RESOLUTION NO. 739
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA DENYING, A CONDITIONAL 7t/-/t'
USE PERMIT FOR AN AUTOMOBILE SERVICE
STATION AND RESTAURANT AT 600-618 NORTH
SANTA ANITA AVENUE.
WHEREAS, Harker Development Corporation, on 16 December
1970, filed an application for a conditional use permit, Planning
Department File No, C.U.P.-70-l8, for a service station and
restaurant at 600-618 North Santa Anita Avenue; and
WHEREAS, a public hearing was held on said matter before
the Planning Commission on 25 May 1971, at which time all interested

persons were given full opportunity to be heard and to present
evidence,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The subject site is zonedM~l. The north
portion of the subject lot is occupied by an apartment while the
south portion is occupied by single-family dwellings, The north-
eastern portion of the site is vacant. The Foothill Freeway is
north of the subject site. The Southern California Service Center
of the U, S. Forest Service and apartments are west of the site
in R-l and R-3 zones, Apartments are south of the site in Zone M-l.
To the east of the site are single-family resident;l.al homes in

Zone M-l, The applicant proposes to build a service station and a
res,taurant on a site of approximately '48,000 square feet. The
floor area of the proposed restaurant is to be 3,808 square feet
and that of the automobile service station is to be 2,111 square
feet, Said property is described as follows:

State of California', as per maps recorded in

SECTION 2, This Commission finds that the site for the
proposed use is inadequate in size and shape to accommodate said
use and for said reasons this Commission denies a conditional use
permit as requested by the applicant.
SECTION 3, The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the

City Council of the City of Arcadia.

BEFORE THE
ARCADIA CllY PLANNING COMMISSION
C.U.P.-70-18
The Planning Commission of the City of Arcadia, California, will hold a public
hearing on 25 May 197.1 at 7:30 o'clock, p.m., in the Council Chambers of the
Arcadia City Hall, located at 240 West Huntington Drive, Arcadia, California.
The purpose of the public hearing will be to afford the public an opportunity ta
be heard concerning the proposed use of property commonly known as 600 - 618
North Santa Anita Avenue, as a service station and a restaurant,
The legal description of the subject property is as follows:

Lots 16, 17, 18, and 19 of HAVEN Tract and those portions
of Lots 11,12,13,14, and 150f Haven Tract, City of
Arcadia, County of Los Angeles, State of California, as per
maps recorded in Book 13, Pages 22, and 23 of Maps, in the
Office of the County Recorder of said County lying southerly
and southwesterly of the Foothill Freeway right of way line.
The appl i cant requests a conditional use permit,
The proposed plan may be seen in the Planning Department, 240 West Huntington
Drive, Arcadia, California, Monday through Friday between the hours of 8:00 a,m,
and 5:00 p,m.

ZONE M-l
APPLICATION
This application originally filed on 16 December 1970,
was allowed continuance by the applicant's request, to be
heard at a later date. This application, in the name of
Harker Development ,Corporation, . now proposes to build a
gasoline service station and a restaurant at 600 - 618 North
Santa. Anita Avenue.

PRESENT LAND USE AND ZONING
The subject site is zoned M-l. The north portion of
the subject lot is occupied by an apartment while the south
portion is occupied by single, family dwellings. The north-
eastern. portion of the ,site is vacant. The' Foothill Freeway
is north of the subject site. The Southern California
Seryice Center of the U. S. Forest Service and apartments
are west of the site in R-l and R-3 zones. Apartments are
south of the site in Zone'M-l. To the east of the site'are
single family residential homes in Zone M-l. (s,ee attached,
Land Use and Zoning Map).
PROPOSAL AND ANALYSIS
The. applicant proposes to build a service station and
a restaurant on a site of' approximately 48,000 square feet.
The floor area, of the proposed restaurant is to be 3808
square feet and that of the automobile service station is
to be 2111 square feet.

The Preliminary General Plan indicates high density
residential (20+ D.U./acre) for the area of the subject'site.
The applicant's development would therefore be contrary to'
the Preliminary General .Plan.
The proposed development is substandard in_that it does
not provide for the required number of parking stalls. The
Plot Plan indicates 50 parking stalls while Code requires 54
parking stalls.

Staff feels that it is the intent of the Ordinance to
provide adequate parking stalls for restaurants and service
stations even when located in Zone M-L Inasmuch as more
than 50% of the parking stalls indicated on the Plot Plan
are substandard in terms of stall widths required for
commercially zoned properties, Staff would require nine
foot wide stalls with hairpin stripes.
The Plot Plan indicates two (2) 25 foot high free-
standing signs. These signs fail to meet Zone M-l Code
requirements that only, "Orie (1) square foot of sign area
may be used for each two (2) lineal feet of building frontage.
Every sign shall be located flat against the facad,e of the
building."

The proposed development is substandard in terms of
setback required by Code. The applicant's Plot Plan
indicates a setback of 65 feet (from street center line)
for the restaurant and approximately 6'8 feet for the service
station canopy. Code requires an 85 foot setback, a diff-
erence of 20 feet and 17 feet respectively. Also, the Plot
Plan fails to clearly indicate the location of landscaping.
Code requires that plant areas and islands, shall be surrounded
by a raised concrete curb: This is not indicate,d.
The Staff also wishes to point out that this particular
intersection will be totally affected by the freeway inter-
change. Until the interchange is completed, it is difficult
to assess the impact of the freeway on this general area. It
is the Staff's belief that a new environment will be created
by the freeway; thus, two possibilities appear to be
significant:
1. Completion of the freeway should be ~ndertaken
before the application is granted so that the
City can evaluate the changes the-freeway brings
to the area;
.
2. Th~ proposed use may be of too small a scale to
efficiently utilize this land,.
If the second occurance above happens, the City faces
the danger of letting the site be pre-empted by an inferior
use. Under these conditions, the proposed development may
be a detriment to all future development.
RECOMMENDATION
Planning Staff recommends denial of this application.
This recommendation ,is based upon the belief that the best

use of this site should occur and that the freeway should be
completed befElre a decisiEln is made. At the same time, it
would appear to the Staff that the propEl sed use will not take
advantage of the full developmental possibilities of the site.
Finally, Staff finds that the applicant's proposed develop-
ment is substandard in terms of parking spaces, signs, re-
quired setback, landscaping and does not conform to the Pre-
liminary General Plan, The Planning Department recommends
that this application be denied.
However, if the Planning Commission wishes to approve
this application, the follElwing recommendatiElns should be
made conditions of approval:
1. ConditiElns as outlined in the attached report from
the Department of Public Works shall be complied
with to the satisfaction Elf the Director of Public
Works.

2. All signs shall comply with existing sign regulations.
3. Setback shall comply with Code.
4. The applicant shall prepare and submit a revised
parking, irrigation, and landscaping plan to the
Planning Departme~t for its approval.
5. Trash area shall be completely screened from public
view by an enclosure of which three (3) sides shall
consist of six (6) foot high decorative masonry
walls, or other approved screening devices.
6. The applicant shall 'provide solid decorative screening
which shall screen the entrance to all restrooms and
shall meet the approval of ' the Planning Department
7. All merchandise, wares, and crate,s, in the form of
temporary and permanent storage or display shall
be within the building.
8. All required walls shall be ornamental in nature.
9. Lighting shall comply with Code.

SUBJECT: CUP 70-18
The revised plan for the proposed development has been checked by the Public
Works Department and it is recommended that the following be made conditions
of approval:
1. Dedication of a 15 foot radius corner cut-off.
2. Construct new curb and gutter on Newman Avenue and 25 foot radius curb
return. Curb and gutter on Newman to be 20 feet from center line and
existing pavement widened as required by Department of Public Works,
3. Submit street improvement plsns per requirements of the Department of
Public Works for approvsl by the City Engineer.
4. Instsllfull parkway width sidewalk on Newman Avenue with tree wells
and plant trees per requirements of the Department of Public Works.
5. Submit detail plans for on site improvements showing existing and
f1nishedsurface elevations indicating drainage.
6. Install all utilities underground and install street light on Sants
Anita at location determined by the Department of Public Works.
7. Existing parkway on Santa Anita is 8 feet and oriNewman it is 15 feet
instead of 10 feet shown on plans.
