HomeMy WebLinkAbout0696 " / ,. . . . RESOLUTION NO. 696 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA GRANTING A CONDITIONAL USE PERMIT FOR A CHURCH AT 601 EAST LIVE OAK. WHEREAS, on 1 December 1969 the Reverend Thomas S. Shaw on behalf of the Los Angeles Metropolitan Church of the Bible Covenant filed an application for a conditional use permit, Planning Department File No. C.U.p.-69-17, for the use of property at 601 East Live Oak Avenue for church purposes; and WHEREAS, a public hearing was held on said matter before the Planning Commission on 24 February 1970 at which time all interested persons were given full opportunity to be teard and to . present evidence. NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS: SECTION 1. The subject site is zoned R-2. Mixed commer- cial buildings are located east and south of the, site in Zone C-2, a service station is west of the site in C-2 zone, and multiple and single family residential dwellings are northwest and north of the subjec't site in zones R-l, R-2 and R-3. There are church facilities on the site which have not been used for in excess of 90 days. SECTION 2. This Commission finds that: . 1. The granting of a conditional use permit as herein- after provided will not be detrimental to the public health or wel- far~ or injurious to the property or improvements in such zone or vicinity. 2. The use applied for at the location indicated is properly one for which a conditional use permit is authorized. -1- 696 v " . . . 3. The site for the proposed use is adequate in size and shape to accommodate said use, and all yards, parking, loading, landscaping, anQ other features required to adjust said use with the land and uses in the neighborhood. 4. The site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. 5. The granting of such conditional use permit will not adversely affect the general plan. SECTION 3. That for the foregoing reasons, subject to approval of the City Council, this Commission grants a conditional use permit for the use of said property for church purposes upon . ' the following terms and condi tidns : 1. The applicant shall prepare and submit a revised landscaping and parking plan to the Planning Department which wotld be in substantial compliance with existing regulations. The applicant has an agreement for the use of 13 additional parking spaces on adjacent property. 2. In the event that either the congregation should exceed 96 persons or the existing parking covenant for the 13 parking spaces should be revoked, the applicant shall provide additional equivalent parking within 500 ft. of the subject site. SECTION 4. The Secretary shall certify to the adoption of this resolution and shall cause a copy to be forwarded to the . City Council of the City of Arcadia. -2- 696 . t . . . The applicant stoted that it appears his congregation will be at the subject sit e for an undetermined period of time; therefore, he requests that the Planning Commission approve his application for a conditional use permit. Shaw for the Los Angeles Metropolitan Church 9f the Bible Covenant proposes to re-open an existing church sanctuary and educational building. . PRESENT ZONING AND LAND USE The subject site is zoned R-2. Mixed commercial buildings are located east and south of the site in Zone C-2, a service station is west o'f the site in C-2 zone, and multiple and single family residential dwellings are northwest and north of the subject site in zones R-l, R-2 and R-3. (See attached Land Use & Zoning Map.) PROPOSAL AND ANALYSIS At the present time the existing building is a non-conforming use. It has not been used for a period exceeding 90 days, and a conditional use permit application has never been filed. Consequently, a conditionol use permit application is required to permit'the building to re-open as a church. The area of the site is approximately 10,700 sq. ft., the area of the existing buildings are approximately 768 sq. ft. (church) and 1620 sq. ft~educational building), creating an approximate building area of 2,388 sq. ft. There are twelve porking spoces indicated on the applicant's plot plan; however, parking stalls nos. 10 and 12 do not conform to existing ordinonce, which leaves the applicant ten parking spaces in lieu of his proposed twelve spaces. Also, there is a covenant Filed with the Planning Department which states that the church may use thirteen parking spaces which are adjacent and east of the subject site. This creates a total of twenty-three usable parking spaces far the applicant. (See attached letter from Mr. Robert Williams). . The existing available parking area is adequate to provide the required spaces for 0 congregation of approximately ninety-six persons. The applicant stated in his application thot the church hos an approximate membership of twenty-five persons. However, in the event that Mr. Williams should revoke his covenant for the thirteen parking spoces and/or the church congregation should exceed ninety-six persons, additional parking area within 500 ft. radius of the subject site should be provided. . . . . . Page Two In addition the Municipal Code requires a five ft. landscape border and a three ft. high solid ornamental masonry wall to be erected where parking areas front, side, or rear on a street. And where such parking areas side or rear directly on 0 residentiol zone a solid ornamentol masonry wall six ft. in height shall be installed on the zone boundary or property line. RECOMMENDA liON The Planning Deportment recommends approval of this application subject to the following conditions: 1. The appl icant shall prepare and submit a revised landscaping and parking plan to the Planning Department which would be in substantial compliance with existing regulations. 2.
