HomeMy WebLinkAbout0706 (2) '.... / .. . ~ RESOLUTION NO. 706 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A HIGH SCHOOL AT 501 NORTH SANTA ANITA AVENUE. 7~-P WHEREAS, there was filed with this Commission on 18 June 1970 the application of Mr. Paul Disselken to open a four year Christian High School, Maranatha High School, on property known as 501 North Santa Anita Avenue, Arcadia, more specifically described as follows: . Lot 26 of Tract No. 17329 and that portion of Lot 15 of Tract 17329, in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in Book 446, Pages 26 and 27 of Maps, in the office of the County Recorder of said County and those portions of Cornell Drive and Windsor Road, as shown on s,aid map, lying southerly of a line that is parallel with and distant 50 feet southerly, nieasured at right angles, from the southerly line ann easterly and westerly prolongation thereof, of Lot 14 of said Tract No. 17329 . WHEREAS, a public hearing was duly held on said matter before this Commission on 14 July 1970 at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The subject site is an existing two-story church located on the northwest corner of Santa Anita Avenue and Colorado Boulevard and is zoned R-3. Apartments are north, east, '. and west in zones R-3, M-l, and R-3 respectively. AutomoQile service stations are east and southeast ,in zone M-l, A dry cleaning establishment is south in zone M-l, and the Santa Fe Railroad right -1- 706 , / . . . of way is adjacent and west of the site. The area of the subject site is approximately 40,810 square feet, with the e>:isting building having a gross floor area of approximately 15,360 square feet. The applicant proposes to occupy an existing church facility and operate a four- year private Christian high school initially having a staff of ten (10) and a student body of one hundred and twenty-five (125). SECTION 2. This Commission finds that: 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is . properly one for which a condi,tional use permit is authorized. 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, land- scaping, and other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional . use permit for the use of said property to open a four year Christian high school, Maranatha High School, subject to compliance with all applicable regulations of the Arcadia Municipal Code and upon the following conditions: -2- 706 r , . . . . . 1. This conditional use permit shall expire one (1) year after it becomes effective. 2. Suffic,ient space shall be vacated by the City to the applicant to permit the construction of a three (3) foot high wall between parking area No.2 and Cornell Drive. In addition, the applicant shall make an irrevocable offer to rededicate the vacated land to the City and remove said walls if" and when the subject site is no longer occupied by the Maranatha High School. 3. All wall designs shall be subject to the approval of the Director of Public Works. 4. Maximum student enrollment shall not exceed one hundred and twenty-five (125) students. 5. No physical education activities shall be permitted on this site. 6. All conditions required by the Arcadia Fire Chief and State Fire Marshall shall be complied with to the satisfaction of these individuals. 7. The applicant shall prepare and submit a revised parking and landscaping plan to the Planning Department for its approval which would be in substantial compliance with existing regulations. 8. In the interest of safety the driveway on Colorado shall be clearly marked as an entrance only and all traffic .shall be required to exit via Windsor Road and Newman Avenue. 9. All unloading of passengers or students shall be done in the rear as no parking is allowed on Santa Anita or Colorado in . the vicinity of the intersection. 10. Due to the existence of power poles on the front and rear of subject site with existing overhead services from the rear, it is recommended that undergrounding not be required. -3- 706 " I,. "' . . C.U.P.-70-8 HJ:GH SCHOOL 501 NORTH SANTA ANITA AVENUE ZONER-3 APPLICATION This application, filed on 18 June 1970 in the name of Mr. Paul Disselken for the Maranatha High School is a request to open. a four year Christian High School. PRESENT ZON1NG AND LAND USE The subject site is an existing two-story church located on the northwest corner of Santa Anita Avenue and Colorado Boulevard and is zoned R-3. Apartments are north, east, and west in. zones R-3, M-l, and R-3 respectively. Automobile service stations are east ahd southeast in zone M-l. A dry cleaning establishment is south in zone M-l, and the Santa Fe Railroad right of way is adjacent and west of the site. (See attached Land Use and Zoning Map). PROPOSAL AND ANALYSIS (The applicant proposes to occupy and existing church facility and operate a four-year private Christian high school initially having a staff of ten (10) and a student body of one hundred and twenty- five (125).-" Also, the applicant foresees a maximum potential enrollment bf two hundred and fifty (250) students and staff of twenty. In addition, no physical education activities are proposed to be conducted on this site. \ The area of the subject site is approximately 40,810 square feet, with the existing building having a gross floor area of approxi- mately 15,360 square feet., This proposal indicates a total of fifty-seven (57) parking spaces; twenty-six (26) would be fronting on Windsor Road (parkin~ area No. 1), twenty-eight (28) are located south of Cornell Drive (parking area No.2), and three (3) spaces are located at the front of the building. parking area No. 1 is proposed to have seven tandem parking stalls. Code permits tandem parking when a parking attendant is provided. It is Staff's opinion that a parking attendant should be provided, or some other pr.ocedure should be adopted by the applicant to permit tandem-parked automobiles to be removed as freely as possible. Furthermore, the three (3) parking spaces at the front of the bui1ding should be eliminated; inasmuch as code does not permit parking in, side yards of schools; thus, leaving a total of fifty-four (54) possible parking spaces for an initial enrollment of one hundred and twenty-five (125) students and a staff of ten (ten). The existing ordinance does ; . . . . . Conditional Use Permit No. C.U.P.-70-8 14 July 1970 Page Two not specify the parking requirements for high schools; however, it is the Planning Department's opinion that approximately 80 per cent of the school's staff and approximately 60 per cent of its student body will require parking spaces, creating a minimum, need of approximately 83 parking spaces. In addition, the applicant proposes to construct a three (3) foot high solid masonry wall between Cornell Drive and parking area No.2. Code requires a five (,5) foot landscape border between the subject wall and Cornell Drive; however, this requirement would eliminate eleven (11) parking spaces. Thus, staff recommends the landscape requirement be waived by the Commission. An additional factor to be considered is the location of the wall, as proposed, would be ,in the public right-of-way, and if constructed would be a potential liability to the city; therefore, staff rec,ommends that sufficient space be vacated by the city to the applicant to pp.rm:it the construction of a wall. In view of the latter statement, Staff also recommends that, simUltaneously with the aforementioned vacation, the applicant make an, irrevocable offer to rededicate the vacated land to the City and remove said wall if, and when, the subject site is no longer occupied by the applicant. In past actions regarrting initial conditional use permit appli- cations for private schools, the Planning Commissi'on has specified the date of expiration of the permit. For example, the initial conditional use permit for the Montessori School (C.U.P.-65~3) expired five (5) years from the effective date of the permit. It is the Planning Department ',s opinion that a similar condition of approval should be imposed on this application. However, Staff recommends that thi~ Conditional Use Permit expire one (1) year after it becomes e,ffective. This would provide the applicant, staff, and the commission an opportunity to evaluate, as well as to correct, an ensuing d:',fficulties generated by said use at this location.
