RESOLUTION NO. 717 A RESOLUTION OF THE PLANNING COMMISSION OF 76-/$" THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A RIDING ACADEMY AND A SINGLE FAMILY RESIDENCE. . WHEREAS. there was filed with this Commission on 2 October 1970 the application of Keith Davidson. owner. to continue an existing riding academy operation and residence on property known as 11721 East Clark Street. Arcadia. more specifically described as follows: .,. Lots 110~ to 1144. 863 - 903. 632 - 660. 395 - 416 and Lot "E" in the Chicago Park Tract in the City of Arcadia. County of Los Angeles. State of California. as per Book 30. Page 100 of Miscellaneous Records in the office of the County Recorder of said County. WHEREAS. a public hearing was duly held on said matter before this Commission on 10 November 1970 at which time all interested persons were given fUll opportunity to be heard and to present evidence. NOW. THEREFORE. THE PLAN~NG COMMISSION OF THE CITY OF ARCADIA ,HEREBY DETERMINES AND RESOLVES AS FOLLOW'S: SECTION 1. The subject site is the location of a riding academy and a single family residence and is zoned M-l and D. To the south is located a combination of light industries. a garage. storage areas and parking areas. An abandoned gravel quarry and an abandoned dwelling are to the east. Vacant land is to the north. All of the above areas are zoned M-l and D. Myrtle Avenue (adjacent and east of the subject site) and Dearborn Street (which is oriented ._ in an east-west direction and intersects approximately the middle of the subject site) are unconstructed. non-vacated streets. In 1960. as a part of z-60-8 and Annexation No. 20. a riding academy -1- 717 I " . " .. . " , ' ... was permitted by a special use permit which was to expire after a ten-year period. Inasmuch as there was no provision made fora time extension in the original permit which is due to expire on 6 December 1970. the applicant is applying for a conditional use permit whiCh. if granted. would allow the continuation of existing uses. The subject site is approximately a ten-acre development comprising one residence. stables. corrals. and other facilities necessary to the operation of the riding academy. SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare,or injurious to the property or improvements in such zone . or vicini ty . 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in siz,e, and shape to accommodate said use. and all yards. parking. loading. landscaping. and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate :n width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. ." SECTION 3. That for the foregoing reasons. subject to approval of the City Council. this Commission grants a conditional use permit for a riding academy and one single family residence -2- 717 ;. , ,- . . , . . subject to compliance with all the applicable regulations: 1. Five (5) feet of said property along the entire frontage of Clark Street shall be irrevoc~bly dedicated for street purposes. 2. At the time improvements are made or placed in the . public streets in the Chicago Park Tract pursuant to a redevelopment plan of the City of Arcadia, the permit~ shall pay a prorated share of said cost, said share to be calculated on the same basis as computed for other property within said tract. 3. The perm1t~shall pay to the City for the water main .. "tZII. 70 installation in the sum of $4,~78.02, which sum is computed at the rate of $4.143 per front foot. 4. Water service facilities shall be installed by the permi~ at his expense and shall conform to the Uniform Plumbing Code. 5. The City of Arcadia and its authorized representatives shall have access to all parts of said property at reasonable times for the purpose of extractin& soil samples. 6. PROPOSAL AND ANALYSIS In 1960, as a part of Z-60-8and Annexation No. 20, a riding academy wa.s permitted by a special use peTmit which was to expire after ,a ten-year period. ~, inasmuch as there was no provision made for a time extension in the original permH hich is due to expire on 6 December 1970, the applicant is applying for a conditional se permit which, if granted, would allow the continuation of existing uses. I t is Staff's opinion that the landscaping should concur with M-I regulations which require that the required side yard setbacks of five (5) feet (ten (10) feet on corner) and the front yard setbacks of ten (10) feet be landscaped. In addition, City Council Resolution No. 3324, which was adopted in 1960 and established zoning regulations applicable to the subject site, states in port: "d. That the setback area of the pToperties abutting Peck Road shall be landscaped in a manner approved by the City Planning Commission and shall thereafteT be maintained in such condition." Staff does not believe that this area has been adequately maintained. It is recommended by Staff that the applicant be required to'submit landscaping plans to the Planning Department for its approval. . Prior ta entering into a redevelopment study of Chicago PaTk, the City of Arcadia is presently in the process of studying the feasibility of developing the area into an industrial area. In order to obtain a valid judgment as to the feasibility of having an industrial area in Chicago Park, it will be necessary to obtain core samples throughout Chicago Park, inc luding the subject site. Therefore, as a condition of approval of this application, Staff will require permission (in a form acceptable to the City Attorney) for access during reosonable hours to the subject site by the City of Arcadia and its representatives for the purpase of extracting these soil samples. FU,rthermore, inasmuch as it is anticipated that redevelopment activities should commence there in approximately two years, Staff recommends that the Conditional Use Permit should be granted for a two-year period and then successivly reviewed at six-month intervals until such time as final determination is made as to the future of Chicago Park. RECOMMENDA TION I nasmuch as Staff believes that the granting of such Conditional Use Permit wi II not be detrimental to the public health or welfare or injurious to the property OT improvements in the vicinity, Staff recommends approval of this application, subject to the following conditions: . I. Conditions as outlined in the attached report from the Department Publ ic Works shall be complied with to the satisfaction of the DiTector of Public Works. 11"2. October 7, 1970 TO: Planning Department FROM: Department of Public Works SUBJECT: CUP 70-15 In an unimproved area such as this the Public Works Department would normally require the dedication of street right-of-way, the construction of sewers, curb and gutter, sidewalk, street paving, the installation of street lights and parkway trees, all at the expense of the property owner or developer, concurrent with on-site improvements. Since no on-site improvements are proposed at this time, and since the City is considering a redevelopment project, it is recommended that the normal requirements be waived and the following be made conditions of approval of the CUP: /1. Dedicate 5 feet for Clark Street to provide the normal 60 feet street right-of-way. 2. The lots are 25 feet wide with the exception of lot 1098 which is 5 feet wide, The tota 1 front footage is H55 feet, The frontage costs for lots 1130 and H3l were paid in 1962 at the time of a water, service instaHation for an existing house leaving a front footage of 1105 feet, As a condition for approval for conditional use permit application CUP 70-15, the Water Department will require a payment of $4,143 per front foot, The total charge will be $4,578,02. At the same time the water service requirements will be made to conform to the Uniform Plumbing Code. April 16, 1971 TO: CITY MANAGER FRm4: CITY ATTORNEY SUBJECT: CONDITIONAL USE PE&~IT FOR A RIDING ACADEMY IN CHICAGO PARK Keith Davidson, the applicant for, the Conditional Use Permit, states that ,he is willing as a condition to the permit to agree \'lith the City that he will waive any claim to any increase in value to his real property, which will be covered by the Conditional Use Permit, which increase is due fully to the existence of the Conditional Use Permit, if granteq, or any improvements that are hereafter put ,on pursuant to the Conditional Use Permit.
