HomeMy WebLinkAbout0718 . . . . RESOLUTION NO. 718 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA RECOMMENDING A ZONE CHANGE AT 235 EAST FOOTHILL. BOULEVARD. WHEREAS, an application was filed on 29 September 1970 by New Dimensions Food Service as lessees of the property at 235 East Foothill Boulevard, requesting that a portion of said property hereafter described be reclassified from Zone PR-l, Automobile Parking Zone - Second One-Family Zone, to Zone C-2, General Commercial Zone; and WHEREAS, a public hearing was held on 10 November 1970 at which time all interested persons were given full opportunity to be . heard and to present evidence; and WHEREAS, the proposed zone change is necessary to allow a' proposed restaurant to be placed in approximate alignment with other commercial developments on adjacent property, and whereas, such an alignment would provide a better development as compared to develop- ment under the existing zoning which be constructed thirty-four (34) feet would require the restaurant to 'FoOi\.\\LL closer to Oolorado Boulevard; and WHEREAS, the proposed rezoning would not adversely affect adjacent property. . NOW, THEREFORE, BE IT RESOLVED. SECTION 1. That the Planning Commission recommends to the City Council that the following described property be reclassified from zone PR-l to zone C-2: -1- 718 - ~/ ". . . , . Beginning at southeast corner of Lot 4 Tract #12834, thence northerly along east property line of said Lot 135.00' to true point of beginning, thence westerly along southerly border of PR-l Zone 80.00' to westerly prop- erty line of said Lot 4, thence northerlJ 38.00' along said line, thence easterly 80.00' parallel to southerly border of said PR-l Zone to easterly property line of said Lot 4, thence southerly 38.00' along said line to point of beginning. SECTION 2. That good zoning practice justifies said change of zone. SEC.TION 3. The Secretary shall certify to the adoption of this resolution. . C.U.P.-70-14 RESTAURANT 235 EAST FOOTHILL BOULEVARD FROM: S.UBJECT: and APPLICATION These applications, filed on 29 September 1970 in the name of New Dimensions Food Service, tenant, at 235 East Foothill BouleMard, proposes that a portion of this property be reclassified from Zone PR-l to C-2 and requests a conditional use permit for the purpose of constructing a restaurant. PRESENT LAND USE AND ZONING The subject site is zoned PR-l and C-2 and is presently vacant. To the north is located single family residences in Zone R-l. Across Foothill Boulevard to the South, are a restaurant and mixed office and residential uses in a C-2 zone. Ralph's market and assorted shops are located directly to the west in Zone C-2 & D. Directly to the west in zones PR-l and C-2 are mixed commercial uses. PROPOSAL AND ANALYSIS The following legal description describes the area proposed for a zone change: "Beginning at south east corner of Lot 4 Tract #12834, thence northerly along east property line of said lot 135.00' to the true point of beginning, thence westerly along southerly border of PR-l Zone 80.00' to westerly property line of said Lot 4, thence northerly 38.00' along said~line, thence easterly 80.00' parallel to southerly border of said PR-l zone to easterly property line of said Lot 4, thence southerly 38.00' along said line to point of beginning (see attached land use and zoning map)." )i~~~ ~ ~~~ \q ~~' . . 235 EAST FOOTHILL BOULEVARD page Two . The 38 fo~t by 80 foot strip approx~mately bisects the subject site in an east-west orientation. The purpose of the request for a zone change is to allow the restaurant to be placed in an approximate alignment with the existing shops on the west and Shakey's Pizza Parlor on the east. As the present zoning would compel the applicant to locate his building thirty-four feet in front of the proposed building site, it is Staf.f I s opinion that such a building placement would hot be in keeping with the area's characteristics. Staff believes that theproposed zone change would be consistent with the existing developments and would not be detrimental to the surrounding properties. The proposed restaurant has a total floor area of 3600 square feet and will be located on a site having a total area of approxi- mately 27,000 square feet. The following describes the remaining characteristics of the development as related. to code: . PARKING Required by Code: As stated, ten spaces are required per 1000 square feet gross floor, thus totaling 36 spaces. Proposed: 36 spaces. LANDSCAPING Required by Code: must be landscaped A minimum three percent of parking area and irrigated. Proposed: Applicant meets the minimum requirement of three percent. No irrigation system is indicated. Required by Code: A five-foot landscaped buffer strip be planted and maintaned where a parking area abuts a residen- tially zoned property. Proposed: No strip is indicated Required by Code: All planting areas or is~ands shall be surrounded by a continuous raised concrete curb. Proposed: None is indicated. LIGHTING Required by Code: They must be shielded with atandardsnot to exceed fifteen fee,t. Proposed: No method is indicated. WALLS Required by Code: A six-foot high solid ornamental wall must be constructed on north property line Proposed: Existing wooden fence. Required by Code: A three-foot high sOlid'masonry wall to be constructed between parking area and landscaped border abut- ting a street must be of ornamental material. Proposed: A three-foot high block wall of undesignated material is designated. . RECOMMENDATION Staff recommends approval of Zone Cllange Application No.Z-70-3 and Conditional Use Permit Application No. C.U.P.-70-14, subject to the following conditions: 1. Approval of Zone Change Application No. Z-70-3 should be granted prior to grmting approval of Conditional Use Permit Application No. C.U.P.-70-14. 2. Those conditions, as outlined in tile report from the Department of Public Works, shall be complied with to the satisfaction of the Director of Public Works. 3. A revised landscaping and irrigation plan shall be sub- mitted to the Planning Department for its approval. 4. All utilities shall be installed underground. . 5. The walls at the northerly and southerly property lines shall comply with code. 6. Make arrangements with the Edison Company to install a 20,000 lumen mercury vapor street light on a marbelitepole with underground circuit in front of the property. 3, Construct two tree wells in the existing sidewalk per City Standard S-ll and plant two 15 gallon parkway trees of a species approved by the Department of Public Works. . 4.
