HomeMy WebLinkAbout0734 .. . . t RESOLUTION NO. 734 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA DENYING A CONDITIONAL USE PERMIT FOR A DRIVE-IN PHOTO SALES BUSINESS AT 645 WEST DUARTE ROAD. ...J 7/-6 WHEREAS, John Ludlow, on 19 April 1971, filed an application for a conditional use permit, Planning Department File No. C.U.P.- 71-5, for the use of said property for a drive-in photographic film sales and processing business; and . WHEREAS, a public hearing was held on said matter before the Planning Commission on 11 May 1971 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The subject site is zoned C-2 with "H" overlay and located in the parking lot of a shopping center at said address. The buildings surrounding the subject site in the shopping center consist of a discount food market to the north with mixed commercial buildings to the east and west. The applicant proposes to build a small "walk-in" film processing shop in the shopping center parking lot. The area of the proposed site is 157.5 square feet, SECTION 2. This Commission finds that the proposed development would cause a disruption of the existing traffic circu- , \ j lation in the area which is already inadequate, and that the site is otherwise unsuitable for' development for the proposed use. SECTION 3. That for the foregoing reasons this Commission denies a conditional use permit as requested by the applicant. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the -1- 734 ,/ " . . . City Council of the City of Arcadia. DUARTE ROAD ZONE C-2 APPLlCA TIO N This applicotion, filed on 19 April 1971, in the nome of John Ludlow, proposes to construct a "wolk-in" film processing building for the reception, transmittal rand purchasing of film; this film will not be chemically processed and developed on the subject site, . PRESENT LAND USE AND ZONING The subject site is zoned C-2 with "H" overlay and is located in the parking lot of 0 shopping center. The buildings surrounding the subject site in the shopping center consist of a discount food market to the north, with mixed commercial buildings to the east and west. The Arcadia Professional Center and the Mutual Savings Building are to the south and are zoned C-2 with "H" overlay (see Land Use & Zoning Mop). PROPOSAL.AND ANALYSIS The,applicant proposes to build a small "walk-in" film pr:ocessing shop (pick-up and delivery) in the shopping center porking lot, The area of the proposed site is 157.5 square feet. Ordinance requires a drive-in business to have 0 minimum lot area of 10,000 square feet. It is this Department's opinion that the intent of the 10,000 square foot area requirement was to insure that drive-.in businesses such as banks, cleaning estoblishments, liquor stores and restaurants would have sufficient space available to,provide adequate porking, loading, and circulation to insure the safety of adjoining property, pedestrians, and automobiles. The applicants proposal indicotes o floor area of approximately 51 square feet, This Deportment believes that the subject site is totolly insufficient to enable adequate circulation, loading, and porking to exist on the proposed site, . The applicant's proposed development is substondard in terms of porking stoll requirements, roof sign, landsc.cping, and traffic circulation, The applicant's proposed plot plan foils to indicate the location of the lot site as well as the location of parking spoces in its vicinity. The proposed plot plan also provides conflicting informotian as to the lot size, giving dimensions of 20 feet by 30 feet, os oppased to that given on the application (9 feet by 17,5 feet), The applicant~s proposed plot plan indicates zero (0) parking spaces in lieu of the three'required by Code. C.U,P.-71-5 -2- 11 May 1971 be indicated on the plot plan, The ingress and egress traffic from the two driveways fronting Duarte Road daes nat permit a traffic circulation Which insures the safety and welfare of the public, RECOMMENDA TION Inasmuch os the applicant1s proposed development is substandard in terms of parking spaces, raaf sign, landscaping and that the traffic circufotion would nat insure the safety and welfare,of the public, the Planning Department recommends that this application be denied. However, if the Planning Commission wishes to approve this application, the following recommendations should be mode conditions of approval: 1. Conditions as outl ined ,in the attached report from the Department of Publ ic Works shall be complied with to the satisfaction of the Directar of Publ ic Works. 2. The appl icant sholl indicate that parking on the odjacent shopping center site shall be available for his proposed development. 3. The appliccn t sholl prepare and submit a revised parking and landscaping plan to the Planning Department for its approval which would be in sub- stantial compliance with existing regulatians. 4. The building to house said business sholl be constructed substantially in accordance with the'plans which are on file with the Planning Department. 5. All signs shall comply-with existing regulations. 6. Service windows or counters shall not be allowed on the south face of thestruc ture. 7, That there be an unobstructed 20 foot wide aisle between the applicant's proposed building and the shopping center sign as shawn on the Plot Plan. 8.
