RESOLUTION NO. 733
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR A RESTAURANT AT 855 SOUTH 7/-4
BALDWIN AVENUE. '
WHEREAS, there was filed with this Commission on
15 April 1971 the application of Frank Schneider and Associates,
developers representing the Sizzler Family Steak House, for a
conditional use permit for a restaurant on real property known as
955 South Baldwin Avenue, Arcadia, more particularly described as
follows:
.
Parcell: The southerly 100.00 feet of Lots 22 a~d 23
"said distance being measured along the westerly line
of said Lot 22" of Tract 2731, in the City of
Arcadia, in; the County of Los Angeles, State of
California, as per map recorded in Book 33, page 29,
of Maps, in the Office of the County Recorder of
said County, together with that portion of the
Rancho Santa Anita, in said City, County and State,
as per map recorded in Book 1, page 97, of Patents,
in said Office of the County Recorder, included
within that part of the northerly 20.00 feet of the
40. 00 foot , strip marked "Right of way of the Southern
Pacific Railroad" on said map of Tract 2731, which is
bounded on the west by the southerly prolongation
of the westerly line of said Lot 22, and bounded on
the east by the center line of Baldwin Avenue,
60 feet wide, as said avenue is shown on said map
of Tract 2731.

... WHEREAS, a public hearing was held on said matter on
11 May 1971 at which time all interested persons were given full
opportunity to be heard and to present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The applicant proposes to construct a restau-
rant containing 4,200 square feet on a site totaling approximately
40,300 square feet. The subject property is the site of the

former Kent Chevrolet used car agency; the sales office still
remains. North of the perimeter of the site are located C-O
and D, R-3 and C-2 classifications; south of the site are R-3,
PR-3, and C-2 classifications; R-3 is located to the west; and
westerly, across Baldwin Avenue, is C-2 zoning, Mixed uses are
located in these zones, including residential, service stations,
commercial uses and a nursery school. The site is zoned C-2
and R-3. An application has been made to request the westerly
half of the site be rezoned from R-3 to PR-3 for the purpose of
providing parking for the restaurant, Planning Department Case
No. Z-71-4.

SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized,
3. The site for the proposed use is adequate in size and
shape to accommodate said use, and all yards, parking, loading,
landscaping, and other features required to adjust said use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
. and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for restaurant purposes
subject to compliance with all applicable regulations of the Arcadia
Municipal Code and upon the following conditions:
1. This permit shall become operative only if a portion
of the property is rezoned in accordance with the application on
file in said case Z-7l-4.
2. All existing structures shall be removed, The
property shall be improved in accordance with plans which are on file,
Planning Department Cas,e No. C oU oP 0 -71-4.
3, Irrigation and landscaping shall be installed in
accordance with plans which have been submitted and approved by
the Planning Department.

4. All required walls shall be ornamental in nature,
5. All lighting and signs shall comply with the Arcadia
Municipal Code.
6. All utilities shall be installed underground,
7, Grading and draining shall be in accordance with plans
submitted to and approved by the Department of Public Works; the
plans shall show all finished surface elevations.
8. Existing driveways shall be closed in conformance
With City standards.
9. Full parkway sidewalks shall be installed on Baldwin
Avenue with tree wells, and trees planted shall be in accordance
. with the requirements of the Department of Public Works.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

The Planning Commission of the City of Arcodia, Californio, will hold a public hearing
on 11 Moy 1971, at 7:30 o'clock p.m., in the Council Chambers of the Arcadio City Hall,
located at 240 West Huntington Drive, Arcadia, California,
The purpose of the publ'ic hearing will be to afford the public on opportunity to be

These applications, filed on 15 April 1971 in the nome of Frank Schneider and
Associates, developers representative for Sizzler Fanily Steak House, at 855 South
Baldwin Avenue, proposes that 0 portion of this property be reclassified from Zone
R-3 to Zone PR-3 and requests a conditional use permit for the purpose of constructing
an eoting estoblishment.
PRESENT LAND USE AND ZONING
([) The subject site is located at 855 South Baldwin Avenue and is zoned C-2 and
R-3 and is the site of the former Kent Chevrolet used ca~ncy. Although pri-/
marily vacant, the sales office' still remains on the site.l ~oning to the north of the
sit!! is R-3, C-O & D, and C-2 where are" located a service station, a nursery
school, and non-conforming buildings used for commercial and residential uses.
To the west are properties zoned R-3 which ore' either vacant or utilized for apart-
ment developments. To the south in Zones R-3, PR-3, and (-2 are located a tire
store, 0 service station and non-conforming residential uses. Westerly, across
Baldwin Avenue, in Zone C-2, are miscellaneous commercial use~ ~e attoched

Tract 2731, which is bounded on the west by the Southerly
prolongation of the westerly line of said Lot 22, and bounded
on the east by the southerly prolongation of the-easterly line
of said Lot 22.
The applicant is requesting that the westerly half of h is site (which is primarily
a landlocked parcel with on area totaling approximately 18,900 square feet) be re-
zoned from R:"3 to PR-3 so that he would be able to provide parking for the eating
establishment which is proposed in Conditional Use Permit Application No. C, U. P.-
71-4.
Inasmuch os the area requested -for rezoning (with the exception of the southerly
twenty-foot strip) is landlocked and could not be developed separately and inasmuch
as the appl icant is providing adequate walls and landscape buffers through his
conditianol use permit application, -Staff does not believe this zone change would
be detrimental to the surrounding properties.
