CI RESOLUTION NO. 705 A RESOLUTION OF THE PLANNING COMMISSION OF THE.CITY OF ARCADIA DENYING A CONDITIONAL USE PERMIT FOR A SERVICE STATION AT 104 EAST COLORADO BOULEVARD. . . WHEREAS, there was filed with this Commission on 26 May 1970 the application of Otto and Elvera R. Weller to reopen an existing vacant service station on property known as 104 East Colorado Bou- levardj and WHEREAS, a public hearing was held on said matter before the Planning Commission on 9 June 1970 at which time allintere,sted persons were given full opportunity to be heard and to present evidence.. . NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The subject site is zoned M-l. Commercial buildings are north and south of the site in Zone M-lj multiple family residences are adjacent and east of the site in Zone M-lj and vacant property is west in Zone M-l. The applicants propose to reopen an existing nonconforming seTvice station. . SECTION 2. This Commission finds that remodeling the existing closed service station in accordance with the applicant's proposaf' would not meet the Cl ty I s fitandards for a viable and aesthetically pleasing facility.and for this reason the Commission denies a conditional use permit as requested by the. applicant. -1- 705 70 . b v' ~ . t . SECTION 3. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the City Council of the City of Arcadia. Weller, owners of tne property of 104 Colorado Boulevard proposes to reopen an existing vocant service station for Petrol Stops Ltd. PRESENT ZO.NING AND LAND USE The subject sit e is zoned M-l. Commerciol buildings ore north and south of the site in Zone M-l; multiple family residences ole odjocent ond east of the site in Zone M-l; ond vacant property is west in Zone M-l (See attoched Land Use & Zoning Map) , . ~ PROPOSAL AND ANALYSIS /l/..(JJlu.J~ r:- The opplicants propose to reopen an exisfing^~erlice sta146n.l1.he area of the subject site is opproximatelY-1,4,OOO square feet. The e.xisting building floor oreti is approximotely 1,125 squore reet) , The proposed development is substandord in that it does no~ovide the required landscoped areo on' t~westerly property line between the eXistin.g pump islond ar,d First Avenue, nor does it ~delineated porking stolls. It is the Planning Deportment's opinion thot the ten (10) feet between the westerly property line and the pump islond is not odequate to permit the req."ired construction of a five (5) foot planter and still provide safe traffic circulation; therefore, sf'off recommends that the Plannin,g Commission grant relief from this IOl1dscoping requirement, In addition, the applicants have requesbed that the,Plonning Commission grant relief from the following reCJuirements: (1) The elimination of the required plonter; at the intersection of Coiorodo Boulevord and First Avenue, and the 5 ft, x 38 ft. planter on the northerly property' line between the existing pump island and Coloraoo BouJevord; (2) the proposed forty (40) squore feet of raised plClnting locoted along' the northwest carner of the building facode be eliminated; (3) requ~st to ,ubstitute ospholt berm insteod of concrete curbing at the planters on the east and south property I.ine; ond half-inch pipe insteod of three-quorter inch water pipes be permitted (See attached letter of request). First Avenue 9 June 1970 Page Two . , , approvol Numbers 1 & 2, which require a 15 foot radius corner cut-offond a'n irrevocable offer to dedicate 10 feet for future widening of Colorodo Boulevord would eliminate opproximotely one-half of the planteral' the intersection of Colorado Boulevard and First Avenue and because these plonters interfere wit h the safe flow of customer traffic, relief should be gronted from these conditions, It is Staff's opinion that the proposed plonter at the corner of the lot could be increosed towards the interior of the lot without interfering with the troffic circulat ion of the subject site. Also, the Department of Public Works has stoted thot the J>roposedwidening of Colorado Boulevard will not take ploce until19740r 1'975; consequently, the Planning Department feels the plonter focing Colorodo Boulevard should be instolled as indicoted on the plot plan. RECOMMENDA TlON The Plonning Department recommends opprovol of this application subject to the following conditions: 1. Conditions os outlined in the attached report from the Department of Public Works shall be complied with to the satisfaction of the Director of Public Works. . 2, The applicont sho.1I prepare and submit to the Planning Deportment for its approval revised parking and landscaping plans which would be in substantial compliance with existing regulotions. 3. Trash area shall substantially comply with existing regulations, 4. AU outs.ide lighting sholl be so arranged ond' shielded os to prevent ony glare or reflection of ony kind on adjoining streets or property. 5. The oppliconts sholl provide solid decorative screening which shall screen the entronce ta 0 II restrooms, 6. All merchandise, wares, ond crates in the form of temporary and permonent storage or disploys shall be within the building. " 7. The Plannina Commission Arcadia, California Gentlemen: I herewith respectfully request a waiver for the follow- ing requirements of the conditional use permit for my service station at First and Colorado in Arcadia, California. The elimination of the planter islands at the corner of the lot and the 5'x35' foot island on the north side facing Colorado Blvd. The city (Arcadia) has requested a ten foot setback for future widening of Colorado Blvd. Also the installation of these two islands would interfere with the safe flow of cus- tomer traffic. The elimination of these two islands would also make it unnecessary to break up the black top to install, the water lines. The building and sidewalk were not designed for planter boxes at the windows. It would block off part of the sidewalks and ~lould create a walking problem.' So I am asking to please eliminate these planters. Since the s,tation is not ne\'1 I \'louldappreciate the per- mission to substitute' asphalt burro instead of concrete curbing at the nlanters on the east and south sides. Also the east and south pianters are not large. I feel half inch ,.ater lines would carry the load. In that way we could hook up to fhe build- in6 water lines. This would eliminate break~n8 up of the black top, except at the rear of the building. Half inch pipe in- stead of three quarter inch \'lould be appreciated. Intercept all drainage and convey to the street 'in such a manner as to prevent drainage over the walks and drive aprons. 4. Install all utilities underground. 5.
