RESOLUTION NO. 743 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A DRIVE-IN RESTAURANT AT 301 EAST HUNTINGTON DRIVE. WHEREAS, there was filed with this Commission on 16 June 1971, the application of Dominic C. Sturniolo for a condi- tional use permit for a drive-in restaurant on real property known as 301 East Huntington Drive, Arcadia, more particularly . described as follows: Lots 12, 13, 14, 15 and 18 of Tract No. 6860 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 78, Page 75 of Maps in the office of the County Recorder of said County. WHEREAS, a public hearing was held on said matter on 13 July 1971, at which time all interested persons were g~ven full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The subject site is zoned C-2 & D. There are no buildings on the site, but it is improved with a parking lot which is used in connection with the Derby Restaurant. There is . no regulation or covenant requiring that the parking lot be so used. The applicant proposes to build a drive-in restaurant on the site which is approximately 18,500 square feet in area. The proposed drive-in has an area of approximately 1,032 square feet on the ground floor and approximately 496 sq~are feet on the second floor. -1- 743 / . . . .' . . SECTION, 2. This Commission finds that: L The granting ,of a conditional use ,pe,rmit as hereinafter provided will ,not be detrimental to the, public health or welfare or injurious to the property or improvements in such zone or vacinity. 2. The.use applied for at, the location indicated is properly one for which a conditional use, per.m1t.is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping and other features required to adjust said use with the land and,uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. 6. The proposed use will not substantially increase vehicular traffic on any street in a residentially zoned district. 7. The proposed use will not lessen the suitability of any nearby commercially zoned property for commercial use by interferring with pedestrian traffic. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for drive-in restaurant purposes subject to compliance with all applicable regulations of the Arcadia Municipal Code and upon the following conditions: 1. All improvements, including, without limitation, landscaping, signs, lighting, aisle widths, wall heights and colors and materials of the building exterior, shall be made in accordance with plans which have been submitted to and approved -2- 743 I' '. . . . by the Planning Depar tmen t" Case No. C.U.P.-7l-8. 2., The ,existing driveway ,aprons not to be used, on Huntington Drive, ,and Third Avenue ,shall. be .,close.d, and City standard concrete driveway aprons shall, be constructed ,at, the locations shown ,on the,...plaos_, . 3~ Full parkway width concrete sidewalk wi,th tree wells shall be, constructed on Huntington,Drive and Third Avenue and parkway trees shall be, planted per City, standards,. 4. All utilities shall be installed underground. Existing overhead transmission line across the lot can remain but electric service to re,s taurant shall be, undergro,und ,and ser.vice drops to adjacent properties should be relocated. 6. Dedication of a l5-foot radius corner cut-off shall be required. SECT~ON 4. The Secreta~y shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. C.U.P.-7l-8 DRIVE-IN EATING ESTABLISHMENT 301 EAST EUNTINGTON DRIVE ZONE C-I & D APPLICATION This application. filed on 16 June 1971, in the name of Dominic C. Sturniolo, owner of the property at,,30l East Huntington Drive, proposes to build a drive-in restaurant. PRESENT ZONING AND LAND USE The subject site is zoned C-2 & D. Conunercial east. south, and west of the site in Zone C-2 & D. residential homes are north and east of the site in C-2 & D (see attached Land Use & Zoning Map). PROPOSAL A~~ ANALYSIS buildings are Single-family Zones M-l and The applicant proposes to build a drive-in restaurant on a site with an area of approximately 18,,500 square feet. The first floor of the proposed drive-in has an area of approximately 1,032 square feet while the area of the second floor is approximately 496 square feet, making a total area of approximately 1,528 square feet of building floor area. The applicant's plot plan, floor plan, and elevation, fail to indIcate signs, parking lot lighting and aisle width. Theappli- cant meets Ordinance parking requirements by providing for 31 parking spaces. However, with ,the approval of C.U.P.-7l-8, it shall not be ' possible to use the subject site ~n meeting additional parking re- quirements for C.U.P.,-69-10. At the rear of the site, the present location ofa utility pole and one arresting cable limit a proposed aisle width to approximately 15 feet (see attached Plot Plan). Ordinance requires a minimum of 25 feet-. The proposed Plot .Plan does not indicate either the height or the materials of the wall abutting the street. The Municipal Code requires a three foot high solid masonry wall to be erected where parking area front, side or rear a street. ,~l 1,/~^\x' . . . " . . C.U .P.-71-B' -2- 13 July 1971 As the applicant's site is in an ar~hitectural design zone, the Plot Plan should indicate the colors and materials, of the exterior of' the building as well as the size, type" and location of signs, Planning Department Staff be'lieves that the hat-shaped canopy is in effect a three-dimensional si,gn. Due to ',it's cartoon-like quality, 'this sign is con- sidered to be a totally inappropriate architectural device both in regards to design as well as the intent of the or- dinance. Other than this hat-shaped sign, nq other signs have ,been indicated on the plans. Lighting for the building, signs, and grounds have not been indicated as required by i. Code. ' RECOMMENDATION The Planning Department recommends approval of this application subject to the following conditions: 1. Conditions as outlined in the attached report' from the Department of Public Works shall be complied with to 'the satisfaction of the Director of Public,Works. 2. The applicant shall prepare and submit a revised set of plans for Planning Department' approval'. Close the existing driveway aprons not to be used on Huntington Drive and Third Avenue and construct city standard concrete driveway ap~ons at the locations shown on the plans. 2. Construct full parkway width concrete sidewalk with tree wells on Huntington Drive and Third Avenue and plant parkway trees per city standard. 3. Inte~cept all surface drainage and pipe it under the sidewalk to the gutter. Nuisance drainage over the sidewalk 'not permitted. 4. Install all utilities underground.
