REGULAR MEETING MINUTES
TUESDAY, JUNE 16, 2015
CALL TO ORDER — Mayor Kovacic called the regular meeting to order at 7:00 p.m.

ROLL CALL OF CITY COUNCIL MEMBERS
PRESENT: Council Member Beck, Tay, Wuo, Chandler, and Kovacic
REPORT FROM CITY ATTORNEY ON THE CLOSED SESSION ITEM
City Attorney Deitsch reported that the City Council conducted a Special Meeting, and that part
of that agenda was a Closed Session to consider the two items listed on the posted agenda,
under Closed Session; and that Item b was the threat of litigation pursuant to the Ralph M.
Brown Act, one (1) case; no reportable action was taken.
City Attorney Deitsch further announced that as part of the Special Meeting, a Study Session
was conducted, and on unanimous vote, 5-0 the City Council authorized the City Manager to
submit the Enhanced Watershed Management Program Plan on behalf of the Rio Hondo San
Gabriel River Water Quality Group consisting of the cities of Arcadia, Azusa, Bradbury,
Monrovia, Sierra Madre, the County of Los Angeles, and the Los Angeles County Flood Control
District, to the California Regional Water Quality Control Board, Los Angeles Region, in
accordance with the National Pollutant Discharge Elimination System (NPDES) Municipal
Separate Stormwater (MS4) Permit; and explained that this is a Plan to mitigate or eliminate the
discharge of water pollutants in the watershed within this area region.
In addition, City Attorney Deitsch announced that as part of the Study Session, the City Council
on unanimous vote (5-0) approved a City Mulch Delivery Program and authorized an additional
appropriation of $10,000 from the Water Fund; he explained that the City would deliver, one
time, on a Tuesday or Thursday, 2 cubic yards of mulch per residential lot to any resident who
calls the City, and noted this is a water saving program.
Mayor Pro Tem Chandler added that this mulch is free of charge.
SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS
City Manager Lazzaretto advised the City Council that the City was contacted Monday afternoon
by the San Gabriel Valley Council of Governments that on Thursday evening they will be asking
their representatives to take a position on the 710 Freeway Extension Alternative; he advised
that Council Member Tay is the City's representative and should discuss with the City Council to
see if they have an opinion on the 710 Freeway Extension Alternative for discussion at
Thursday's meeting.

City Attorney Deitsch advised the City Council that two findings, by a super majority vote, at
least 4 affirmative votes would need to be made that (1) there is a need to take action tonight,
which City Manager Lazzaretto already explained; and (2) that the need to take action came to
the attention of the City after the agenda was posted.
It was moved by Mayor Pro Tem Chandler, seconded by Council Member Tay, and carried on
roll call vote to add make the required findings to add the item to the agenda relating to the 710
Freeway Extension Alternative.

A motion was made by Council Member Tay, seconded by Mayor Pro Tem Chandler, to read all
ordinances and resolutions by title only and waive the reading in full.
PRESENTATIONS
a. Presentation of Proclamation to Reverend Phil Wood who is being transferred from
Church of the Good Shepherd after 19 years.
b. Presentation of Certificates of Commendation to the Arcadia High School Quiz Bowl
Teams.
1. PUBLIC HEARING
a. Resolutions confirming Engineer Reports for the Arcadia Citywide Lighting
District No. 1 and the Arcadia Kaitlyn Place Landscaping and Lighting District.
Resolution No. 7070 confirming the Engineer's Report for the levy and collection
of the Arcadia Citywide Lighting District No. 1 and the assessment diagram
connected therewith; and ordering the levy and collection of assessments for
Fiscal Year 2015-16.
Recommended Action: Find that Resolution No. 7070 is exempt from the
requirements of the California Environmental Quality Act; and adopt Resolution
No. 7070
Resolution No. 7071 confirming the Engineer's Report for the levy and collection
of the Arcadia Kaitlyn Place Landscaping and Lighting District and the
assessment diagram connected therewith; and ordering the levy and collection of
assessments for Fiscal Year 2015-16.
Recommended Action: Find that Resolution No. 7071 is exempt from the
requirements of the California Environmental Quality Act; and adopt Resolution

Public Works Services Director Tait and Management Analyst Carmen Masud presented the
staff report.
Mayor Kovacic opened the public hearing.
A motion to close the public hearing was made by Mayor Pro Tem Chandler, seconded by
Council Member Wuo, and seeing no further objection, Mayor Kovacic declared the public
hearing closed.
It was moved by Mayor Pro Tem Chandler, seconded by Council Member Wuo, and carried on
roll call vote to find that Resolution No. 7070 is exempt from the requirements of the California
Environmental Quality Act, and adopt Resolution No. 7070 confirming the Engineer's Report for
the levy and collection of the Arcadia Citywide Lighting District No. 1 and the assessment
diagram connected therewith; and ordering the levy and collection of assessments for Fiscal
Year 2015-16.

PUBLIC COMMENTS
Mayor Kovacic announced that several individuals have turned in speaker cards relating to City
Manager item 4.a and will be allowed to give public comment at that time.
Alexis Proctor, an Arcadia resident, appeared and spoke about her qualifications to serve on the
Recreation and Parks Commission, and urged the City Council to appoint her.
Nabila Ebrahimi, a Pasadena resident, appeared and spoke about various legal matters of fraud
involving her and her husband.
Sue & Art Narevsky, Arcadia residents, appeared and shared a picture with the City Council,
regarding a vacant home right next door to them that they have been waiting for about a year to
be demolished and a new home rebuilt, and advised that they just received in the mail today
notice that the house on the other side of them is going to be demolished and a new home built;
they discussed traffic and cars that speed on their street, and requested speed bumps because
the street has now become a safety hazard.
Mrs. Narevsky asked if there were any City Codes or regulations where two houses are being
constructed on both sides of a property.

Mayor Kovacic suggested that Mr. and Mrs. Narevsky provide Development Services Director
Kruckeberg with their contact information for follow up.
Robert Stover, an Arcadia resident, appeared and rebutted comments made by Council
Members at a prior City Council meeting regarding the Highlands; and indicated that he believes
the City Council have ignored concerns and input from Arcadia residents.
REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the
City Council related to meetings attended at City expense [AB 1234])
Council Member Tay mentioned an article regarding housing in the Arcadia's Best website and
encouraged everyone to read it.
Mayor Pro Tem Chandler had nothing to report.
Council Member Beck responded to Alexis Proctor and Mr. & Mrs. Narevsky; he congratulated
Reverend Wood for his years of services to the community, and the Arcadia High School Quiz
Bowl Team; he stated that he was impressed to see many people at the meeting to share their
concerns; he also commented on various issues in the City such as construction, school district,
historic home preservation, and the election in April.
Council Member Wuo announced that he attended Park Lane Dental Office grand opening on
Saturday with Mayor Kovacic; he indicated that Park Lane Dental Office received the first
National Design Award in California and $2,500, which they donated to the Arcadia Police
Association; and wished all fathers a Happy Fathers' Day.
City Clerk Glasco announced various summer programs at the Arcadia Museum.
City Manager Lazzaretto thanked Reverend Wood for his years of service to the community; he
reminded everyone of the Patriotic Concert and Downtown Market event, the 626 Night Market
at the race track, summer concerts in the front lawn of City Hall and free movies in the park and
encouraged everyone to attend.
Mayor Kovacic commented on Reverend Wood's tenure in Arcadia; he commented on the
orientation of summer recreation activity leaders; and reminded everyone that on July 3 is the
Patriotic event at the Gold Line Station and the Downtown Market, and on July 4 is the Sierra
Madre parade and encouraged everyone to attend.
2. CITY CLERK
a. Appointments to City Boards and Commissions

Arcadia Beautiful Commission t2 ;positions)
Council Member Beck nominated Janalee Shimmin for reappointment, and Lee Shimmin for
appointment to the Arcadia Beautiful Commission.

By a majority vote of the City Council, Janalee Shimmin was reappointed to the Arcadia

Arcadia Museum Commission ( 1 position)
Council Member Beck nominated Virginia Blitz to fill the unexpired term of Lee Segal on the
Arcadia Museum Commission.

By majority vote of the City Council, Alice Wang was appointed to the Library Board for a four (4)

Planning Commission (2 positions)
Mayor Kovacic indicated that Planning Commission appointments will be handled separately. It
was the consensus of the City Council to interview all 12 applicants and directed staff to prepare
for interviews for the Planning Commission appointments in future years.
Recreation and Parks Commission (2 positions«
Council Member Beck nominated Raymond Cheung and Joseph Shivan for reappointment to
the Recreation and Parks Commission.

In response to a question raised by City Manager Lazzaretto, City Attorney Deitsch confirmed

4. CITY MANAGER
a. Rescind actions taken in Closed Session at the Mav 5. 2015. Continued S�)ecial
City Council meeting related to zonin-q and other studies in the Highland Oaks
area; consider taking new actions relative thereto; and consider Brown Act cease
and desist letters and related actions.
Recommended Action: Rescind previous actions and consider the foregoing
items
City Attorney Deitsch presented the staff report.
Mayor Kovacic opened the public comment for this item.
Scott Hettrick, CEO of the Arcadia Chamber of Commerce, appeared and asked that the City
Council consider separating out the commercial area from the Zoning Code update.
Matt McSweeney, Downtown Arcadia Improvement Association, did not come up but echoed
the same comments as Mr. Hettrick.
Jean Tsunashima, an Arcadia resident in the Highlands, appeared and expressed her
disappointment regarding the City Council's decision to stop the Zoning Code update process;
and urged the City Council to move forward with the Zoning Code update, including the
Highlands area, and the historical preservation survey.
David Arvizu, a representative of "Save the Arcadia Highlands" and petitioner in the lawsuit,
appeared and thanked the City Council for reconsidering the Zoning Code update; he reiterated
that the lawsuit is about CQEA, that nowhere in the lawsuit does it mention the Zoning Code
update or the historical preservation survey; and expressed his disappointment about the
exclusion of Highlands in the Zoning Code update and historical preservation.
Karen How, President of the Arcadia Historical Society, appeared and expressed their support
of historical preservation of homes in Arcadia.
Charles Greene, an Arcadia resident and Member of the Highlands Homeowner Association,
appeared and thanked the City Council for the Zoning Code update and historical preservation
survey and hopes that no areas are excluded.
Barry Gold, resident of Sierra Madre and Arcadia resident, appeared and urged the City Council
reconsider its decision regarding the Zoning Code update and historical preservation survey.

April Verlato, an Arcadia Highlands resident, appeared and thanked everyone for coming out to
the meeting regardless of their opinions; she commented on increased community awareness
and eagerness to have the Zoning Code updated; she indicated that the current Zoning Code is
insufficient to help protect views and privacy; and spoke about the intention of Resolution No.
6770 and preservation, and discussed putting limits on the square footage of homes.
Sharon Logan, representing the Downtown Arcadia Improvement Association, appeared and
urged the City Council to move forward with the Zoning Code update.
John Uniack, an Arcadia resident, appeared and spoke about inconsistencies in the adoption of
the Resolution No. 6770 regarding land use, and urged the City Council to move forward with
the update of the Zoning Code, including in the Highlands area.
Brett Mitulski, an Arcadia resident, appeared and spoke about the Zoning Code update and the
importance of historical preservation, and urged the City Council to listen to the residents and
take action in order to preserve the good parts of Arcadia; and spoke about above ground
telephone poles for the new homes and asked why they cannot be placed underground.
Tim Burch, an Arcadia resident, appeared and encouraged the City Council to rescind decisions
it made and continue the process of the Zoning Code update; he discussed the survey of
neighboring cities when the City Council adopted the real estate sign ordinance and questioned
why the City Council had not done the same for the Zoning Code update.
Kirk Olson, an Arcadia resident, appeared and spoke about the size of houses in Arcadia that
were built from 2012 to present.
Peter Amundson, an Arcadia resident and former Arcadia City Council Member, appeared and
thanked the City Council for reconsidering this item and reminded them not be sidetracked by
the lawsuit.
Roy McMean, an Arcadia Highlands resident, appeared and commented on the impact of the
development in Highlands is creating on traffic and the environment, and urged the City Council
to listen to the residents.
City Attorney Deitsch reported that the first motion for City Council consideration and action is to
direct the City Attorney to publicly report the vote of each Council Member concerning each of
the May 5, 2015, Closed Session actions, as previously told to newspapers.
It was moved by Council Member Beck, seconded by Council Member Wuo, and carried on roll
call vote to direct the City Attorney to publicly report the vote of each Council Member
concerning each of the May 5, 2015, Closed Session actions, as previously told to newspapers.

Mayor Kovacic called upon City Attorney Deitsch to provide the public statement.
City Attorney Deitsch reported that the City Council determined by a 3-2 vote with Mayor
Kovacic and Council Members Tay and Beck voting yes and Mayor Pro Tem Chandler and
Council Member Wuo voting no to proceed with a historical survey excluding the area within the
jurisdiction of the Highland Oaks Homeowners Association until the "Save the Arcadia

Highlands" litigation is resolved. The City Council further determined by a vote of 3-2 with
Mayor Pro Tem Chandler and Council Members Wuo and Tay voting yes and Mayor Kovacic
and Council Member Beck voting no to temporarily suspend the zoning Code update project
and neighborhood impacts committee work until the litigation is resolved.
City Attorney Deitsch reported that the second motion for City Council consideration and action
should be to rescind the actions taken in Closed Session at the May 5, 2015, Continued Special
City Council Meeting, which were noted above.
In response to a question raised by Mayor Pro Tem Chandler, Mayor Kovacic responded that
commercial and residential zoning are included in the rescinding action.
It was moved by Council Member Beck, seconded by Council Member Chandler, and carried on
roll call vote to rescind actions taken in Closed Session at the May 5, 2015, Continued Special
City Council Meeting concerning suspension of the following until resolution of the litigation in
Save the Arcadia Highlands vs. City of Arcadia, et al.: (1) rescind the suspension of work on the
Citywide Zoning Code update project, (b) rescind the suspension of the portion of the historical
preservation survey pertaining to the Highland Oaks Homeowners Association area, and (c)
rescind the suspension of further formation and meetings of the Citywide neighborhood impacts
committee.

Mayor Kovacic confirmed that all prior actions are rescinded.
City Attorney Deitsch reported that for City Council consideration are items that were considered
at the May 5, 2015, Closed Session and acted upon; that the City Council can take action to
approve the action taken at the May 5, 2015, again, or a variation thereof, or take no action
which would mean the Zoning Code update would proceed.
Regarding Work on the Citywide Zoning Code Update project:
It was moved by Mayor Kovacic, seconded by Council Member Beck, and carried on roll call
vote to continue with the Citywide Zoning Code update notwithstanding the lawsuit, no
exceptions.
A substitute motion was made by Mayor Pro Tem Chandler, seconded by Council Member Tay,
and carried on roll call vote, to suspend work on the Citywide Zoning Code update, including
commercial, residential and industrial until resolution of the Save the Arcadia Highlands, et al.
vs. City of Arcadia litigation.
City Attorney Deitsch announced that a substitute motion takes priority over a pending motion, if
it is seconded.

It was moved by Council Member Beck, seconded by Mayor Kovacic, and carried on roll call
vote to move forward with the citywide historical preservation survey including the Highland
Oaks Homeowners Association area.
A substitute motion was made by Mayor Pro Tem Chandler, seconded by Council Member Tay,
and carried on roll call vote to move forward with the Citywide historical preservation survey
excluding the Highland Oaks Homeowners Association area pending resolution of the Save the
Arcadia Highlands, et al. vs. City of Arcadia lawsuit.

Regarding further formation and meetings of the Citywide Neighborhood Impacts Committee:
It was moved by Mayor Pro Tem Chandler and seconded by Council Member Tay to suspend
further formation and meetings of the Citywide Neighborhood Impacts Committee pending
resolution of the Save the Arcadia Highlands, et al. vs. City of Arcadia lawsuit.
A substitute motion was made by Council Member Beck, seconded by Mayor Kovacic, to move
forward with further formation and meetings of the Citywide Neighborhood Impacts Committee.
The motion failed on the following roll call vote:

City Attorney Deitsch announced that because the substitute motion failed, the original motion
made by Mayor Pro Tem Chandler should be voted on.
Mayor Kovacic asked for a roll call of Mayor Pro Tem Chandler's original motion to suspend
further formation and meetings of the Citywide Neighborhood Impacts Committee pending
resolution of the Save the Arcadia Highlands, et al. vs. City of Arcadia lawsuit. The motion
carried on the following roll call vote:

Regarding taking any other action relative to the foregoing:
It was moved by Mayor Kovacic, seconded by Council Member Beck, to move forward with the
Citywide Zoning Code update for commercial areas and multi -family residential areas in the

Regarding authorizing dispatch of a letter to Mr. David Arvizu responding to his letters

a roll call vote to authorize and direct the Mayor to execute a letter to Mr. David Arvizu
responding to his letters threatening Brown Act litigation dated May 18 and June 2, 2015.

b. Discussion relating to the 710 Freeway Alternative Extension. (Added to the
Agenda)
City Manager Lazzaretto advised that the City was notified by the San Gabriel Valley Council of
Governments that on Thursday evening they will be asking their representatives to take a
position on the 710 Freeway Extension Alternative; he advised that Council Member Tay is the
City's representative and should discuss the item to see if the City Council has an opinion on
the 710 Freeway Extension Alternative for discussion at Thursday's meeting.
It was the consensus of the City Council that no official stance be taken by the City Council
regarding the 710 Freeway extension alternatives. Council Member Tay heard general
discussion from the City Council regarding the 710 Freeway extension alternatives, which he
could use during his deliberations at the San Gabriel Valley Council of Governments meeting on
Thursday.

Mayor Kovacic adjourned this meeting at 10:04 p.m. in memory of long time Arcadia resident
Janice Board and John Nicoloro of the Monrovia -Arcadia -Duarte Town Council to Tuesday, July
7, 2015, 6:00 p.m. in the City Council Chamber.
