RESOLUTION NO. 735
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA TO THE CITY COUNCIL
RECOMMENDING A DENIAL OF A PROPOSED ZONE
CHANGE AT 530-644 WEST FOOTHILL BOULEVARD.

WHEREAS~ on 1 March 1971, Herbert M. Piken filed an
application requesting that the property hereafter described be
rezoned from R-l to C-l, Planning Department Case No. Z-71-1,
for the purpose of developing said property into a neighborhood
shopping center; and
WHEREAS, a public hearing was held before the Planning
Commission on 11 May 1971 at which time all interested persons
were given full opportunity to be heard and to present evidence,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. That the property proposed for a zone change
is presently developed with single-family residences, except for
one vacant parcel. The property is bounded by the Foothill Freeway
on the south, Foothill Boulevard on the horth, the Baldwin Avenue
undercrossing on the east and a Foothill Freeway off ramp on the
west, Property across the Foothill Freeway to the south is zoned
for and developed with single-family reeidences as is the property
across Foothill Boulevard to the north. Said property is described
as follows:

Lots 2, 3, and 4 of Los Robles de Santa Anita in the
City of Arcadia, County of Los Angeles, State of
California, as per map recorded in Book 33, page 20
of Maps, in the Office of the County Recorder of
said County, EXCEPT those portions conveyed to the
State of California for Foothill Freeway,

SECTION 2, This Commission finds that the proposed
zone change is not justified by either public necessity, convenience,
general welfare or good zoning practice and, therefore, recommends
to the City Council that said property not be rezoned.
SECTION 3. The Secretary shall certify to the adoption
of this resolution,

at a regular meeting of the Planning Commission of the City of

APPLICAT I ON
This application, filed on the First of March 1971 in the
name of Herbert M. Piken of 15720 Ventura Boulevard, Suite 216,
Encino, California; proposes that the subject Rroperty be rezoned
from R-1: 10,000 to C-1 & D and developed into a neighborhood
shoppi!1g center.
. PRESENT LAND USE AND ZONING
The subject site is zoned R-1: 10,000 and presently. contains
single-family residences and one vacant parc.l. This site is bo~nd-
ed by. Foothill Boulevard, the Foothill Freeway, the Baldwin Avenue
undercrossing, and a Foothill Freeway off-ramp. Oirectl~across
Foothill Boulevard are single-family homes; to the west lie
residential, agricultural, and vacant lands; east of the site are
located other single-family homes. This particular site is unique
in this entire tier of lots by being totally isolated by'major
trafficway~,_ Tbus, t~e site suffers from the pro~imity of ~oth
current and projected large volumes of traffic, making residential
use5 most unlikell. Inas~uch as the site is isolated by trafficways
to this extent, the number of alternative uses logically to be
expected to occur is radically,limited.
PROPOSAL AND ANALYSIS

Following is a legal description of. the property for which
the zone change is requested:
"Lots 2,3, and 4 of Los Robles de Santa Anita in the
City of Arcadia, County of Los AQgeles, State of
California, as per map recorded in Book 33, Page
of Maps, in the Office of the County Recorder of
said County, except those portions conveyed to the
State of California for Foothill Freeway~.

u~es: A bank containing, 7,200 sq~are feet of floor area; a res-
taurant containing.5,000 square feet; a market containing,27,200
square feet;,a drug_store containing 30,000 square feet; and
satellite stores, up to eight in number, whose total gross area
equals 10,000 square feet.
Elevations submitted with the plo~ plan i'ndicate a commercial
compl~x that can be well integra.te4 with the neigbborhood. The
sJte is so closely.tjed to the freeway_environment that the Staff
belJeves that the prpP9.ed develop~ent is likely. ~o be ~he best
proposal submitted for any_time in the foreseeable future. It
would appear that no alternative land use acceptable to the City
can be expected because of the un~sual characteristics of the
site.
RECOMMENDATION
Because of the particular nature of the site and the ~ighly
visible impact of the freeway~ the Planning Staff believes that
the use is both reasonable a,nd suitable. Therefore, th,e Planning
Department recommends that the zon'ing be changed to the proposed
C-1 & D and that the application be granted with the fCllowing
conditions:
1. All conditions of approval as submitt.ed in the report
from the Department of Public Works shall be complied
with to the satisfaction of the Department of Public
Works,
2. No structure of) this parcel shall be permitted to extend
above the grade of, Foothi 11 Boulevard higher than 20 feet
measured from the so~therly curb line of Foothill
Boulevard.

3. The developer shall be responsible for sc.reening planting
to be placed in the bordering s~rip alo~g the northerly
stde of Foothill Boulevard adjacent to the frontage
road serving the R-O single-family homes north of Foothill.
4, All developments shall be set back no less than 75 feet
from the centerline of Foothill Boulevard.
5. ' An irrigation and landscaping plan shall be submitted to
the Planning Department for its approval.
6. All u~ilities shall be placed underground.
7. No less than five (5) per cent of the interior parking
lot shall be landscaped as approved by City Staff.

a~ No discount stores shall be permitted;,cleaning es~
tablishments shall be limited to pick-up and delivery
service only. Actual cleantng shall not be permitted
on the site,
9. Buildings shall not comprise more than 45 per cent
coverage of the site.
10. One free-standing sign shall be permitted which may be used
only for the purposes of identifying the commercial facili-
ties. Noadditi'onal signs identifying types of uses or
businesses shall be allowed except on the face of the
respective buildings. All signs shall be reviewed and
approved by the Planning Commission.
11. All grading shall be approved by the Department of Public
Works.
12. All parting stalls shall be equipped with wheel stops.
13. No mature trees shall be removed from the site for
construction without the prior approval of the Planning
Commission.

Planning Commission,

SUBJECT: Zone Change Z-71-l - Foothill at Baldwin
Plans for the proposed development have been reviewed by the Engineering Division, and
the following items are recommended as conditions of approval:
1. Foothill Boulevard has recently been widened on the south side and the right-of-way
and pavement width are adequate to handle the anticipated traffic.
2. The traffic circulation plan appears to be a workable solution but State approval
would be required to construct left-turn pockets and acceleration lane as shown on
the plan if constructed prior to relinquishment by the State.
3. Sanitary sewers are not complete between Baldwin Avenue and San Carlos along the
northerly line of the Foothill Freeway. The developers may have to install and
maintain a sewage lift station to pump the sewage into the Foothill Boulevard
Sewer or obtain the necessary easements and extend the sewer along the northerly
line of the Freeway from Baldwin Avenue to San Carlos.
4. A detailed site plan showing finish surface elevations, drainage and sewage dis-
. posal shall be submitted for approval.

A plan for the street work in Foothill and Baldwin shall be prepared and submitted
for approval by the City and State. All surface drainage shall be discharged into
Btorm drain facilities on the north side ,of the Freeway.
6.
All utilities to be installed underground within the site and the developer shall
make arrangements with the Edison Company to underground all existing overhead
utility lines on the south side of Foothill and install six 20,000 lumen street
lights on marbelite poles with underground circuits at locations approved by the
Department of Public Works. Adequate lighting for Baldwin Avenue will be in-
stalled as a part of the current Foothill Freeway project.
7.
Construct full parkway width sidewalk on Foothill Boulevard with tree wells and
plant parkway trees per City standard.on Foothill and Baldwin.
8.
Developer shall remove existing concrete pavement in medians on Foothill and in-
stall automatic sprinkler system and landscaping designed by a registered land-
scape architect. The median and slope easement on Baldwin Avenue shall be
trkated in the same manner and all plans are subject to the approval of the
Ditector of Public Works.

WHEREAS, Herbert M. Piken, interested party of real property located within the City
of Arcadia, California, and hereinafter described, has filed with the Planning Commission of
the City of Arcadia, an application-requesting a zone change from Zone R-l to Zone C-l &
D on the following described property:
Lots 2, 3, and 4 of Los Robles de Santa Anita in the City of
Arcadia, County of Los Angeles, State of California, as per
map recorded in Book 33, Page 20 of Maps, in the Office of
the County Recorder of said' County, EXCEPT those portions
conveyed to the State of Cal ifornia for Foothill Freeway,
The property is commonly known as 530, 550, 610, 624, 644 West Foothill
Boulevard.
Now, therefore, notice is hereby given that on Tuesday, 11 May 1971, at the hour of
7:30 o'clock p.m, in the Council Chambers of the City Hall, 240 West Huntington Drive,
Arcadia, California, said Planning Commission will hold a public hearing on the proposed
zone change, and an opportunity'will Ie afforded to persons particularly interested, and the
public generally, to be heard on all matters concerning said zone change,
