RESOLUTION NO. 707
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A
CONDITIONAL USE PERMIT FOR A RESTAURANT
AT 516 EAST LIVE OAK AVENUE. 70 -'7
WHEREAS, there was filed with this Commission on 18 June
1970 the application of Mr. Yet F. Wong to reopen and operate an
existing restaurant, known as the Arcadian Bar-B-Q, ,on property
located at 516 East Live Oak Avenue, Arcadia, more specifically
described as follows:

A portion of Lot 2 in Tract No. 15233 in the City
of Arcadia, County of Los Angeles, State of California,
as per map recorded in Book 332, Page 29 of Maps,
in the office of the County Recorder of said County.
WHEREAS, a public hearing was duly held on said matter
before this Commission on 14 July 1970 at which time all interested
persons were given full opportunity to be heard and to present
evidence.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The subject site is an existing one-story
vacant restaurant located on the southwest corner of Live Oak Avenue
and Hempstead Avenue and is zoned C-2. A Texaco service station and
a church are north in zones C-2 and R-2. Mixed commercial buildings
are east and west in zone C-2. Single family residential homes are
south and located in the County of Los Angeles. The subject site
is an irregularly shaped parcel containing approximately 9,835
~ feet, with the existing building having a gross floor area of approx-
imately 2,130 square feet. The applicant proposes to remove an
existing garden wall at the front of the building and reopen a
restaurant.

SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injurious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size and
shape to accommodate said use, and all yards, parking, loading, land-
scaping, and other features required to adjust said use with the
land and uses in the neighborhood.
4. The site abuts streets and highways adequate in width
. and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property to reopen and operate an
existing restaurant, subject to compliance with all applicable
regulations of the Arcadia Municipal Code and upon the following
conditions:
1. The dimensions of the drive-way facing Hempstead
Avenue shall be modified, as required by the Director of Public

Works.
2. Mechanical equipment, including but not limited to
heating and air conditioning devices, shall be screened from public
view, and said screening material shall be approved by the Planning
Department.

3. The existing free-standing sign shall be removed from
the public right-of-way and all signs shall comply with the existing
sign regulations.
4. The applicant shall submit complete landscaping and
irrigation plans to the Planning Department for its approval.
5. The existing building shall be refurbished and main-
tained in good condition.
6. The required parking shall substantially comply with
the Arcadia Municipal Code.
7. A five foot wide concrete sidewalk shall be constructed

next to the curb on Hempstead and the remaining parkway area shall
be landscaped.
8. All utilities shall be installed underground including
the existing overhead electric service.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

APPLICATION
This application, filed on 18 June 1970 in the name of Yet F. ,Wong,
owner of the property at 516 East Live Oak Avenue, commonly known
as the Arcadian Bar-B-Q, proposes to reopen and operate an existing
restaurant.
PRESENT ZONING AND LAND USE
The subject site is an existing one-story vacant restaurant located
on the southwest corner of Live Oak Avenue and Hempstead Avenue and
is zoned C-2. A Texaco service station and a church are north in
zones C-2 and R-2. Mixed commercial buildings are east and west in
zone C-2. Single family residential homes are south and located in
the County of Los Angeles (see attached Land Use and Zoning ~lap).
PROPOSAL AND ANALYSIS
The subject site is an irregularly shaped parcel containing
approximately 9,835 feet, with the existing building having a gross
floor area of approximately 2,130 square feet. The applicant proposes
to remove an existing garden wall at the front of the building and
reopen a restaurant.
The proposed development is substandard in that it does not provide
the required screening of the mechanical equipment on the roof. In
addition, the proposed five (5) foot landscape border and three (3)
foot wall facing Hempstead Avenue both project into the ingress
driveway, resulting in a vehicular hazard which could jeopardize the
safety and welfare of the public.' Staff recommends that this
driveway opening be modified in a manner meeting with the approval
of the Director of Public Works.
Inasmuch as the Ordinance states that a free-standing sign may extend
a maximum distance of one (1) foot into a public way, and inasmuch as
the free-standing sign is located in the public right-of~way, Staff
recommends that this sign be removed. Also, the proposed wall sign
facing Live'Oak Avenue contains a total" area of approximately 238
square feet, .whereas, a maximum area of 94 square feet would be permitted
by code.
Finally, although this proposal indicates nineteen (19) parking
spaces in lieu of the twenty-two (22) required, it is the opinion ,-J-.
of the Planning Department that the Planning Commission could grant ~"', r 1
relief from the additional three (3) required parking spaces. 10

RECOMMENDATION
The Planning Department recommends approval of this application
subject to the following conditions:

The Planning Commission of the City of Arcadia, California will hold 0 public
hearing on Tuesday, 14 July 1970 at 7:45 p.m. in 'the Council Chamber of the Arcadia City
Hall located at 240 West Huntington Drive" Arcadia, California.
The purpose of the Public Hearing will be to afford the public an opportunity to
be heard concerning the use of property, commonly known as 516 East live Oak, to re-open
a restaurant.
The legal description of the subject sit e is as follows:
A portion of Lot 2 in Tract No. 15233 in the City of Arcadia,
County of Los Angeles, State of Cal ifornia, as per map recorded
in Book 332, Page 29 of Maps, in the office of the County
Recorder of said County.
The applicant requests a conditional use permit.

The proposed plan may I:e seen in the Planning Department, 240 West Huntington
Drive, Arcadia, California, Monday through Friday between the hours of 8:00 a.m. and
5:00 p.m.
