RESOLUTION NO. 693
A RESOLUTION OF THE CITY PLANNING COMMISSION
OF THE CITY OF ARCADIA GRANTING A CONDITIONAL
USE PERMIT FOR THE REMODELING OF A SERVICE
STATION AT 5 WEST LIVE OAK AVENUE.

WHEREAS, there was filed with this Commission on 21
January 1970 the application of Phillips Petroleum Company for the
remodeling of an automobile service station on property known as
5 West Live Oak Avenue, Arcadia, more specifically described as
follows:

That portion of Lot 69 of the Santa Anita Colony,
in the City of Arcadia, Courity of Los Angeles,
State of California, as per map recorded in Book
42, Page 87 of Miscellaneous Records, in the
office of the County Recorder of said county;
described as follows,:
Beginning at a point in the east line of said lot
that is distant along said east line north 00 59'
2511 west 107.17 feet from the northerly extremity
of the curve described in the decree in Case No.
274177 Superior Court of said county as concave
to the northwest and having a radius of 15.00
feet and a length of 21.21 feet; thence along said
east line south 00 :'9' 2511 east 107.17 feet to said
northerly terminus; thence southerly along said
curve 21.21 feet to its point of tangericy with a
line that is parallel with and distant northerly
25.00 feet, at right angies, from the southerly
line of said Lot 69; thence along said parallel
line south 800 05' 1511 west 59.94 feet to a point
in the northeasterly line of Las Tunas Drive at the
easterly extremity of the curve described ir said
decree as concave to the north and having .a radius
of 450.00 feet; thence westerly along said curve
77.53 feet; thence parallel with the east line of
said lot, north 00 59' 25" west 120.00 feet; thence
north 82b 49' 44" east 150.00 feet to the point of
beginning.
WHEREAS, a public hearing was duly held on said matter
before this Commission on 10 February 1970 at which time all
interested persons were given full opportunity to be heard and to
present evidence.

NOW, THEREFORE, THE CITY PLANNING COMMISSION OF THE CITY
OF ARCADIA HEREBY DETERMINES AND RESOLVES AS FOLLOWS:
SECTION 1. The subject proper.ty is zoned C-2. Mixed
commercial buildings are north, east, south, and west of the property
in C-2, C-l, and C-M zones. The area of the subject property is
approximately 18,000 square feet, and the existing building floor
area is approximately 1,275 square feet.
SECTION 2. This Commission finds that:
1. The granting of a conditional use permit as herein-
after provided will not be detrimental to the public health or
welfare or injUrious to the property or improvements in such zone
or vicinity.
2. The use applied for at the location ,indicated is
properly one for which a conditional use permit is authorized.
3. The site for the proposed use is adequate in size
and shape to accommodate said use, and all yards, parking, loading,
landscaping, and other featur.es required to adjust said. use with
the land and uses in the neighborhood.
4. The site abuts streets and highways adequate in wi.dth
and pavement type to carry the kind of traffic generated by the
proposed use.
5. The granting of such conditional use permit will not
adversely affect the general plan.
6. The proposed use will not substantially increase
vehicular traffic on any street in a residentially zoned district.
7. The proposed use will not lessen the suitability of
any nearby commercially zoned property for commercial use by inter-
fering with pedestrian traffic.
8. The proposed use is not locate~ near a place of
assembly.

SECTION 3. That for the foregoing reasons, subject to
approval of the City Council, this Commission grants a conditional
use permit for the use of said property for the remodeling of a
service station, subject to compliance with all applicable :regula-
tions of the Arcadia Municipal Code, particularly the provisions
of the zoning regulations relating to drive-in businesses and upon
the following conditions:
1. All drainage shall be intercepted and conveyed to
the gutter by a pipe under the sidewalk or into an existing storm
drain catch basin.
2. The applicant shall prepare and submit a revised
parking and landscaping plan to the Planning Department for its
approval which would be in substantial compliance with existing
regula.ti~ns .
3. The applicant shall provide solid decorative screening
which shall screen the entrance to all restrooms.
4. Trash areas shall sUbstantially comply with the
existing ordinance.
5. All merchandise, wares and crates, in.the form of
tempo:rary and permanent storage or display shall be within the
building.
6. All signs shall comply with existing sign regulations.
7. Concrete bumpers shall be installed in the parking
stalls.
8. All utilities shall be installed underground includ-
ing underground electric service.
SECTION 4. The Secretary shall certify to the adoption
of this resolution and shall cause a copy to be forwarded to the
City Council of the City of Arcadia.

APPLlCA TION
This application Filed on 21 January 1970 in the name,of James L. Cossulo for Phillips
Petroleum Company proposes to remodel the exist ing service station.
PRESENT ZONING AND LAND USE
The subject site is zoned C-2. Mixed commercial buildings are north, east, south and
west of the site in C-2, C-l, and C-M zones. (See attached Land Use & Zoning Map.)

PROPOSAL AND ANALYSIS
The appl icant proposes to remodel the existing servi ce station., The area of the subject
site is approximately 18,000 square feet. The existing building floor area is opproximately
1275 square Feet.

The proposed development is substandard in that it does not provide For the required
five (5) Foot block wall surrounding the trash area, nor does it have delineated parking
stolls. In oddition, ot the present time there are, some outdoor merchandise displays
including automotive accessories, and additives which by code are not permitted. Also,
the applicant stated in the general contractar notes thot six (6) new planters with six (6)
inch curb walls and a sprinkling system in the proposed and,existing planting areas will be
installed. And a solid masonry "modesty wall" to screen restroo,m dOo,rs will be constructed.
RECOMMENDA TION c
The Planning Department recommends approval of this appli~ati~~ su6j!,ct ta the following
conditions: .
1. Conditions as outlined in the attached report from the Department of
Public Works shall be complied with to the satisfaction ofthe Directar
of Public Works.
2. The applitant shall prepare ond submit a revised parking ond landscaping
plan to the Plonning Department for its approval which would be in
substantial compliance with existing regulations.

SUBJECT: C.U.P. 70-2 - Service Station, Santa Anita & Live Oak
Plans for subject improvement have been reviewed and the following should
be made conditions of approval:
1. The installation of grating type catch basins behind the driveway
aprons to intercept the drain"age and pipe it beneath the sidewalk
to existing sto"m drain catch basins in conformance with Article
9262 - 3 - 7 of the Arcadia Municipal Code.
2. Install concrete bumpers in the parking stalls.
3. Install all utilities underground including underground electric
service.
4. Curbs, gutters, driveway aprons, sidewalks and parkway improvements
conform to the City standards and are in good condition so no parkway
improvements are required.
5. Existing right-of-way is adequate and no dedications are required.
