RESOLUTION NO. 712
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARCADIA RECOMMENDING THAT PROPERTY
AT THE NORTHEAST CORNER OF HUNTINGTON DRIVE
AND BALDWIN AVENUE BE REZONED TO C-2, H, AND
D, UPON SPECIFIED CONDITIONS.
WHEREAS, public hearings were held before the Planning
Commission on the 2nd day of July, 1970, the 28th day of July, 1970,
and the 11th day of August, 1970, to consider the application of
Santa Anita Consolidated, Inc" Planning Department Case No. Z-70-l,
requesting that certain real property at the northeast corner of
Huntington Drive and Baldwin Avenue, hereinafter more particularly
described, be rezoned to C-2, H, and D for the purpose of developing
a regional shopping center and office complex, at which times all

interested persons were given a full opportunity to be heard and to
present evidence; and
WHEREAS. the Planning Commission hereby finds that a
regional shopping center designed and planned in accordance with the
conditions hereafter set forth and located on said property can be
harmoniously adjusted to the surrounding uses and the community and
that the public necessity, convenience, general welfare, and good
zoning practice justify the use of said property for a regional
shopping center,
NOW, THEREFORE, BE IT RESOLVED THAT the Planning Commission
recommends to the City Council that the real property at the northeast
corner of Huntington Drive and Baldwin Avenue, as shown on the Design
Overlay Site Plan on file in said Case No. Z-70-l and consisting of
. approximately 70 aores, be rezoned to C-2, H, and D zones on condition
that said property be developed and used only as a regional shopping

center in substantial accordance with the plans submitted by the
applicant and on condition that D zone regulations be adopted
containing the conditions expressed herein and the conditions of
approval recommended in the Planning Department report dated
2 July 1970 on file in said case No, Z-70-l as supplemented by
a report of the Director of Public Works, dated July 24, 1970,
relating to traffic on Hugo Reid Drive and the existing entrance
at the northeast corner of Baldwin Avenue and Huntington Drive;
provided that the IIH" zoning shall encompass only that portion of
the property within Building Setback Line as shown on the Design
Overlay Site Plan on file in said case Z-70-l; and provided that
the following exceptions and stipulations shall supersede any pro-
visions of said Planning Department report or said Site Plan:
1. Any uses which are subject to the Conditional Uses
provisions of the Zoning Ordinance shall be permitted only upon
the granting of a conditional use permit,
2. No office buildings shall be constructed.
3. No building or structure shall exceed the height
limits established by the Zoning Ordinance of the City of Arcadia.
4. No building permits for any construction on said
property shall be issued unless the owner of said property has
complied with all conditions hereof or has furnished guarantees
satisfactory to the City, including surety bonds if required,
that all conditions hereof will be fulfilled.
5. The following uses shall not be permitted because
the public necessity, convenience and welfare do not justify such
uses and they are not compatible with the plans and propos~s of
the applicant;

6. Condition number one (1) of the June 24, 1970
report of the Director of Public Works is deleted. An irrevocable
offer to ded~cate sufficient property along the east side of
Baldwin Avenue in order to provide adequate improvement of
Baldwin Avenue shall be made. The total expense of the improve-
ment of Baldwin Avenue including median landscaping and
irrigation shall be at the expense of the developer. This
condition is not only for traffic safety and flow, but for the
protection of the amenities of the residential property on the
west side of Baldwin Avenue.
7. All plans for improvement and alteration of
adjacent streets in connection with these conditions shall be
submitted to the Commission for recommendation and approval by
the City Council.
8. The operators of the center shall provide adequate
Security personnel for protection and control of persons and
property on the site.
9. Construction shall commence within two (2) years
and thereafter shall be diligently prosecuted to completionj
failure to do so shall result in automatic reversion to the

present zoning.
10. No certificate of occupancy for any part of the
development shall be issued until the entire project is
completed unless approval is given by the Planning Commission
upon a showing that the project will be completed within a
reasonable time after a certificate of occupancy is issued for
a particular use.
11. Adequate areas within the site shall be provided
for protected loading and unloading of passengers on public

transportation vehicles.
The above proposed changes will promote, preserve, and
protect the public health, safety, and general welfare and will
be consistent with good zoning practice.
The Secretary shall certify to the adoption of this
resolution and shall cause a copy to be forwarded to the City
Council of the City of Arcadia.
I HEREBY CERTIFY that the foregoing resolution was
adopted at a regular meeting of the Planning Commission held on
the day of 8 September, 1970, by the following vote:
