RESOLUTION NO. 738
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA TO THE CITY COUNCIL
RECOMMENDING A DENIAL OF A PROPOSED ZONE
CHANGE AT 1243 LOVELL A VENUE .
WHEREAS, on 21 April 1971, N. Richard Arconti, developer,
filed an application requesting that the property hereafter described
be rezoned from R-l to C-O, Planning Department Case No. Z-71-5,
for the purpose of constructin'g a medical office building; and
WHEREAS, a public hearing was held before the Planning
Commission on 25 May 1971, at which time all interested persons
were given full opportunity to be heard and to present evidence,

NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1, That the property proposed for a zone change
is presently zoned'R-l and is occupied by a single-family residence,
To the north in Zones C-O & D-H and PR-l is the eight-story medical
building and parking lot. Westerly of the site is the Security
Pacific National Bank and parking lot in Zone C-2 & H, In Zone R-l,
to the south are single-family residences. Easterly, across Lovell
Avenue in Zone R-l are single-family residences, Said property is
described as follows:

Lot 9 of Tract No. 8487 in the City of Arcadia
County of Los Angeles, State of California, as
per map recorded in Book 114, Page 48 of Maps,
in the Office of the County Recorder of said
County,
SECTION 2, This Commission finds that the R-l and P
zone immediately adjacen~ to the north of the subject property
provides a good buffer between the C-O zone where the eight-story

medical building stands and the R-l Zone; that the proposed zone
change effectively destroys the PR-l buffer zone; and that the
proposed zone change is not justified by either public necessity,
convenience, general welfare or good zoning practice and, therefore,
recommends to the City Council that said property not be rezoned.
SECTION 3, The Secretary shall certify to the adopt~on
of this resolution.

has filed with the Planning Commission of the City of Arcadia, an applicatian
requesting a zane change from R-l ta C-O on the following described property.

opportunity will be afforded to persons particularly interested, and the public
generally, to be heard on all matters concerning said zone change,

This application, filed on 21 April 1971, in the nome of N, Richard Arconti,
Developer, is a request ta reclassify 0 lot from Zone R-l ta Zone C-O.

lAND USE AND ZONING
The subject site is presently zoned R-l and is occupied by 0 single-family
residence. To the north in Zones C-O & D-H and PR-l is the eight-story medical
building and porking lot, Westerly of the site is the Security Pacific Notional Bank
and parking lot in Zone C-2 & H, In Zone R-l, ta the south are single-family
residences. Easterly, across Lovell Avenue in Zone R-l are single-family residences.
PROPOSAL AND ANALYSIS
The subject site at 1243 Lovell Avenue has the following legal description:
Lot 8 of Tract No. 8487 in the City of Arcadia, County
of Los Angeles, 'State af California, as per map recorded
in Baok 114, Page 48 of Maps, in the Office of the
County Recorder af said Caunty.
The appl icant proposes ta reclassify the subject site, which is occupied by a
single-family residence, from Zone R-l ta Zone C-O, Zone C-O is the Professional
Office Zone which would primarily permit business and medical offices, pharmacies,
medical and clinical laboratories and financial institutions, The appl icant cantends
that there are no C-O zoned areas available in the West Arcadia Medical-Dental
Community and that the subject site is more suitable for professional uses than for
residential.

Code requires that the m in imum lot size, for developing a C-O zoned lot is
10,000 square feet; the applicant's proposal has provided 0 lot of approximately
19,800 square feet.
It is also Staff's opinion that, in view of the proposed General Plan
recommending that that area be utilized far "Administrative, Professional, Financial
Office" uses, Zone Change Application No. Z-71-5 would be in compliance with the

proposed General Plan. Furthermore, the opplicant's developmental plans (please
see attached) for a four-suite dental complex would also be in compliance with the
proposed General Plan. Staff believes that this development would only be an
extension of the professional office center which is matudng in this area and that
the proposed zone change would not be detrimental to the neighborhood. However,
certain modifications would have to be made to the appl icant's proposal, The setback
on the west side of Lovell Avenue between Duarte Road and Naomi Avenue is 70 feet
from the center line of the street; the applicant has not complied with Code in this
respect, Furthermore, Code specifies that when a side yard in Zone C-O abuts a
residential zone, the'side yard of ten (10) feet shall be maintained.
RECOMMENDA TION
Staff recommends that Zone Change Application No. Z-71-5 be approved subject
to the following conditions:

1) All conditions as submitted in the report from the Deparhnent of Publ ic
Works shall be compl ied with to the satisfaction of the Director of Publ ic
Works.
2) All development shall be in compliance with C-O zone regulations.

The plans for the propoaed development have been reviewed and the
following should be made conditions of approval.
1. Submit a detailed site plan showing existing and finish surface
elevations and method of drainage. This plan must be approved by
the Public Works Department prior to issuance of a building permit.

2. Construct concrete gutters, driveway aprons, and full parkway width
sidewalk with tree wells on Lovell Avenue and plant parkway trees
all in accordance with City standards.
3, Install all utilities underground.

of Arcadia agrees that this area will be best suited
for Professional use expansion.
