 July 1971, at which time all interested persons were given full opportunity to be heard and to present evidence; NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The subject site is zoned C-2 and is occupied by an existing eating establishment and retail bakery. Retail stores and an eating establishment are located to the north in Zone C-l. Residential uses are located to the east in Zone C-O. Retail stores and residential uses are to the south in Zone C-2. A service station, retail store and residential uses are to the . west in Zone C-2. The applicant proposes to extend an existing nonconforming use to permit an addition of approximately 275 square feet to provide an interior hall to their restrooms. They also propose an alteration within the existing sales area which would permit additional seating for 28 persons. The proposed use of this building-will be a combination of a coffee shop and retail -1- 747 . . . ,r"' ;". : . . bakery with a gross floor area of 4,675 square feet. Approximately 1,908 square feet of the proposed gross ,floor area will be devoted to the coffee shop use. This will include the dining area, rest- rooms, halls and cooking areas necessary for the coffee shop use as well as the sales area for the retail bakery goods. The applicant proposes to devote the remaining 2,767 square feet to preparation and 'storage areas for the retail bakery which prepares pies for sale on the premises ,only. The existing shop has been operating under the same use since January 10, 1968, with a seating capacity of 42 and a gross floor area of 4,400 square feet. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as hereinafter provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proP9sed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping and other features required to adjust said use with the land and 'uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to ' approval of the City Council, this Commission grants a conditional' use permit for the use of said property for restaurant purposes subject to compliance with all applicable regulations of the Arcadia -2- 747 ,.: > . . . Municipal Code and upon the following condition: 1. The property shall be used in ~ccordance with plans . filed with the Planning Department by the applicant, Planning Depart- ment Case, No. C.U.P.-71-11, provided that a trash enclosure shall be constructed in accordance ~ith the Arcadia Municipal ,Code. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City, of Arcadia.
