RESOLUTION NO. 727
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR A HEALTH CLUB AT 902 SOUTH
BALDWIN AVENUE.

WHEREAS, on 1 March 1971 Arcadia Health Spa, Inc., by
Ray Maurich; filed an application for a conditional use permit for
a health club at 902 South Baldwin Avenue, said application being
filed concurrently with an application to amend the Zoning Ordinance
to permit health clubs in a C-l zone on a conditional use permit
basis; and
WHEREAS, a public hearing was duly held on said matter
before the Planning Commission on 23 March 1971 at which time all
. interested persons were given fUll opportunity to be heard and to
present evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The subject site is zoned C-2 and is surrounded

on all sides by other C-2 property. The existing building-on the
site is presently vacant; the building was formerly used as a part
of a Chevrolet new car agency. The applicant proposes to remodel
the existing building and make .an addition thereto which will provide
a building with 4400 square feet. The remodeled building will have
a gym, swimming pool, and other supplementary facilities.
SECTION 2. This Commission finds that:

1. The granting of a conditional use permit as hereinafter
provided will not be detrimental to the public health or welfare or
injurious to the property or improvements in such zone or vicinity.

2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized when
Condition (1) of Section 3 hereof has occurred.
3. The site for the proposed use is adequate in size and
shape to acconunodate said use, and all yards, parking, loading, land-
scaping, and other features required to adjust said use with, the
land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for a health club upon the
following conditions:
1. An ordinance shall be adopted permitting health spas
at the subject location. This permit shall become effective only
when such an ordinance has been adopted.
2. The property shall be developed substantially in
compliance with the plans on file in the subject case, C.U.P.-71-2.
3. Automobile parking shall. comply with the prov:lsions
of the Arcadia Municipal Code.
4. The island and canopy in the existing driveway entrance
and shown on said plans shall be removed.
5. Landscaping and irrigation therefor, shall be installed
in accord'ance with plans which have been submitted to and approved
by the Planning Department.

6. Thirty-se~en dollars ($37.00) shall be paid to the
City to co~er the cost of planting two new trees in the existing
tree wells on Baldwin Avenue.
7. Any use o~ the subject property for any purpose o~her
than a legitimate health club shal~ cause this permit to automatically
be revoked.
8. The context of any signs on the property advertising
the health club shall be subject to approval by the Planning
Department.

SECTION 4. The Secretary shall certify to the adoption o~
this resolution and shall cause a copy to be forwarded to the City
Council of the City of Arcadia.

APPLICATION
This application filed on 8 March 1971 by Ray Maurich proposes to remodel
the existing building at 902 S. Baldwin Avenue into a health club (Arcadia
Health Spa, Inc.). The applicant concurrently is appl~ for a Text
Amendment (T.A.-71-2) that would allow the proposed use in Zone C-1 or
any less restrictive zone.
PRESENT LAND USE AND ZONING

The subject site is zoned C-2 and the proposed use is properly one for
which a conditional use permit would be authorized upon approval of
T.A.-71-2. 1he existing building on the site is presently vacant being
a part of a former auto agency.

The zoning of the neighboring properties along Baldwin Avenue is all
C-2 and may be seen on the attached zoning and land use map. The
existing land use is as follows: The property immediately to the: north
of the subject site is vacant but was formerly a new car agency. Further
north are restaurants, a liquor store and numerous llmall neighborhood
commercial businesses. Propery westerly across Baldwin Avenue is developed
with service stations, vacant car: lot, beauty ,salon, duplexes, garage, tire
store, etc. Southerly property is developed with a real estate and insurance
agency adjacent to the subject site. The property to the east is zoned C-2
and consists of a vacant parking lot.
PROPOSED DEVELOPMENT

The applicant proposes to use the existing 3300 square foot building which,
with remodeling, will have a gross floor area of 4400 square feet (an
additional 1100 square feet of gross floor area). The remodeled building
will include a !!}'m, swimming pool, whirlpool and wet- and dry sauna baths
(see attached building plan). This health club requires 22 parking spaces
which have been delineated on the plan. There are additional adjoining
parking spaces to the north and east but they are not included in the
subject's lease. The proposed plot plan fails to provide for minimwn
Code requirements as far as planter width, raised curbs and permanent
irrigation system. The canopy, as shown on the elevation plan provides
for a vertical clearance of 12 feet while 14 feet is neceseary to allow
the ingress/egress of emergency vehicles.

REcOMMENDATION
The plAnning Department recOlllIllends that this application be approved subject
to the following conditions:
1. Approval of Text Amendment T .A.-71-2.
2. All development shall be in substantial compliance with the
plans on file in the PlAnni"g Department office.
3. All conditions ot' the attached report from the Department of
Public Works shall be complied with to the satisfaction of
the Director of Public !forks.
4. All parking shall comply with Code.
5. That the island and canopy, as shown on the proposed plot plan,
shall be removed.
6. The applicant shall submit revised landscaping and irrigation
plans to the Planning Department for approval
