RESOLUTION NO. 714 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CO,N'DITIONAL USE PERMIT FOR A GARAGE AT 125 EAST SANTA 0 _/~ CLARA STREET . 7 WHEREAS, there was filed with this Commission on 18 August 1970 the application of Mr. Arthur F. Giffis, to operate facilities . for a garage and used car sales on property known as 125 East Santa Clara Street, Arcadia, more specifically described a's follows: Lots 5, 6, 7, 8, 9, and 10 of Block 79 of the Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California~ as per map recorded in Book No. 15, Pages ~9 and 90 Maps, in the office of the County Recorder of said county. WHEREAS, a public hearing was duly held on said matter before this ColllJllission on 8 September 1970 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE ,PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: . SECTION 1. The subject site is the location of the old City of Arcadia Department of Public Works Yards and is zoned M-l. Mixed commercial, industrial and residential property are nor~h, east, south and west of the site in M-l zone. The SUbject site contains approximately'8,145 square feet of building area on a rectangularly shaped parcel comprising approximately 48,000 square feet. This proposal is a request to operate a garage and to sell used cars. The applicant proposed to use the subject site for minor repair work on automobiles and trucks he purchases from institutional and public agencies, such as railroads, city and state motor pools. -1- 714 ./ . . . . SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property to operate facilities for a garage and used car sales, subject to compliance with all appli- cable regulations of the Arcadia Municipal Code and upon the folJowing conditions: 1. The performance standards as outlined in the M-l Zone, Arcadia Municipal Code, shall be complied with to the satisfaction . of the Building Superintendent. 2. All signs shall comply with existing sign regulations. 3. A parking plan shall be submitted to the Planning Department for its approval. -2- 714 r . . . . . 4. A minimum ten foot front yard shall be provided. 5. Landscaping and irriBationplans shall be submitted to the Planning Department for its approval. 6. A three foot high ornamental masonry wall with a three foot high chain link fence on top thereof shall be installed along the front of the site. A six foot high masonry wall shall be installed at the rear of the property at the location of and in lieu of the existing chain link fence. 7. A full parkway width concrete sidewalk and driveway apron shall be constructed. 8. All utilities shall be installed underground, including electric service. 9. Drainage shall be intercepted at the property line and conveyed to the street by pipes under the sidewalk. 10. One 7,000 lumen Mercury Vapor street light shall be installed on an underground circuit at a location to be designated by the Director of Public Works. 11. All work shall be performed to the satisfaction of the Director of Fu~lic Works. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. -2- , . . . C.U.P.-70-13 GARAGE AND USED CAR SALES 125 EAST SANTA CLARA STREET ZONE M-I APPLlCA TION This applications filed on 18 August 1970 in the name of Mr. Arthur F. Giffis, buyer in escrow, proposes to operate facilities fora garage and used car sales. PRESENT ZONING AND LAND USE The subject site is the location of the old City of Arcadia Department of Public Works Yards and is zoned M-1. Mixed commercial, industrial and residential property are north, east, south and west of the site in M-I zone (see attoched Land Use Zoning Map). PROPOSAL AND ANALYSIS This proposal is a request to operate a garage and to sell used cars. The applicant has stated that he intends to use the subject site for minor repair work (painting, tune-ups and tire mounting) on automobiles and trucks he purchases from institutional and public agencies, such as railroads, city and state motor pools. He would then distribute said vehicles to his automobile sales lots in , Monrovia and Lang Beach. He also indicated that the subject site will not be open to the public for sales or repair work; however, hedbes occasionally expect to wholesale some of his surplus inventory to other automobile dealers. The subject site contoins approximately 8,145 square feet af building area on a rectangularly shaped parcel comprising approximately 48,000 square feet. It is alsa the applicant's intention to lease to Consolidated Pool Mart of Arcadia an area of approximately 9,715 square feet at the northweit corner of the Of.<" . F :;(1/ , ' '. . . . Conditional Use Permit No. C.U.P.-70-13 8 September 1970 Page Two subject site, which contains a building area of approximately 3,110 square feet. The proposed development does not comply with the Arcadia Municipal Code in that it does not allow for the required minimum front'yard of ten (IO)feet, nor does it provide the required seventeen (17) delineated parking stalls and wheel stops. In addition, truck beds are being stored precariously against a seven (7)- foot high chain link fence located along the alley at the northeost corner of the subject site, which is a potential hazard to the safety of the public. And whereas Section 9266.2.7. of Code states," OUTSIDE 'l:JSAGE. Property out- side a building may be used for parking, loading, and stdrage areas provided that all such storage activities conducted thereon are-screened' from view from adjoining properties and public rights-of-way," it is'Staff's opinion that a si" (6)-foot high block wall should be installed adjacent to the northerly property line in lie,u of the existing chain link fence. Furthermore, it is Staff's apinion theseven(7)-foot.high"chain link fence fronting Santa Clara Road should be removed, and replaced"wITh a six (6)-foot high block wall. Said replacement wall should be a minimum of ten~IO}"feet from the southerly property line, and the area between the southerly property.lil'/eel:l1'ld the subject wall should be landscaped and irrigated. This would provide the,screening and front yard re- quirement necessary to camply with Code. . NOTl CE OF PUBLIC HEARING BEFORE THE ARCADIA CITY PLANNI NG COMMISSION C.U.P.-70-13 The Planning Commission of the City of Arcadia, California will hold a public hearing on 8 September 1970 at7: 45 p.m. in the Council Chamber of the Arcadia City Hall, located at 240 West Huntington Drive, Arcadia, California The purpase of the public hearing will be to afford the public an opportunity to be heard concerning the propased use of property commonly known as 125 East Santa Clara Street, as a garage and used car sales. The legal description of the subject property is as follows: Lots 5, 6, 7, 8, 9, and 10 of Block 79 of the Santa Anita Tract, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book No. 15, Pages 89 and 90 Maps, in the office of the County Re- corder of said county.
