A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF ARCADIA RECOMMENDING CERTAIN
CHANGES IN THE ZONING AND SUBDIVISION
ORDINANCES, RELATING TO PLANNED UNIT
DEVELOPMENTS.
.
WHEREAS, public hearings were held before the Planning
Commission on April 14 and April 28, 1970, to consider certain
amendments to the zoning and subdivision ordinances relating to
Planned Developments at which times all interested persons were
given full opportunity to be heard and to present evidence.
NOW, THEREFORE, BE 'IT RESOLVED that the Planning CommissiOR
makes the following recominendations to the City Council:
That a Planned Development concept be incorporated into
the City's subdivision and zoning ordinances. This would permit
residential development of a site of not less than three acres
without regard to the present minimum lot sizes and yard require-
ments. Density would remain the same as under existing ordinances.
For example, in the R-I zone a particular parcel could be developed
under existing ordinances or under the planned unit concept with
a one-family dwelling for each 7500 square feet, excluding streets.
However, in the planned unit development the minimum area of the
lots may be just enough to accommodate a one-family dwelling, i.e.,
2000 square feet, not 7500 square feet, as in the existing R-I
regula~~ns. The land which is not subdivided into lots is then
set aside for common use and is owned in common by the owners of
~ all the lots within the planned unit development. Existing front
yard requirements would apply to any part of the development
abutting existing streets.

9277. DECLARATION OF POLICY. The purpose of the regula-
tions set forth herein is to provide for the establishment and
control of residential Planned Developments. The intent is to
encourage well-planned developments by providing the means for
greater creativity and flexibility in environmental design than is
provided under the strict application of the zoning ordinances
while at the same time promoting and preserving the public interest,
. health, safety, welfare, and property values.
9277.1. CONDITIONAL USE PERMIT REQUIRED. A planned unit
development shall be subject to the regulations of this Title
and shall be established by means of a conditional use permit,
pursuant to Division 5 of this Part, Sections 9275.1, et seq., as
modified by these regulations.
9277.2. OPERATIVE DATE OF PERMIT. The conditional use
permit shall nO.t become operative until complete, final plans
for the construction and installation of all improvements required
by the permit have been approved by the Planning Commission, which
approval shall be given if the plans comply with the terms of the
permit.

9277.3. EXPIRATION OF PERMIT. The conditional use
permit shall expire, unless extended by the Planning Commission
before the expiration date, eighteen months after the effective
date, unless construction has begun and is carried on diligently
to completion.

9277.4. CONDITIONS. In addition to the conditions
established by these regulations, the Planning Commission may impose
conditions which it deems necessary or desirable in carrJing out
the general purpose and intent of this Title.
9277.5. SUBDIVISION. A tentative subdivision map and
a final map may be approved for a planned unit development which
does not comply with all of the subdivision regulations of this
code, Sections 9111.1, et seq., provide~ that a. condition of such
approval is that the subdivision shall be subject to all of the
terms of the conditional use permit for the planned unit development.
All of the subdivision regulations which are not inconsistent with
these regulations or any conditions of the conditional use permit
shall be complied with.
9277.6. PRELIMINARY PLANS. The preliminary plans
submitted with the application for a conditional use permit shall
show (a) That the development asa whole is well related to existing
and planned land use and circulation patterns on adjoining properties
and will not constitute a disrupting element, (b) The lOCation and
nature of all existing and proposed structures, facilities, utilities,
and landscaping and the proposed treatment of any such existing
features, (c) The height of all structures shall be stated; elevation
plans need not be included with the application.
9277.7. CONSENT OF OWNERS. An application for a condi-
tional use permit shall not be accepted unless the applicant
submits satisfactory proof that the owners of all of the land
proposed for a planned unit development have endorsed the applica-
tion with their consent to the filing of the application.

9277.8. CONSENT OF OWNERS - FINAL MAP. The .final sub-
division map shall not be approved and shall not be recorded unless
satisfactory evidence is presented that all of the land within
the proposed development is under a single ownership.
9277.9. USES. ZONES. Planned unit developments shall
be permitted only for one-family residential use in the R-O, R-l,
and R-2 zones.
9277.10. DENSITY. The density within a planned unit
development shall be the same as permitted in the zone in which
the land is located pursuant to the provisions of Article IX,
Chapter 1 of this code.
9277.11. MINIMUM AREA. The land to be developed shall
be not less than three acres in area.
9277.12. LOT AREA. The minimum lot area shall be no
less than the area occupied by the dwelling located thereon.
9277.13. COMMON AREAS. All land within the development
which is not subdivided into separate lots or dedicated for streets
or other public purposes shall be for the common use of the owners
of lots within the development, and each owner of a lot shall own
an inseparable, undivided interest in the common area.
9277.14. SITE COVERAGE. Buildings and'structures shall
occupy.no more than 45 per cent of the land within a development,
excluding streets and common drives.
9277.15. HEIGHT. No building or structure shall contain
more than two stories nor shall any building or structure in any
event exceed 35 feet in height.
9277.16. SETBACKS. No building shall be constructed
within 25 feet of the perimeter property line of the development,
provided that no building or structure shall be located closer to
a peripheral public street than the depth of the front yard that
ould otherwise be required.

9277.17. STREETS. Dedicated public streets shall comply
with the subdivision regulations which, except for these regulations,
would be applicable. Private streets and drives need not meet the
requirements of this code which would otherwise be applicable if
the Planning Commission finds after recommendation of the Fire Chief,
Chief of Police, and Director of Public Works, that the design of
the proposed streets and common vehicular ways are adequate to
protect the public health, safety, and welfare.
9277.18. PARKING. At least four park~ng spaces, each
designed for use with unobstructed access, shall be provided within
the development for each dwelling unit.
9277.19. LANDSCAPING. A suitable decorative masonry
wall shall be placed on the perimeter of the development except
. where the perimeter is an existing public street. A..minimum of
five feet adjacent to said wall shall be landscaped with plantings
and used for no other purpose. Landscaping and a permanent sprin-.
kler system shall be installed in all common areas in accordance
with plans prepared by a landscape architect.
9277.20. VARIANCE. A variance from the regulations of
this Title may be permitted provided the Planning Commission finds
at the time the conditional use permit is granted that such a
variance will not detrimentally affect the development or adjacent
properties.
9277.21. COMPLETION OF COMMON AREAS. The final develop-
ment plans shall not be approved unless they contain provisions

which the Commission finds will guarantee construction and comple-
tion of all work proposed under the plan within a reasonable time

9277.22. OWNERSHIP. MANAGEMENT. OPERATION. The final
plans shall contain provisions, whether in the form of recorded
covenants, conditions, and restrictions or other devices, which

... guarantee to the satisfaction of the Commission that the development
in its entirety, including privately owned and common areas, shall
be perpetually, or as long as legally possible, operated and main-'
tained in good order and condition and that such provisions may be
enforced by the City, and that the City may recover the cost of
any such enforcement. The finai subdivision map shall contain the
following certificate executed by the owner:
"We hereby dedicate to the City of Arcad-ia, the
right to prohibit the construction of additional
residential buildings thereon, except for
additional parking, recreational facilities,
and accessory buildings over the area designated
as the common area."
9277.23. PROHIBITIONS. After the final subdivision map
has been recorded, no work shall be done on any property within the
. development except in full compliance with the final development
plans.
9277.24. VIOLATION. The violation of any of the regula-
tions herein or of the provisions of the development plans or other
actions taken pursuant to the authority contained in this Title,
shall constitute a violation of this Title and shall be subject
to the same penalties as any other violation of this Code.
The Secretary shall certify to the adoption of this
resolution.

Section 4.(d) Wherever authority is granted to permit
the sale of a lot in a residential planned development contingent upon
the possession of an interest in common areas and facilities which
are appurtenant to said lot, the Certificate of Occupancy for buildings
on said lot shall be valid only while said interest is held by the
