A RESOLUTION OF THE ,PLANNING COMMISS ION
OF THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR A RESTAURANT AT 1027 SOUTH
BALDWIN A VENUE .
WHEREAS, there was filed with this Commission on 4 June
1971, the application of James A. and William E. White for a
conditional use permit for a restaurant on "real property known as
1027 South Baldwin Avenue, Arcadia, more particularly described
as follows:
.
Lots 3 and 4 of Tract No. 5220 in the City
of Arcadia, County of Los Angeles, State of
California, as per map recorded in Book 55,
Page 2 of Maps in the office of the County
Recorder of said County.
WHEREAS, a public hearing was held on said matter on
13 July 1971, at which time all interested persons were given full
opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCAD~A HEREBY DETERMINES AND RESOLVES'AS FOLLOWS:
SECTION 1. The applicant proposes to open a restaurant
in a vacant store in a small neighborhood shopping center at the
northwest corner of Baldwin Avenue and Arcadia Avenue. The vacant
store was formerly occupied by London Bridge Fish and Chips. The
site 1s zoned C-2 & Hand PR-3.
SECTION 2. This Commission finds that:

1. The granting of a conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vacinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.

3. The site for the pr.oposed use is adequate in size and
shape to accommodate said use" and all ,yards" parking" loading,
landscaping and other features required to adjust said use with
the land and uses, in the neighborhood...
4,. The ,site abuts streets and highways, adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for, the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
~ use permit for the use of said property for restaurant purposes
subject to compliance with all. applicable regulations of the Arcadia
Municipal Code and upon the following condition:
1. Landscaping, including an ornamental masonry
wall acrOSS the front of the parking area and an irrigation
system shall be installed in, accordance with plans submitted to
and approved by the Planning Department, Case No. C.U.P.-71-7.

SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the,City of Arcadia.

PRESENT LAND USE AND ZONING "-

The subject site is zone~ PR-3 and C-2 & H and is pro-
posed to be located in a now vacant store in a shopping cen-
ter. The adjoining shops in the shopping center consist of
mixed commercial uses. Mixed cormnercial uses are located to
the north in zones,PR-3 and C-2 & H. To the west are apart-
ments and single-family residences in Zone R-3. Southerly
there is a vacant business and anartment houses in Zones
C-2,& H, PR-3 and R-3, Eas~erly'are neighborhood commercial
uses, bOI"ling alley, bank" professional building and a
residence in Zone C-2 & H (see Land Use and Zoning Hap).
PROPOSAL AND ANALYSIS
The applicant proposes to open an eating es-cablishment
in a vacant store (was occupied by London Bridge Fish and
Chips from 1968 to 1970) which is part of a small neighbor-
hood shopping center. The shopping center site contains
, approximately ~9,59~ square feet with the existing buildings
occupying a total area of approximately 23,666 'square feet.
The applicant's proposed eating establishment Houlrj occupy
2,~75 square feet.
As submit:ted by the applicant, the eating establishment
would provide an area for eating on the premises as ,';ell as
facili ties for take-out food.

This shopping center site is substandard in terms of
parking spaces and parking lot landscaping. Present Code
requirements, if applied to this shopping complex, Hould

require that 147 parking spaces be provided, in lieu of the
57 existing. Code also requires that a solid ornamental wall
three (3)'feet in height be erected where a parking area abl.lts
a street, and that three (3) per cent of the interior parking
area be landscaped. This site is substandard with respect to
the above menti,oned items.,
RECOMMENDATION
The Planning Department.recommendsthat this application
be denied, believing older existing shopping c~nters with
obvious inadequate parking facilities should be brought into
closer compliance with the existing code regulations by dis- 0,
couraging commercial activities which generate a higher de-
mand for parking spaces and encouraging those commercial
activities which generate a iesser'demand for parking faci-
lities.
.
In order to provide some direction and assistance to
owners and prospective tenants for this and similar commer-
cial areas, it is generally those uses \oIhich require a
conditional use permit that generate a higher demand for
parking facilities than other co~~ercial uses which are per-
mi tted by Code wi tho,u t a conditional use permit.
However, if the Planning Commission wishes to approve
this application, the following recommendation should be made
a condition of approval:
1: The conditions as outlined in the attached report
from the Department of Public Works shall be com-
plied wit~ to the satisfaction of the Director of
Pl.lblic Works.
