RESOLUTION NO. 725
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA DENYING A CONDITIONAL
USE PERMIT FOR AN EATING ESTABLISHMENT AT
311 EAST LIVE OAK AVENUE.

WHEREAS. on 12 January 1971 Lester Armstrong and Wolf
Tewes filed an application for a conditional use permit. Planning
Department File No. C.U.P.-7l-l. for the use of property at 311 East
Live Oak Avenue for an eating establishment. Said property being
more particularly described as follows:
Lots 53 and 54 of Tract B2l7 in the City' of
Arcadia, County of Los Angeles. Book 246.
Pages 26 and 27 of Maps in the office of the
County Recorder.

WHEREAS. a public hearing was held on said matter before the

Planning Commission on 26 January 1971 and was continued from time
to time to 9 March 1971. at which times all interested persons were
given full opportunity to be heard and to present evidence.
NOW. THEREFORE. THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY RESOLVES AS FOLLOWS:
SECTION 1. The subject site. whi~h has been bisected by
an alley. is a parcel containing approximately 10.500 square feet
with the existing building and patio are~having a total area of
approximately 2300 square feet. The subject site is an existing
vacant building located on the north side o~Live Oak Avenue between
Third and Fourth Avenues and is zoned C-2. D and PR-3 and D. Parking
. and residential uses are located directly no~th of the site in zones
PR-3 and R-2. Immediately adjacent to the west in zone C-2 and D
is a vacant lot. To the east in Zone C-2 and D is a building

which is presently vacant. Across Live Oak Avenue' to the south in
Zone C-M and Dare mixed uses. The eating e~tablishment provides
an ar.ea for eating on the premises as well as facilities for take.-
out food. ~~e proposed development is substandard in that i~ provides
neit~er adequate parking-lot landscaping, nor a sufficient ~ount of
parking stalls.
SECTION 2. The Commission finds that the applicant has
failed to appear before the Planning Commission, and'has failed to
furnish additional information relative to the manner of the operation
of the proposed eating establishment, after a formal request by the
Commission to do so. The Commission finds that the existing improve-

mentand that there are an inadequate number of parking spaces on
the property for such a use.
SECTION 3. That for the foregoing reasons this Commission
denies a conditional use permit as requested by the applicant.
SECTION 4. The Secretary shall certify to the adoption of
this resolution and shall cause a copy to be fOrwarded to the City
Council of the City of. Arcadia.

APPLlCA TION
This application, filed on 12 January 1971, in the names of Lester Armstrong
and Wolf Tewes, is a proposal to open an eating establishment in an existing building,
PRESENT ZONING AND LAND USE
The subject site is an existing vacant building located on the north side of
live Oak Avenue between Third and Fourth Avenues and is zoned C-2 & D and PR-3 & D,
Parking and residential uses are located directly north of the site in zones PR-3 and R-'2.
I mmediately adjacent to the west in zone C-2 & D is a vacant lot. To the east in Zone
C-2 and D is a building which is presently vacant, Across live Oak Avenue to th.. south
in Zone C-M and D are mixed uses.
PLANNI NG AND ANALYSIS
The subject site, which has been bisected by an alley, is a parcel containing
approximately 10,500 square feet with the existing building and patio area having a total
area of approximately 2300 square feet. '
As submitted by the applicant, the eati,:,g establishment provides an area for eating on ,the
premises as well as facilities for take-out food.
The proposed development is substandard in that it provides neither ad ua
parking-lot I?ndsca . ing, nor a sufficient amount of . rkinS stalls. r a requires that

border of not less than five (5) feet. Code also requires that where a parking area abuts a
street, a solid ornamental wall three (3) feet in height'shall be erected.
As proposed, the applicants.have sixteen parking spaces, where Code requires
23 spaces. It is Staff's opinion that the parking could be rearranged in such a manner as to
provide additional parking so as to bring the lot insubstantial compliance with Code.
RECOMMENDA TI ON
Staff recommends approval of C. U; p, -71-1, subject to the following conditions:
1. Conditions, as outlined 'in the attached report from the Department of Public
Works shall be complied with to the satisfaction of the DirectOr of Publie Works,
2, A revised parking plan which will bring the parking 10,t in substantial
compliance with Code, shall be submitted to the Planning Department,

3. A revised landscaping and irrigation plan shall be submitted to the Staff,
4. A solid ornamental masonry wall three (3) feet in height shall be erected
where the parking area abuts Live Oak Avenue,
5. I mprovements shall be made in substantial accordance with plans on file
in the Planning Department,
